01-08-2008 MINUTES REGULAR SESSION JANUARY 8, 2008 A Regular Meeting was held by the City Council of the City Schertz, Texas, on January 8,2008, at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present, to-wit: Mayor Hal Baldwin Council Member David Scagliola Council Member Tony Wilenchik Mayor Pro Tern John Trayhan Council Member Jim Fowler Council Member Michael Carpenter Staff Present: City Manager Don Taylor Assistant City Manager John Bierschwale City Secretary Brenda Dennis Assistant City Manager David Harris City Attorney Michael Spain Deputy City Secretary Mary Ybarra CALL TO ORDER Mayor Baldwin called the meeting to order at 6:30 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Council Member Carpenter gave the Invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. HEARING OF RESIDENTS Mayor Baldwin recognized the following: . Ms. Frances Rushing, President Schertz Chamber of Commerce who gave announcements on the Chamber's upcoming events. . Mr. Christopher Coronado, Schertz Youth Committee who announced the upcoming Youth Town Hall Meeting and invited the City Council to attend. . Mr. Robert Brockman, 1001 Elbel #411 who congratulated the street department on keeping the roads repaired and spoke on the new Library and School Bond issues. 1. Items by Council General Announcements Mayor Pro-Tem Trayhan . Will be attending the Schertz Housing Authority Meeting on Monday 14th January 6:30 p.m. Councilmember Fowler . Glad to be back and wished everyone a Happy New Year. City Council Regular Meeting January 8, 2008 67 Councilmember Scagliola · Also glad to be back wished everyone a Happy New Year Councilmember Wilenchik · Attend a recent Doggy Day meeting and it has been set for May 31 st. . Attended AACOG meeting on Tuesday 8th January · Attended Commissioners Court Meeting and mentioned some upcoming changes. Councilmember Carpenter · Attended the Library Board meeting Monday ih January and will be attending the upcoming Wednesday, 9th January P&Z meeting. · He will be out of the State on Tuesday 221ld January and will not be in attendance at the Council Meeting. 2. Items by Mayor · Mayor Baldwin read a letter sent by Lockheed Martin informing Council they are in the process of re-competing all of the contracts they currently have and should they not get those contracts that they will be informing approximately 230 employees of a reduction. · Mayor Baldwin read a thank you letter from a citizen regarding the recent services of the Schertz Fire Department. INTRODUCTIONS: New city employees in the Police and Animal Control Department. Brad Bailey Media Relations introduced and read short biographies on his two new employees Leslye Hernandez and Amanda Davenport. Chief Starr introduced and read short biographies on new Communication Officers Christine Cosentino and Vicki Tackett, he also introduced and read biographies on new ACO Operators Mary Pruette, Tina Presi and Timothy Ross. PRESENTATIONS · Mayor Baldwin read into record the categories for the Christmas Lighting Contest and introduced Patti White Executive Administrative Assistant who showed a brief PowerPoint on the finalist. Mayor Baldwin asked all finalists in the audience to stand and be recognized. The following were given awards: First Place Second Place Third Place 3657 Diamond Falls - Alexander Family 6407 Pfeil- Greenwood Family 509 Mitchell - Brummett Family Mayor Baldwin presented the trophies. Mayor Baldwin introduced Assistant City Manager David Harris who introduced Mr. Anthony Mills, TMRS who spoke regarding the changes in the TMRS Retirement System answering questions from Council. ACTION ITEMS 3. APPOINTMENT OF THE SECRET ARY - Consideration Deputy City Secretary. CITY SECRETARY AND DEPUTY CITY and/or action appointing the City Secretary and the Mayor Baldwin introduced Brenda Dennis as the new City Secretary for Schertz and also thanked Mary Ybarra for her service in serving as Interim City Secretary. Mayor Baldwin recognized Mayor Pro Tern Trayhan who moved seconded by Council Member Wilenchik to appoint Brenda Dennis as City Secretary and Mary Ybarra as the Deputy City Secretary. Vote was unanimous. Motion Carried 4. MINUTES: Consideration and/or action regarding the approval of the December 18, 2007 and December 20, 2007 City Council minutes. Mayor Baldwin recognized Council Member Carpenter who moved seconded by Mayor Pro Tern Trayhan to approve the minutes of December 18, 2007 with the corrections and the minutes of December 20,2007. Vote was unanimous. Motion Carried 5. 