01-15-2008 MINUTES REGULAR SESSION JANUARY 15,2008 A Regular Meeting was held by the City Council of the City Schertz, Texas, on January 15, 2008, at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present, to-wit: Mayor Hal Baldwin Council Member David Scagliola Council Member Tony Wilenchik Mayor Pro Tern John Trayhan Council Member Jim Fowler Council Member Michael Carpenter Staff Present: City Manager Don Taylor City Secretary Brenda Dennis Assistant City Manager John Bierschwale CALL TO ORDER Mayor Baldwin called the meeting to order at 6:30 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Council Member Fowler gave the Invocation followed by the Pledges of Allegiance to the Flags ofthe United States and State of Texas. HEARING OF RESIDENTS Mayor Baldwin recognized the following: . Ms. Frances Rushing, President Schertz Chamber of Commerce who gave announcements on the Chamber's upcoming events. . Mr. Ed "Grumpy" Azzoz, 528 Wayward Pass who spoke against having the Library being built in-house and on the Grackle Fest. . Mr. Robert Brockman, 1000 Elbel #411 who spoke on issues of FM 1518. PRESENTATIONS . Update on status of Schertz Tales Magazine Mayor Baldwin recognized Brad Bailey, Director of Media Relations and Leslye Hernandez, Marketing Specialist who gave a PowerPoint presentation on the status and future of the Schertz Tales Magazine answering questions from Council. ANNOUNCEMENTS Council General Announcements: City Council Regular Meeting January 15, 2008 72 Mayor Pro-Tem Trayhan · Recently attended the Schertz Housing Authority meeting Monday, January 14,2008. Councilmember Fowler · Announced last weekend his church held a fund raising golf tournament for a young man to raise funds for wheelchair; he congratulated City Manager Don Taylor and his team and appreciated their support. Councilmember Scagliola · Recognized and congratulated the Schertz Chamber of Commerce for obtaining many memberships and stated that he had attended a recent ribbon cutting at the Little Spurs Pediatric Urgent Care. Councilmember Wilenchik · Attended Commissioners Court meeting today and the ACOG meeting that followed. · He state that the Financial Peace University Course class will be starting Thursday, January 17, 2008 at 6:30 p.m. at the Police Training Room. Sessions to last approximately two hours and the course is a 13-week course and a certificate of completion will be issued at the end of the course. Cost is $139.00 and that Schertz Bank and Trust has agreed to sponsor 50% of the cost for everyone who completes the course. Councilmember Carpenter · He will be out of the State on Tuesday 22nd January and will not be in attendance at the Council Meeting. . 50th Anniversary Plaque presentation has been postponed until the 29th Council meeting. · He attended the Planning and Zoning meeting last week and at that meeting they requested a joint meeting be held with Council to roll out the revised UDC and their second request is to have staff bring to Council a moratorium on Electronic Signs until the Sign Ordinance could be finalized. Items by Mayor · Invited cItIzens to attend the Thursday, January 17, 2008 Historical Preservation Committee for a presentation by Donna Semmes and Dean Wiertz on their trip to Riedesheim France, which is the birthplace of Sebastain Schertz. · Announced the Schertz Seguin Local Government Corporation meeting scheduled Thursday, January 17,2008 at 1 :30 in the Municipal Complex Conference Room. · Mayor Baldwin announced that former Council Member Tim Sweeney recently lost his oldest son Robert the viewing has been set for Wednesday, January 16th from 6 to 8 p.m. at the Schertz Funeral Home and services will be held at the First Baptist Church on Pat Booker in Universal City on the 1 ih at 1 :00 p.m. please keep the family in your prayers. City Council Regular Meeting January 15, 2008 73 . Announced that Steve White's wife had a stroke and to also keep them in your prayers. 1. Minutes - Consideration and/or action regarding the approval of the minutes of the regular meeting of January 8, 2008. Mayor Baldwin recognized Mayor Pro Tern Trayhan who moved seconded by Council Member Fowler to approve the minutes of January 8, 2008 with the corrections. Vote was unanimous. Motion Carried 2. Ordinance No. OS-A-03 - Consideration and/or action on approval of final reading on an Ordinance regarding Annexation. Final Reading Mayor Baldwin recognized Council Member Carpenter who moved seconded by Mayor Pro Tern Trayhan to approve final reading of Ordinance No. 08-A-03. Vote was unanimous. Motion Carried 3. Resolution No. OS-R-02 - Consideration and/or action approving a resolution authorizing an agreement with iService Online. (D. Taylor) Mayor Baldwin indicated that this item had been pulled from this agenda would be on the January 22, 2008 agenda for consideration. 