02-19-2008 MINUTES REGULAR SESSION FEBRUARY 19, 2008 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on February 19, 2008, at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present, to-wit: Mayor Hal Baldwin Council Member David Scagliola Council Member Tony Wilenchik Mayor Pro-Tern John Trayhan Council Member Jim Fowler Council Member Michael Carpenter Staff Present: City Manager Don Taylor City Secretary Brenda Dennis Assistance City Manager John Bierschwale CALL TO ORDER Mayor Baldwin called the meeting to order at 6:30 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Council Member Carpenter gave the Invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. HEARING OF RESIDENTS Mayor Baldwin recognized the following: . Principal Knox and Ms. Randenski 5th Grade Teacher and students at Wilder Intermediate School, who gave a brief presentation regarding Project Lemonade. . Frances Rushing, Schertz Chamber Commerce President who announced upcoming Chamber events. . Ronald Scholl, 1300 Engel Rd, who spoke regarding the proposed Rolling Hills Ranch zonmg. . Robert Brockman, 1000 Elbel #411 who spoke on State notification issues, a sign issue in Ashley Oaks, and different light outages. INTRODUCTIONS . Introductions of new employees: (Police, Fire) Fire Chief David Covington introduced and read short biographies on new employees Brian Krask, Jason Ellis and gave them the Oath of Office. Attended the Commissioners Court meeting Tuesday, February 19, 2008. . Announced that Pct. 1 County Commissioner Roger Baenziger's wife Marian died Monday and passed on his prayers and condolences to the family. . Received a letter from TML asking that he serve on the 2009 Legislative Session Committee for Municipal Revenue. Council Member Carpenter . Request that Public Works check out the traffic control devices on Savannah Drive that are out. Items by Mayor . ASA Commuter Rail District Board policies meeting Wednesday, February 20, 2008. REGULAR AGENDA 1. Minutes - Consideration and/or action regarding the approval of the minutes of the regular meeting of February 12,2008. Mayor Baldwin recognized Mayor Pro-Tern Trayhan who moved, seconded by Council Member Fowler to approve the minutes of February 12,2008 with a change noted on the last page. Vote was unanimous. Motion Carried 2. Tank Lettering Design - Consideration and/or action regarding approval for the lettering for the new water tanks as well as information on price to add city logo. (S. Willoughby) Mayor Baldwin recognized Sam Willoughby, Public Works Director who introduced this item answering questions from Council. It was the consensus of the Council opt for the lettering that is on the tank on 135 to be consistent. Mayor Baldwin recognized Council City Council Regular Meeting February 19, 2.008 98 ~ Member Carpenter who moved, seconded by Council Member Fowler to use the same lettering that is on the tank at 135. Vote was unanimous. Motion Carried 3. Ordinance No. 08-S-07 - Consideration and/or action on approval offmal reading of an ordinance adopting a revised zoning map for the City of Schertz for all parcels located within Bexar County. Final Approval (T. Rhodes) Mayor Baldwin recognized Thomas Rhodes, Interim City Planner who introduced this item answering questions from Council. Mayor Baldwin recognized Mayor Pro-Tern Trayhan who moved, seconded by Council Member Carpenter to approve Ordinance No. 08-S-07 fmal reading. Vote was unanimous. Motion Carried 4. Ordinance No. 08-F-OI0 - Consideration and/or action approving an ordinance revising the rates for Bexar Waste. First Reading (1. Bierschwale) Mayor Baldwin recognized John Bierschwale, Assistant City Manager who introduced this item answering questions from CounciL Mayor Baldwin recognized Council Member Fowler who moved, seconded by Mayor Pro-Tern Trayhan to approve Ordinance No. 08-F-OI0 first reading and add a penalty clause as requested by staff. First Reading Vote was unanimous. Motion Carried 5. Resolution No. 08-R-09 - Consideration and/or action approving a resolution amending the Park Land Dedication rates. (G. Logan) Mayor Baldwin recognized George Logan, Parks and Recreation Director who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Carpenter who moved, seconded by Council Member Scagliola to approve resolution No. 08-R-09 amending the Park Land Dedication rates with corrections noted. Vote was unanimous. Motion Carried 6. Contract with Polaris Library Systems - Consideration and/or action