MINUTES
REGULAR SESSION
JANUARY 22, 2008
A Regular Meeting was held by the City Council of the City Schertz, Texas, on January 22,
2008, at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway,
Building #4, Schertz, Texas. The following members present, to-wit:

CALL TO ORDER
Mayor Baldwin called the meeting to order at 6:30 p.m.
INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED
STATES AND STATE OF TEXAS.
Council Member Fowler gave the Invocation followed by the Pledges of Allegiance to the Flags
ofthe United States and State of Texas.
HEARING OF RESIDENTS
Mayor Baldwin recognized the following:
. Ms. Frances Rushing, President Schertz Chamber of Commerce who gave
announcements on the Chamber's upcoming events. They are as follows:
January 3rd was her fIrst year anniversary - appreciated the kind words from
Council Member Scagliola at the last meeting.
As of today 11 new members since January 3rd and several renewals
January 25th Monthly Chamber Luncheon at 11 :30
January 31 st Trail Riders coming through - contact the Chamber Offices or David
Peveto at Schertz Bank and Trust to volunteer.
March 13th is the date scheduled for the Business Appreciation Gala - time and
place to be announced.
. Mr. Steve White, 805 Main Street who updated the Council on the recovery of his wife
and also spoke on consideration of pay for the Mayor and Council Members.
. Mr. Robert Brockman, 1000 Elhel #411 who spoke on issues of date of the Library
ground breaking and also on wording items on the agenda to be more clear.

Council General Announcements:
Mayor Pro- Tem Trayhan
. None
Council Member Fowler
. Would like an item placed on an upcoming agenda for meetings with various Boards
and Commissions.
Council Member Scagliola
· Last Thursday he attending the Historical Preservation Committee meeting and was
very impressed with the presentations given.
. He will not be attended the Planning and Zoning meeting.
Council Member Wilenchik
. None
Council Member Carpenter
. Would like information on public transportation within in the City on the Commuter
Rail System - get a schedule of their meetings.
. He will be attending the January 23rd Planning and Zoning meeting where they will
discuss the proposed sign ordinance.
. Last week he attended the Schertz Youth Commission meeting.
Items by Mayor
. Announced that the Council and the Planning and Zoning Commission will hold a
joint meeting on January 29th at 5:30 p.m. in the conference room to go over the
revised Unified Development Code.
. Stated that the Commuter Rail Committee has only had one meeting so far this year
and the next is scheduled for mid February.
. That he had attended the Thursday Historical Preservation Committee meeting and it
was a great presentation and hopes to include some of the information in the
upcoming 50th celebration.

regular meeting of January 15, 2008.
Mayor Baldwin recognized Mayor Pro Tern Trayhan who moved seconded by Council
Member Fowler to approve the minutes of January 15, 2008. Vote was unanimous.

2. Ordinance No. 08-D-05 - Consideration and/or action approving fmal reading of
Ordinance No. 08-D-05 amending Section 86-115 of the Schertz Code of Ordinances
revising maximum limits on specific streets and providing a repealing clause. Final

Mayor Baldwin recognized Police Chief Starr who introduced this item answermg
questions from Council.
No action.
3. Ordinance No. 08-S-06 - SUP 2007-010 - Consideration and/or action approving fmal
reading of Ordinance No. 08-S-06 for a Specific Use Permit (SUP) for Lots 35 and 36,
Block 1 of the Nell Deane Subdivision. The proposed commercial lot is within the Air
Installation Compatible Use Zone (AICUZ). The 3.1 + acre tract is zoned General
Business - 2 (GB2). The tract is situated out of the Genobera Malpaz Survey No. 67
Abstract No. 221, Guadalupe County, Schertz, Texas. The property is located
approximately 412 feet east of the intersection ofFM 1518 on Nell Deane Street. FinaL

questions from Council.

