01-29-2008 MINUTES JOINT WORKESSION AND REGULAR SESSION JANUARY 29, 2008 A Joint Worksession was held by the City Council and the Planning and Zoning Commission at 5:30 p.m., in the Municipal Complex Council Conference Room and a Regular Meeting was held by the City Council of the City Schertz, Texas, on January 29, 2008, at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. Presentation and brief discussion by Mitchell Planning Group regarding the revised Unified Development Code Presentation and Discussion (T. Rhodes) CALL TO ORDER Mayor Baldwin and Chairman Richmond called the joint meeting to order at 5:30 p.m. Mayor Baldwin recognized Thomas Rhodes, Planning Manager who introduced this item with a PowerPoint presentation answering questions from both the City Council and the Planning and Zoning Commission. ADJOURNMENT City Council, Planning and Zoning Commission adjourned the Joint Worksession at 6:25 p.m. City Council Regular Meeting January 29, 2008 83 CITY COUNCIL REGULAR SESSION CALL TO ORDER Mayor Baldwin called the regular meeting to order at 6:33 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Council Member Carpenter gave the Invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. HEARING OF RESIDENTS Mayor Baldwin recognized the following: · Ms. Frances Rushing, President Schertz Chamber of Commerce who gave announcements on the Chamber's upcoming events. They are as follows: Luncheon Recap, Chamber Luncheon will be Feb 29 (leap year), 11 :30, at the Civic Center with Life/business coach Penny Powers as featured speaker. Thanks to Jim Wolverton for serving as featured speaker at Jan 25 Chamber Luncheon, Sam Clemens DECA president spoke regarding district and state competition; Chamber board presented $250 to help club get to Corpus state competition; Dixie Bane donated $54 from SO/50 drawing, Leslye Hernandez donated, and Melvin Golla/Schertz Bank and Trust donated $750; club took home $1100 from Friday's luncheon. Trailriders Stew Lunch: Greater Randolph Area Trailriders and Kerr Country Trailriders will arrive between 11 a.m. and 1 p.m. Thursday at Pickrell Park, where Schertz Bank and Trust, City of Schertz and Schertz Chamber will serve stew them prior to their final leg into San Antonio for the annual stock show and rodeo; Still need volunteers to help prepare the stew and to help keep an eye on and stir the stew through the night. Stew prep begins Wednesday afternoon at 4-5 p.m., and Melvin Golla and Company will be feeding the volunteers. Ribbon Cuttings: Ambassador Chair is working with several new businesses to plan ribbon cuttings for the first and second week of February. Will send out e-mail announcements beginning a week from the dates, so please keep an eye out for our notes February 14: Valentines Day - Don't forget chamber member businesses including Bud and Bloom, HEB, Wal-Mart, and Sams have beautiful flowers, plants and gifts for your sweethearts. .~ '-----" City Council Regular Meeting January 29, 2008 84 ~ March 14: Annual Business Appreciation Dinner/Gala - Casino Night - will be held at the Schertz Civic Center. Invitations will go out the 2nd week of February, so watch your mailbox for your invitation. . Mr. Robert Brockman, 1000 Elbel #411 who spoke on the recent water main break on Schertz Parkway and other issues related to the city. . Mr. David Richmond, 2921 Bent Tree Drive who spoke in favor of Agenda Item 6, Electronic sign ninety-day moratorium. . Mr. Mark Roberts, 4300 Spanish Oak who also spoke on Agenda Item 6, Electronic sign ninety-day moratorium. ANNOUNCEMENTS Council General Announcements: Mayor Pro-Tem Trayhan . None Council Member Fowler . Attended the recent Schertz Youth Commission Town Hall meeting, the Monday January 28, Parks & Recreation meeting and mentioned the activities being planned. Council Member Scagliola . Attended last Friday's Chamber Luncheon as well as the Schertz Youth Commission Town Hall meeting. Council Member Wilenchik . Attended the recent Board of Adjustment meeting Monday, January 28, and would be attending the January 30' AACOG Advisory Committee meeting. . Council Member Wilenchik announced that Mr. Ralph Barnett had passed away and recognized his service and achievements for the City of Schertz. Council Member Carpenter . Attended a recent press conference for the San Antonio Metropolitan Youth Soccer Association in which they announced upcoming events planned in March. Items by Mayor . None PRESENT A TION . 