4. Bid # 07-CMR-48-P - Consideration and/or action awarding a bid to Craig R Doyle for the printing, binding, and labeling of Schertz Tales Magazine. (B. Bailey) Mayor Baldwin recognized Brad Bailey Director of Media Relations who introduced this item answering questions from Council. Mayor Baldwin recognized Mayor Pro Tern Trayhan who moved seconded by Council Member Carpenter to approve award of Bid # 07-CMR-48-P to Craig R Doyle for printing, binding, and labeling of Schertz Tales Magazine. Vote was unanimous. Motion Carried 5. Bid # 07-PW-48-M - Consideration and/or action awarding a bid to Johnson Lab & Supply Inc. for installation of radio read meters. (K. Lewinski) Mayor Baldwin recognized Kim Lewinski, Purchasing Manager and Sam Willoughby, Public Works Director who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Scagliola who moved seconded by Mayor Pro Tern Trayhan to approve award of Bid # 07-PW-48M to Johnson Lab & Supply Inc. for installation of radio read meters. Vote was unanimous. Motion Carried City Council Regular Meeting January 15, 2008 74 REGULAR AGENDA 6. Ordinance No. 08-H-04 - Consideration and/or action on approval of final reading of Ordinance No. 08-H-04 regarding Animal Control. (S. Starr) Final Reading Mayor Baldwin recognized Police Chief Steve Starr and Animal Control Supervisor Brenda McGlothlin who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Scagliola who stated that he was still concerned about having a provision in the Ordinance that would allow the Schertz Human Society to house temporarily more than the number of animals the ordinance requires. City Manager Don Taylor stated that he had spoken to the Chief on this subject and had directed staff to come up with the language and a way of allowing this provision and that this item would be brought back to Council at a later meeting. No action taken on this item. 7. Bid Award for the Schertz Library - Consideration and/or action approving bid # for the Schertz Library. (L. Truitt) Mayor Baldwin recognized Leonard Truitt Director of Development Services who introduced this item answering questions from CounciL Mr. Truitt introduced David Dorrough, Project Manager, who came forward answering questions from Council concerning the ability to bring the project in-house. Mayor Baldwin recognized Mr. Ronald Biediger, aia with KeU Munoz Architects to come forward answering questions regarding the point system that was used to determine the bid award. Mayor Baldwin recognized Mr. O'Haver with O'Haver Contractors who came forward asking questions of Council and providing clarity of his bid. After considerable discussion, Mayor Baldwin recognized Council Member Carpenter who moved seconded by Mayor Pro Tern Trayhan to award the bid to O'Haver Construction not to exceed $6,497,423 to include alternatives 1, 2 and 3. The vote was 4 ayes and 1 nay, with Council Member Wilenchik voting nay. Motion carried. 8. Ordinance No. 08->>-05 - Consideration and/or action approving an ordinance amending Section 86-115 of the Schertz Code of Ordinances revising maximum limits on specific streets and providing a repealing clause. 1st Reading (S. Starr) Mayor Baldwin recognized Police Chief Steve Starr who introduced this item answering questions from Council. Mayor Baldwin recognized Mayor Pro Tern Trayhan who moved seconded by Council Member Fowler to approve Ordinance No. 08-D-05 on first reading. Vote was unanimous. Motion Carried 9. 50th Anniversary Committee - Discussion regarding Resolution No. 06-R-30 appointment members to the committee. (V. Mallard) City Council Regular Meeting January 15, 2008 75 Mayor Baldwin recognized Vallery Mallard who introduced this item answering questions from CounciL Council directed staff to bring back a revised resolution changing the number of members assigned to the Committee from seven to five and to change the Bylaws to indicate that three members would constitute a quorum. PUBLIC HEARINGS/ORDINANCES 10. SUP 2007-009 - Ordinance No - Conduct a public hearing and consideration and/or action approving first reading of an ordinance for a Specific Use Permit (SUP) for Lots 2 and 3, Block 2 of the Windy Meadows Subdivision (proposed Pape Subdivision). The proposed commercial lot is within the Air Installation Compatible Use Zone (AICUZ). The 3.1+/- acre tract is zone General Business - 2 (GB2). The tract is situated out of the Genobera Malpaz Survey No. 67 Abstract No. 221, Guadalupe County, Schertz Texas. The property is located approximately 85 feet east of the intersection of FM 1518 on Windy Meadows Drive. 1st Reading (M. Nichols) Mayor Baldwin stated that the applicant had withdrawn his application, therefore; no action was required. 11. SUP 2007 - 010 - Ordinance No. 08-S-06 - Conduct a public hearing and consideration and/or action approving first reading of an ordinance for a Specific Use Permit (SUP) for Lots 35 and 36, Block 1 of the Nell Deane Subdivision. The proposed commercial lot is within the Air Installation Compatible Use Zone (AICUZ). The 2.0 + acre tract is zoned General Business - 2 (GB2). The tract is situated out of the Genobera Malpaz Survey No. 67 Abstract No. 221, Guadalupe County, Schertz, Texas. The property is located approximately 412 feet of the intersection ofFM 1518 on Nell Deane Street. 1st Reading (M. Nichols). Mayor Baldwin recognized Misty Nichols, Planner II who introduced this item answering questions from Council. Mayor Baldwin opened the public hearing and recognized the following who spoke in favor of this item: Mr. Robert Brockman, 1000 Elbel and Mr. Raymon Cook, 913 Dimrock Drive. Mayor Baldwin recognized Mr. Sean Garity who came forward answering questions from Council. There being no one else to speak; Mayor Baldwin closed the public hearing and recognized Mayor Pro Tern Trayhan who moved seconded by Council Member Carpenter to approve first reading of an Ordinance for a Specific Use Permit (SUP) for Lots 35 and 36, Block 1 of the Nell Deane Subdivision. Vote was unanimous. Motion Carried DISCUSSION ITEMS 12. Items by City Manager Taylor and Staff . General Announcements - City Manager Taylor thanked the Mayor and Council Member Fowler for their involvement in the recent golf tournament given by Council Member Fowler's Church in raising money for a great cause.