4. Resolution No. 08-R-02 - Consideration and/or action approvmg a resolution
authorizing an agreement with iService Online. (D. Taylor)
Mayor Baldwin recognized City Manager Don Taylor and Assistant City Manager John
Bierschwale who introduced this item answering questions from Council.
Mayor Baldwin recognized Mayor Pro Tern Trayhan who moved seconded by Council
Memher Scagliola to approve Resolution No. 08-R-02 authorizing an agreement with
iService Online. The vote was unanimous. Motion Carried
5. Resolution No. 08-R-04 - Consideration and/or action approving a resolution amending
Resolution No. 06-R-30 changing the number of committee members and changing the
Bylaws to state that three members constitute a quorum and Council direction on selling
of advanced tickets for the dance and selling of trees. (D. Taylor)
Mayor Baldwin recognized City Manager Don Taylor who introduced this item
answering questions from Council.
Mayor Baldwin recognized Council Memher Carpenter who moved seconded by Mayor
Pro Tern Trayhan to approve Resolution No. 08-R-04 amending Resolution No. 06-R-30
reflecting that fIve members be appointed to the committee and changing the Bylaws to
reflect same plus approval of selling advanced tickets for the dance and advance tickets
for selling trees hut to include language "dedicate in honor of' as well as "in memory of'.
The vote was unanimous. Motion Carried
6. Resolution No. 08-R-05 - Consideration and/or action approving a resolution calling the
May 10th Joint Election with the City of Ciholo and SCUC Independent School District

and approving a election contract with Guadalupe County for election services. (B.
Dennis)
Mayor Baldwin recognized City Secretary Brenda Dennis who introduced this item
answering questions from Council.
Mayor Baldwin recogilized Mayor Pro Tern Trayhan who moved seconded by Council
Member Carpenter approve a Resolution No. 08-R-05 calling the May 10th Joint Election
changing "his" to "hers" in Section 10. The vote was unanimous. Motion Carried
7. Agreement with Schertz Sweetheart Court - Consideration and/or action approving an
agreement with the Schertz Sweetheart Court. (D. Taylor)
Mayor Baldwin recognized City Manager Don Taylor who introduced this item
answering questions from Council. He stated at the request of the Council negotiated and
would enter into a memorandum of understanding to provide formal recognition by and
for the City with the Miss Sweethearts Court Corporation on related matters. Mr. Taylor
has met with Jennifer Bishop, the President of the Miss Sweethearts Court Corporation.
After discussion with Ms. Bishop, it was determined the Miss Sweethearts Court would
become a city function. The 501(c) 3 Corporation will be dissolved.
The amount of money budgeted for this project is $3,000. The Schertz Chamber of
Commerce has refunded this money. The money shall be used for the following items:
. Fuel for truck to pull float.
. Annual gala and nomination dinner (to include food)
· Charm bracelets for each girl participant and lapel pin for each boy participant
Mayor Baldwin recognized Council Member Fowler who moved seconded by Council
Member Scagliola to approve a memorandum resolution agreement with the Schertz
Sweetheart Court. The vote was unanimous. Motion Carried
8. Resignation of the Assistant Municipal Teen Court Judge and approval of a
Resolution appointing Mr. Dullnig as the Teen Court Administrator - Consideration
and/or action accepting the resignation of Darrell Dullnig as Assistant Municipal Teen
Court Judge and approve a resolution appointing him as the Teen Court Administrator.

Mayor Baldwin recognized Assistant City Manager Bierschwale who introduced this
item answering questions from Council.
Mayor Baldwin recognized Council Member Carpenter who moved seconded hy Mayor
Pro Tern Trayhan to accept the resignation of Darrell Dullnig as Assistant Municipal
Teen Court Judge and reappoint him as the Teen Court Administrator. The vote was
unanimous. Motion Carried

BOARDS/COMMISSIONS
9. Appointment/Reappointment to Boards and Commissions/Committees - Consider
approval regarding appointments/reappointments to Boards and
Commission/Committees.
Mayor Baldwin recognized Council Member Scagliola who moved seconded by Council
Member Fowler to reappoint Mr. Andrew Bores, and Mr. Larry Franklin to the TSAC
Board. The vote was unanimous. Motion Carried
Mayor Baldwin asked that an item be placed on the next agenda to appoint a member to
the Historical Preservation Committee.
DISCUSSION ITEMS
10. General Announcements: Items by City Manager Taylor and Staff
. Update on proposed road improvement for land located behind City Hall
Mayor Baldwin recognized Parks & Recreation Director George Logan who came
forward updating the Council on the road improvements and answering questions.
. City Manager Don Taylor - Mr. Taylor had no announcements.
ADJOURNMENT
