06-27-2007 PLANNING AND ZONING MINUTES June 27, 2007 The Schertz Planning and Zoning Commission convened on June 27, 2007 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. CALL TO ORDER/ROLL CALL Mr. Richmond called the meeting to order at 6:31 P.M. 2. CITIZEN COMMENTS Robert Brockman, 1000 Elbel, expressed concern with the code compliance report. 3. CONSENT AGENDA: A. Consider and act upon the June 13, 2007 minutes for the Planning and Zoning Commission meeting. Following reading of the agenda item, Mr. Greenwald moved to approve Consent Agenda item 3A. Ms. Tutschke seconded the motion. Vote was unanimous. Motion carried. 4. PUBLIC HEARINGS: A. PC2006-116 Hold a public hearing consider, and act upon a request to replat the remainder of Lots 2 & 4, Block 2, Tri-County Business & Industrial Park establishing Lot 19, Block 2 of the Lone Star Pet Supply II Subdivision being a 1.169:1: acre tract of land generally located 300- feet east of the intersection of Triton Drive and Corridor Parkway. The property is zoned General Business District (GB). Owner/Applicant: Dennis Stahl, 414 Partnership, Ltd. Representative: Brian Crowell, Halff Associates Public hearing was opened at 6:36 pm. Mr. Greenwald moved to approve the item. Mr. Wallace seconded the motion. Vote unanimous. Motion carried. B. ZC2007-005 Hold a public hearing, consider and act upon a request to zone 4.105:1: acres out of the Malpaz League Survey and Division No.2 of Survey No. 67 in Section No.3 and Part of the Ottomar L. Dietz, Et Al 250 Acre Tract, Guadalupe County, Texas from Single-Family Residential-l District (R-l) to General Business District (GB). The property is generally located at the northwest corner ofFM 3009 and Patrick Henry. Owners: William Dietz, Robert Dietz, and Dennis Dietz Applicant/Representative: David Montelongo, Montelongo Developments, LLC Public hearing opened at 6:41 pm. Ms. Gabbard reviewed staff comments. Mr. Montelongo discussed the possible uses for the prope11y, tree integrity used to create a buffer against the residential area, and traffic concerns on FM3009. Also, he is working with TxDot for access. Mr. Montelongo is willing to work with the community. Charles and Gail Killen, Eli Whitney, expressed concern with general business issues. Charles and Peggy Frey, 100 Lincoln Dr., were concerned with safety issues, and they questioned the easement on the property. Ollie Burkett, 120 Lincoln Dr., questioned the purpose of the meeting if questions from the residents could not be addressed. Mr. Richmond stated that this request was for rezoning of prope11y only, and that questions should address zoning issues. Lou Pollianny stated that FM3009 is already congested enough, and he would like to keep values of homes up. Clarence Berry, corner of Will Rogers and Robe11 Derik, was unhappy with not being notified, and he questioned how Planning and Zoning can consider rezoning with out some type of concept plan. Terry Alem, 1504 Greenwood, had concerns with traffic congestion. Sharon Jost, 1200 Cedarwood, stated her family was opposed to the development due to traffic concerns. She stated that was why the walls were erected, and she would prefer the land to stay residential. Dare Worbese, 117 Robert Stevens, requested to keep residential zoning. Joyce Brisco, 113 Will Rogers, questioned whether P&Z listens to people outside 200 ft., and asked why the applicant requested General Business instead of Neighborhood Services. Donna Bain, 1501 Cherrywood, stated the traffic is a nightmare, and she would like to see the area stay residential. Mark and Laura Reinhardt, 132 Lincoln, had concerns with traffic issues on FM3009 and alternate routes from Greenfield Village to Live Oak Rd. Ms. Reinhardt stated she had concerns that there are too many strip centers and spaces are not being leased. Gary Hunsinger, 144 Lincoln, from outside the 200 ft. radius, said he is concerned with FM3009 becoming another Pat Booker Road and requested that property not be rezoned. Pete Flatten, Thomas Edison, was opposed to the rezoning; he is already affected by the noise. Bill Turner, 3rd house on left on Patrick Henry, stated he moved to Greenfield Village because he liked the area. He is opposed to the rezoning, and is concerned with the traffic on FM 3009. Gloria Marsh, Thomas Edison Drive, stated she was concerned with traffic; she does not want another Pat Booker and Nacogdoches Road. She stated there is too much commercial development already and we do not need anymore. Linda Dietz, 1204 Cyress McCormic, stated her concerns on noise, lights and traffic. She is opposed to Minutes Planning and Zoning Commission June 27, 2007 Page 2 of 4 the rezoning and would like it to stay residential. Public hearing closed at 7:29 pm. David Richmond commented about public hearings and how they help the community. Mr. Montelongo stated he appreciated the tight residential community and their concerns. Mr. Montelongo is willing to work with the community to make this a success, and is open to a private meeting to discuss the issues. Mr. Montelongo stated that the rezoning will not devalue the property, but instead increase the value of both the proposed commercial tract as well as the adjacent residential. Mr. Montelongo stated that a wall would be erected to buffer the noise, and if this property stays as residential it would be hard for homes to be built on the property. Mr. Richmond questioned Mr. Montelongo about zoning. Mr. Richmond stated that the property has been zoned residential for many years, and the owner has tried to sell the prope11y as residential without success. Mr. Richmond stated that it was difficult to deny the owners their right to sell; however, the traffic concerns raised by the citizens are significant and he recognizes the issue. Any developer on FM3009 will require a TIA and decellanes to help traffic. This is not unlike the development of The Oaks at Green Valley. Michael Carpenter spoke on the public hearing notice, Planning and Zoning as well as City Council public hearings, and advised citizens of procedure. Mr. Sommers recommended neighborhood services as the appropriate rezoning category. Mr. Evans stated he needed neighborhood services instead of general business.. Mr. Richmond requested some clarification from staff. Mr. Sommers stated he was not in favor of the proposed rezoning. Mr. Montelongo requested to withdraw the item from the agenda. Mr. Richmond stated that the commission will not make a recommendation to the City Council. Mr. Montelongo has contact information and will get with the residents to hear their concerns. 5. ITEMS FOR INDIVIDUAL CONSIDERATION: There were no items for individual consideration. 6. ITEMS FOR DISCUSSION A. City Council Mr. Carpenter stated he would like to thank the commission for their service. B. Director's Report No comments. C. Planning Commissioner Comments Ms. Tutschke: No comments. Mr. Wallace: No comments Mr. Haddock: No comments. Mr. Richmond: Stated he requested staff to provide COmmlSSlOners with a copy of an AARP article that shows development in Southlake outside Dallas that has retail, apartments and condos and is highly successful. This might be an idea for a new town center at the four corners of Live Oak Road. 7.