50TH Anniversary Committee - Update on the Committees upcoming events and consideration and/or action on amending the 50th Anniversary Committee By-laws. Mayor Baldwin recognized Chair Vallery Mallard who updated the Council on the recent activities of the Committee. Ms. Mallard also asked that council reconsider the number of quorum members. After considerable discussion, Mayor and Council asked that this item be placed back on the 15th agenda for further discussion. 6. RESOLUTION NO. 08-R-OI - Consideration and/or action reappointing Mayor Hal Baldwin to the Board of Directors of the Austin-San Antonio Intermunicipal Commuter Rail District (Rail District). Mayor Baldwin recognized Mayor Pro Tern Trayhan who moved seconded by Council Member Carpenter to reappoint Mayor Hal Baldwin to the Board of Directors of the Austin-San Antonio Intermunicipal Commuter Rail District. Vote was unanimous. Motion Carried 7. RESOLUTION NO. 08-R-03 - Consideration and/or action on approving a resolution authorizing a Planning Services Agreement with Mitchell Planning Group, LLC. Mayor Baldwin recognized Assistant City Manager David Harris who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Carpenter who moved seconded by Council Member Fowler to approve Resolution No. City Council Regular Meeting January 8, 2008 69 08-R-03 authorizing a Planning Services Agreement with Mitchell Planning Group, LLC. Vote was unanimous. Motion Carried 8. ORDINANCE NO. 08-S-01 - Consideration and/or action on approval of final reading of an ordinance amending the Unified Development Code (UDC) Ordinance 96-S-28, as amended by granting a Specific Use Permit for 7.79 .:!:: acres ofland out of the Calvin B. Abbott Survey Number 262, Abstract 18, Comal County, Texas authorizing a heavy equipment sales and rental establishment as a new and unlisted use; providing an effective date; and providing a repealing clause. Mayor Baldwin recognized Council Member Carpenter who moved seconded by Mayor Pro Tern Trayhan to approve Ordinance No. 08-S-01 on final reading. Vote was unanimous. Motion Carried 9. ORDINANCE NO. 08-S-02 - Consideration and/or action on approval of final reading of an ordinance amending the Unified Development Code (UDC) Ordinance 96-S-28 by amending Article XI (Platting), sections 32.3, 32.4, 32.9.2 and 32.9.3, Park and Recreation areas; providing an effective date; and providing a repealing clause. Mayor Baldwin recognized Thomas Rhodes, Interim Planning Manager who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Carpenter who moved seconded by Council Member Scagliola to approve Ordinance No. 08-S-02 on final reading and provide information to the Council regarding expenditure of parkland dedication funds. Vote was unanimous. Motion Carried 10. ORDINANCE NO. 08-A-03 - Consideration and/or action on approval of first reading on an Ordinance regarding Annexation (Lookout Road). Mayor Baldwin recognized Thomas Rhodes, Interim Planning Manager who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Fowler who moved seconded by Council Member Carpenter to approve an Ordinance No, 08-A-03 on first reading regarding Annexation of Lookout Road. Vote was unanimous. Motion Carried 11. ORDINANCE NO. 08-8-04 - Consideration and/or action on approval first reading of an Ordinance regarding Animal Control. (S. Starr) Mayor Baldwin recognized Police Chief Starr who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Carpenter who moved seconded by Mayor Pro Tern Trayhan to approve an Ordinance No. 08-H-04 on first reading regarding amending the Animal Control Ordinance. Vote was unanimous. Motion Carried DISCUSSION ITEMS City Council Regular Meeting January 8, 200S 70 12. Sign Ordinance - Update on amending the City Of Schertz Sign Ordinance. (L. Truitt) Mayor Baldwin introduced Mr. Leonard Truitt, Development Services Director who introduced this item answering questions from Council. Mr. Truitt mentioned several changes being proposed by the Planning and Zoning Commission. He indicated that the Planning and Zoning Commission will be discussing this at their up coming meetings of January 9, 23, 2008 and will be bringing this back to City Council for first reading at the meeting of February 19, 2008. No action taken. 13. Items by City Manager Taylor and Staff . General Announcements Don Taylor, City Manager announced that the Kramer house is scheduled to be moved Thursday, January 10th at 10:00 a.m. EXECUTIVE SESSION 14. Take any action deemed necessary as a result of the Executive Session. City Council did not meet in Executive Session.