50th Anniversary Committee to Honor Past Leaders of Schertz (presenter Brad Bailey) City Council Regular Meeting January 29, 2008 85 Mayor Baldwin recognized Brad Bailey, Media Relations who came forward introducing this item. Mr. Bailey introduced and recognized the Chair of the 50th Anniversary Committee Vallery Mallard, who updated the Council stating that as mentioned every month the Committee would be hosting an event in celebration of the upcoming Schertz 50th Anniversary and stated that the Committee will be honoring this evening former Mayors, Council Members and family members with a commemorative wall plaque with each of their names listed. Mayor Baldwin recognized each honored quest in the audience and had them stand. Mayor Baldwin stated that before the unveiling of the plaque he wanted to recognize an outstanding Citizen. Mayor Baldwin recognized Mr. Ramon Cook for his many years of dedicated service to the City of Schertz and the community presenting him with a trophy for his services. Mayor Baldwin adjourned the meeting for a brief recess at 7:05 p.m. and asked if everyone would join them in the Foyer for the unveiling of the commemorative plaque followed by refreshments. Mayor Baldwin reconvened the meeting at 7:26 p.m. REGULAR AGENDA 1. Minutes - Consideration and/or action regarding the approval of the minutes of the regular meeting of January 22,2008. Mayor Baldwin recognized Council Member Carpenter who moved seconded by Mayor Pro Tern Trayhan to approve the minutes of January 22, 2008 with corrections. Vote was unanimous. Motion Carried 2. Ordinance No. 08-D-05 - Consideration and/or action approving final reading of Ordinance No. 08-D-05 amending Section 86-115 of the Schertz Code of Ordinances revising maximum speed limits on specific streets and providing a repealing clause. Final Reading (S. Starr) Mayor Baldwin recognized Police Chief Star who introduced this item answenng questions from Council. Mayor Baldwin recognized Council Member Scagliola who moved seconded by Council Member Fowler to approve final reading of Ordinance No. 08-D-05. Vote was unanimous. Motion Carried 3. Ordinance No. 08-S-06 - SUP 2007-010 - Consideration and/or action approving final reading of Ordinance No. 08-S-06 for a Specific Use Permit (SUP) for Lots 35 and 36, Block 1 of the Nell Deane Subdivision. The proposed commercial lot is within the Air City Council Regular Meeting January 29, 2008 86 Installation Compatible Use Zone (AICUZ). The 3.1 + acre tract is zoned General Business - 2 (GB2). The tract is situated out of the Genobera Malpaz Survey No. 67 Abstract No. 221, Guadalupe County, Schertz, Texas. The property is located approximately 412 feet east of the intersection ofFM 1518 on Nell Deane Street. Final Reading (M. Nichols) Mayor Baldwin recognized Misty Nichols, Planner II who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Fowler who moved seconded by Council Member Carpenter to approve final reading of Ordinance No. 08-S-06. Vote was unanimous. Motion Carried 4. Interlocal Agreement for Detention Services with City of San Antonio - Consideration and/or action approving an Interlocal Agreement for Detention Services. (S. Starr). Mayor Baldwin recognized Police Chief Star who introduced this item answering questions from Council. Council requested this item be withdrawn from this agenda and moved to the February 5,2008 agenda to identify the funding line item. 5. Ordinance No. 08-H-04 - Consideration and/or action on approval of final reading of an Ordinance regarding Animal Control. (S. Starr) Final Reading. Mayor Baldwin recognized Police Chief Star who introduced this item answenng questions from Council. Mayor Baldwin recognized Mayor Po Tem Trayhan who moved seconded by Council Member Carpenter to approve final reading of Ordinance No. 08-H-04 with changes. Vote was unanimous. Motion Carried 6. Resolution No. 08-R-07 - Consideration and/or action on approval of a Resolution establishing a temporary ninety-day Moratorium for electronic signs. (M. Carpenter/L. Truitt) Mayor Baldwin recognized Leonard Truitt Director of Development Services who introduced this item answering questions from Council. Mayor Baldwin recognized David Richmond Chair of the Planning and Zoning Commission who came forward further expressing the desire of the Commission to approve this item while the Sign Ordinance is being reviewed. Members of Council discussed the possibility of a forty- five day Moratorium instead of a ninety-day. Mayor Baldwin recognized Mayor Pro Tern Trayhanwho moved seconded by Council Member Scagliola to approve Resolution No. 08-R-07 establishing a temporary ninety- day moratorium. The vote was 3/2/0 with Council Members Trayhan, Scagliola, and City Council Regular Meeting January 29, 2008 87 Fowler voting aye and Council Members Carpenter and Wilenchik voting nay. Motion Carried BOARDS/COMMISSIONS 7. AppointmentlReappointment to Boards and Commissions/Committees - Consider approval regarding appointments/reappointments to Boards and Commission/Committees. Mayor Baldwin recognized Council Member Carpenter who moved seconded by Mayor Pro Tern Trayhan to appoint Mr. John Correu, and Mr. Larry Brenner to the Historical Preservation Committee. The vote was unanimous. Motion Carried DISCUSSION ITEMS 8. General Announcements: Items by City Manager Taylor and Staff . Mr. Taylor was absent - Assistant City Manager Bierschwale stated he had no announcements.