approving a contract with Polaris Library Systems for Library Circulation Software. (M. Uhlhorn) Mayor Baldwin introduced Melissa Uhlhorn, Library Manager who introduced this item answering questions from Council. Mayor Baldwin recognized Mayor Pro-Tern Trayhan who moved, seconded by Council Member Carpenter to approve a contract with Polaris Library Systems. Vote was unanimous. Motion Carried PUBLIC HEARINGS AND ORDINANCE APPROVAL 7. Sign Standards Ordinance No. 08-S-011 - Conduct a public hearing and consideration and/or action on approval of first reading of an ordinance amending Ordinance No. 96-S- 28 being the Unified Development Code (UDC) ofthe City by amending Article IX, Sign Standards. First Reading (T. Rhodes) City Council Regular Meeting February 19, 2008 99 Mayor Baldwin introduced Thomas Rhodes, Interim City Planner who introduced this item answering questions from Council. Mayor Baldwin opened the public hearing and recognized the following who spoke: . Frances Rushing, Schertz Chamber of Commerce President . David Richmond, Planning and Zoning Chairman . Robert Brockman, 1000 Elbel . George Antuna, Economic Development Director As no one else spoke, Mayor Baldwin closed the public hearing asking for comments from Council. Council Members deliberated for quite some time on the issues of electronic signs and temporary signs. Mayor Baldwin recognized Council Member Carpenter who moved, seconded by Mayor Pro- Tern Trayhan to approve Ordinance No. 08-S-011 first reading with the following changes: Electronic Signs shall be as follows: Electronic signs be permitted. Electronic signs shall be monument only and shall have the same standards (area, height, etc.) as other monument signs Electronic signs shall be the only on-premise freestanding sign permitted. Temporary signs should be amended to permit no more than two (2) temporary signs for any single business at a time. Mayor and Council asked that staff republish the notice of public hearing for the ordinance allowing business owners to have another opportunity to view the proposed ordinance, make comments, and bring back to City Council for final approval at the March 11, 2008 meeting. Vote was unanimous. Motion Carried BOARDS/COMMISSIONS 8. Appointment/Reappointment to Boards and Commissions/Committees Consideration and/or action regarding appointments/reappointments to Boards and Commission/Committees. . Transportation Safety Advisory Commission (TSAC) . 50th Anniversary Committee Mayor Baldwin recognized Council Member Scagliola who moved seconded by Mayor Pro- Tern Trayhan to appoint Mary Spence, and William Bowers to the Transportation Safety Advisory Commission. The vote was unanimous. Motion Carried City Council Regular Meeting February 19, 2008 100 ----.--J Mayor Baldwin recognized Mayor Pro-Tern Trayhan who moved seconded by Council Member Carpenter to appoint Maria Scagliola and Meghan Scagliola to the 50th Anniversary Committee. The vote was unanimous. Motion Carried PRESENTATION . Presentation regarding Storm Water Management Plan from Givler Engineering. (D. Givler) Mayor Baldwin recognized Mr. David Givler, Givler Engineering who gave a brief PowerPoint presentation on the Storm Water Management Plan answering questions from Council. DISCUSSION ITEMS 9. Ordinance No. 08-T-09 - Discussion and possible consideration and/or action on fmal reading of Ordinance No. 08-T-09 on amending Ordinance No. 05-T-22 relating to the tax abatement for MMIC Schertz MOB, LLC. (1. Jewell) Discussion and Final Reading Mayor Baldwin recognized Jeff Jewell, Economic Development Specialist who introduced this item answering questions from CounciL Discussion only no action. 10. Ordinance 08-M-08 - Discussion and possible consideration and/or action on fmal reading of Ordinance No. 08-M-08 on approving an ordinance concerning regulation of graffiti in the City of Schertz. (L. Truitt) Discussion and Final Reading Mayor Baldwin introduced Leonard Truitt, Development Services Director who introduced this item answering questions from Council. Discussion only no action. 11. General Announcements: Items by City Manager Taylor and Staff . City Manager Don Taylor stated that he would be out of the office starting Wednesday through Friday and that David Harris would be available. EXECUTIVE SESSION Section 551.072 - Deliberations about Real Property Deliberation regarding the purchase, exchange, sale, lease, or value of real property. Council did not meet in Executive Session.
