02-05-2008 MINUTES REGULAR SESSION FEBRUARY 5, 2008 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on February 5, 2008, at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present, to-wit: Mayor Hal Baldwin Council Member David Scagliola Council Member Tony Wilenchik Mayor Pro Tern John Trayhan Council Member Jim Fowler Council Member Michael Carpenter Staff Present: City Manager Don Taylor City Secretary Brenda Dennis Assistant City Manager John Bierschwale Assistant City Manager David Harris CALL TO ORDER Mayor Baldwin called the meeting to order at 6:30 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Council Member Carpenter gave the Invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. HEARING OF RESIDENTS Mayor Baldwin recognized the following: . Ms. Frances Rushing, President Schertz Chamber of Commerce who announced that this Thursday the Capital One Bank in Schertz will be hosting their annual Mardi Gras Event from 5:30 p.m. to 7:30 p.m. Ms. Rushing also gave an update on Ms. Debbie Krause and also mentioned that her assistant Ms. Debbie Gildea was out ill. . Mr. Johnie McDow who updated the Council on the BVY A activities. ANNOUNCEMENTS Council General Announcements: AfayorPro-Tem Trayhan . None Council Afember Fowler . Announced he would be out ofthe State for next week's meeting. Items by Mayor . None INTRODUCTIONS Leonard Truitt, Development Services introduced and read short biographies on two new employees in the Inspections Department: Bernice Fox and Solange Bainbridge Rita Duprat- Waldo, Assistant to the City Manager introduced and read a short biography on a new employee in the 311 Customer Relations Department, Rodolfo Rosales. REGULAR AGENDA 1. Minutes - Consideration and/or action regarding the approval of the minutes of the regular meeting of January 29,2008. Mayor Baldwin recognized Council Member Carpenter who moved, seconded by Mayor Pro Tern Trayhan to approve the minutes of January 29, 2008. Vote was unanimous. Motion Carried 2. Resolution No. 08-R-08 - Park and Recreation Master Plan - Consideration and/or action approving a resolution for adopting a parks, recreation, and open space master plan. (G. Logan) Mayor Baldwin introduced George Logan, Director of Parks and Recreation who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Fowler who moved, seconded Mayor Pro Tern Trayhan to approve Resolution No. 08-R-08. Vote was unanimous. Afotion Carried 3. Buffalo Valley Youth Association (BVYA) Donation - Consideration and/or action accepting a donation from BVY A. (G. Logan) City Council Regular Meeting February 5, 2008 90 Mayor Baldwin introduced George Logan, Director of Parks and Recreation who introduced this item answering questions from Council. Mr. Johnie McDow of the BVY A came forward further explaining the purpose of the donation. Mayor Baldwin recognized Council Member Fowler who moved, seconded by Council Member Scagliola to approve accepting the donation from BVY A. Vote was unanimous. Motion Carried 4. Interlocal Agreement for Detention Services with City of San Antonio - Consideration and/or action approving an Interlocal Agreement for Detention Services. (S. Starr). Mayor Baldwin introduced Steve Starr, Police Chief who introduced this item answering questions from Council. Mayor Baldwin recognized Mayor Pro Tern Trayhan who moved, seconded by Council Member Fowler to approve an lnterlocal Agreement for Detention Services. Vote was unanimous. Afotion Carried PUBLIC HEARING/ORDINANCE 5. Ordinance No. 08-S-07 - Conduct a public hearing and consideration and/or action on approval of first reading of an ordinance adopting a revised zoning map for the City of Schertz for all parcels located within Bexar County. First Reading (M Mchols/T. Rhodes) Mayor Baldwin recognized Thomas Rhodes, Planning Manager who introduced this item answering questions from Council. Mayor Baldwin opened the public hearing and recognized the following citizens: . Mr. James Stewart, Ms. Betty Tate and others (spoke in favor) . Mr. David Tate spoke on behalf of the zoning on the south side. . Ms. Stalls requested her property be zoned back to the original zoning. . Mr. Robert Wall requested his property be zoned back to RA . Mr. Frank Bardovia spoke on annexation of property (did not apply to this item) There being no one else to speak; Mayor Baldwin closed the public hearing and recognized Mayor Pro Tern Trayhan who moved, seconded by Council Member Scagliola to approve Ordinance No. 08-S-07 with changes as discussed. First Reading. Vote was unanimous. Afotion Carried DISCUSSION ITEMS 6. Rate Adjustment for Bexar Waste Services - Discussion on rate adjustments for residential and commercial solid waste collection. (J. Bierschwale) City Council Regular Meeting February 5, 2008 91 Mayor Baldwin recognized John Bierschwale Assistant City Manager who introduced this item answering questions from Council. Mr. Bierschwale introduced Mr. Henry Gutierrez with Bexar Waste who came forward further explaining the need for an increase. City Council directed staff to bring an action item back to them at their meeting of February 19, 2008. Mr. Bierschwale will provide to Council a rate comparison chart of other cities. 7. General Announcements: Items by City Manager Taylor and Staff . Mayor Baldwin recognized Assistant City Manager John Bierschwale who announced an upcoming Public Works Spring Cleanup program. The City will be supplying door hangers, as well as providing information on the City's website. The plan is to split the city into zones and publish a schedule notifying citizens when Public Works would be in their area. EXECUTIVE SESSION Section 551.072 - Deliberations about Real Property Deliberation regarding the purchase, exchange, sale, lease, or value of real property. Mayor Baldwin adjourned the Regular Session into Executive Session at 8: 1 0 p.m. ,r.-",~ RECONVENE TO REGULAR SESSION Mayor Baldwin reconvened the Regular Session out of Executive Session at 8:55 p.m. 8. Take any action deemed necessary as a result of the Executive Session. No action taken.
