MINUTES
REGULAR SESSION
FEBRUARY 12, 2008
A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on
February 12, 2008, at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz
Parkway, Building #4, Schertz, Texas. The following members present, to-wit:

Council Member David Scagliola
Council Member Tony Wilenchik
Mayor Pro-Tern John Trayhan
Council Member Jim Fowler
Staff Present: City Manager Don Taylor
City Secretary Brenda Dennis
Assistant City Manager David Harris
Council Member Michael Carpenter was absent.
CALL TO ORDER
Mayor Pro-Tern Trayhan called the meeting to order at 6:30 p.m.
INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED
STATES AND STATE OF TEXAS.
Council Member Fowler gave the Invocation followed by the Pledges of Allegiance to the Flags
of the United States and State of Texas.
HEARING OF RESIDENTS
Mayor Pro-Tern Trayhan recognized the following:
. Ms. Melba Smith, 206 Aero who spoke on the 50th Anniversary Sock Hop.
Mayor Baldwin arrived at 6:45 p.m.
PRESENTATION
. Texas Professional Soccer Festival and activities (8. Bailey)
Brad Bailey, Community and Media Relations Director came forward providing
information to City Council on the Texas Professional Soccer Festival and activities. Mr.
Bailey introduced Mr. Jim Hope and Mr. James Cronkite who came forward giving a
brief PowerPoint presentation answering questions from Council. Council asked that
staff bring the item back for further discussion and action at next meeting.

Council General Announcements:
Mayor Pro-Tem Trayhan
. Announced he attended the Schertz Housing Authority Meeting, Monday, February
11,2008
Council Member Fowler
. None
Council Member Scagliola
· Announced he attended the TSAC meeting last Thursday, February 7,2008 and gave
a brief update of activities.
. Attended the 50th Anniversary Sock Hop stating the attendance was modest; but
everyone who attended had a great time.
Council Member Wilenchik
· Attended the Schertz Chamber of Commerce Board of Directors meeting and gave
update on planned activities.
· Attended the Ordinance Review Committee meeting Tuesday, February 12,2008 and
gave an update.
Items by Mayor
. Mentioned he received a phone call regarding the lack of handicap parking on FM 78
near Jodi Lopez Law Firm. He asked if staff would look into this and get back with
him.
REGULAR AGENDA
1. Minutes - Consideration and/or action regarding the approval of the minutes of the
regular meeting of February 5, 2008.
Mayor Baldwin recognized Council Member Fowler who moved, seconded by Council
Member Scagliola to approve the minutes of February 5, 2008 with corrections noted.
Vote was unanimous. Motion Carried
2. Rate Change for Civic Center and Community Center's - Consideration and/or action
approving a rate change. (G. Douglas)
Mayor Baldwin recognized Gail Douglas, Community Services Director and Jessica
Robinson Civic Center Manager who introduced this item answering questions from
Council. Mayor Baldwin recognized Mayor Pro Tern Trayhan who moved, seconded by
Council Member Scagliola to approve the rate change. Vote was unanimous. Motion

3. EMS Write-Off's - Consideration and/or action regarding approval of the EMS write-
offs as per City policy. (D. Wait)
Mayor Baldwin recognized Dudley Wait, EMS Director who introduced this item
answering questions from Council. Mayor Baldwin recognized Mayor Pro-Tern Trayhan
who moved, seconded by Council Member Fowler to approve the EMS write-offs as per
City policy. Vote was unanimous. Motion Carried
4. Ordinance No. 08-T-09 - Consideration and/or action amending Ordinance No. 05-T-22
relating to the tax abatement for MMIC Schertz MOB, LLC., First reading (G. Autuna)
Mayor Baldwin recognized Jeff Jewell, Economic Development Specialist who
introduced this item answering questions from Council. Mayor Baldwin recognized
Mayor Pro-Tern Trayhan who moved, seconded by Council Member Fowler to approve
Ordinance No. 08- T -09 granting the transfer of the tax abatement. First Reading Vote
was unanimous. Motion Carried
5. Development Agreement - Consideration and/or action approvmg a Development
Agreement with Lowe's Corporation. (G. Autuna)
Mayor Baldwin recognized Jeff Jewell, Economic Development Specialist who
introduced this item answering questions from Council. Mayor Baldwin recognized
Council Member Fowler who moved, seconded by Council Member Scagliola to approve
a Development Agreement with Lowe's Corporation for the reimbursement. Vote was
unanimous. Motion Carried
6. Ordinance 08-M-08 - Consideration and/or action approving an ordinance concerning
regulation of graffiti in the City of Schertz. First reading (L. Truitt)
Mayor Baldwin introduced Leonard Truitt, Development Services Director who
introduced this item answering questions from Council. Mayor Baldwin recognized
Council Member Scagliola who moved, seconded by Mayor Pro-Tern Trayhan to approve
Ordinance 08-M-08. First Reading Vote was unanimous. Motion Carried
DISCUSSION ITEMS
7. Ordinance No. 08-S-07 - Discussion on approval of final reading of an ordinance
adopting a revised zoning map for the City of Schertz for all parcels located within Bexar
County. (M. Nichols/T. Rhodes)
Mayor Baldwin introduced Thomas Rhodes, Interim Planning Manager, who introduced
this item answering questions from Council. No action taken.
8. General Announcements: Items by City Manager Taylor and Staff
. David Harris Assistant City Manager stated that he received a letter from the U.S.
Postal Service denying the request for zip code changes. He stated that staff would
appeal the decision and get back to Council.

· Sam Willoughby Public Works Director showed two (2) examples oflettering for the
water tanks asking Council for direction. City Council requested that staff bring an
action item back at the next meeting with pricing information to add the City logo.
EXECUTIVE SESSION
Section 551.072 - Deliberations about Real Property
Deliberation regarding the purchase, exchange, sale, lease, or value of real property.
Mayor Baldwin adjourned the Regular Session into Executive Session at 7:40 p.m.
RECONVENE TO REGULAR SESSION
Mayor Baldwin reconvened the Regular Session out of Executive Session at 8:50 p.m.
9. Take any action deemed necessary as a result of the Executive Session.
Mayor Baldwin recognized Council Member Scagliola who moved seconded by Mayor
Pro-Tern Trayhan to purchase five (5) lots in the Live Oak Hills Subdivision from the
following property owners: Ernest Persyn, Abiel V. Grijalva, Margaret Lynch and Hazel
Lee Bernard as discussed in Executive Session. Vote was unanimous. Motion Carried
