08-08-2007 PLANNING AND ZONING MINUTES August 8, 2007 The Schertz Planning and Zoning Commission convened on August 08, 2007 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. CITIZEN COMMENTS No citizen comments. 3. CONSENT AGENDA: A. PC2007-050 Consider and act upon a request for approval of a final plat of Old Wiederstein Road. This 16.667:1: acre tract establishes the right-of-way for Old Wiederstein Road from IH-35 south approximately 2,700 feet, then east to FM 1103. The staff withdrew the consent agenda item. 4. PUBLIC HEARINGS: A. ZC2007-011 Hold a public hearing and consider and act upon a request to zone 5.403:1: acres from Garden Home Dwelling District (R-5) to General Business (GB). The tract is situated out of the T. Herrera Survey, No. 68, Abstract 153, Guadalupe County, Schertz, Texas. The property is generally located at the northwest comer of Schertz Parkway and Live Oak Road. PC2007-065 Consider and act upon a request for approval of a master plan for Meadow Creek Subdivision. This 28.35:1: acre tract contains 85 single-family residential lots within 7 blocks and is located approximately one-half mile east of the intersection of FM-1518 on Maske Road. The property is zoned Single-Family Dwelling District-2 (R-2). Mr. Rhodes reviewed staff comments. After a short discussion, Mr. Sommers moved to table the item. Mr. Wallace seconded the motion. Voting Nay: Ms. Tutschke, Mr. Sommers, Mr. Greenwald, Mr. Evans, Mr. Wallace, Mr. Haddock Jeff Henry, Concept Homes, made a short presentation. After discussion on the AICUZ, lot size, drainage and FEMA changes, Mr. Wallace moved to approve the item predicated on the new FEMA flood plain data. Mr. Greenwald seconded the motion. Vote unanimous. Motion carried. B. PC2007-067 Consider and act upon a request for preliminary plat for Lot 1, Block 1 of the SCUCISD FM -1518 Middle School Subdivision. This 36.544:1: acre tract is located on FM-1518 north of Lower Seguin Road. This property is currently zoned Pre-Development District (PD). Mr. Rhodes reviewed staff comments. Alan Lindskog, CEC Engineering, made a brief presentation. After a short discussion, Mr. Wallace moved to approve the item. Mr. Haddock seconded the motion. Vote unanimous. Motion carried. C. PC2007-064 Consider and act upon a request for approval of a preliminary plat for Lot 21 and 22, Block 1 of the Presto Nova Schertz Subdivision. This 3.344:1: acre tract is located at the Intersection ofFM-78 and FM-3009. The property is zoned General Business District (GB). Mr. Rhodes reviewed staff comments. Mr. Evans asked if the applicant was present. Mr. Rhodes replied no, I do not believe they are. Mr. Evans asked if right turn lanes off FM 78 has been discussed with the applicant so that no one is rear- ended. Mr. Rhodes stated that the City's Engineer has reviewed it and has not made comments requiring an acceleration or deceleration lane. Mr. Sommers stated there is a traffic light at the intersection, and asked how many curb cuts will there be? Mr. Rhodes answered two, one for each lot. Mr. Sommers asked if that is what TxDot is allowing just two, one for each lot? Mr. Rhodes corrected his previous statement by stating that on TxDot's note number three they are only being allowed one access. There is one access for lot 22 and zero access for lot 21 with cross access between the lots. Mr. Sommers questions reciprocal easements. Mr. Rhodes stated that they are showing a 55' ingress/egress easement going across the frontage of lots 21 and 22. That matches up the reciprocal ingress/egress easement with the frontage of lot 20, the Schertz Animal Clinic subdivision on the adjacent property. Lot 20 is not apart of this plat, but will have interconnectivity between all three of those lots. Minutes Planning and Zoning Commission August 8, 2007 Page 2 of 4 Mr. Evans asked staff what the 20' right of way was dedicated to TxDot for? Mr. Rhodes stated there is an existing 120' right of way on lot 20 in front of their 120' right of way; they are having to dedicate one half of their adjacent right of way to make up that 120'. He believes the plan for TxDot is based on a total right of way of 120', and they need to give up that 20' on their side to match that existing right of way dedication. Mr. Evans stated that he is not an Engineer and he does not want to contradict our City Engineer, but apparently we do not know what kind of businesses are going on these lots. rfthey are businesses that draw traffic during morning or evening rush hour with out a right turn lane, we will be setting up someone to be killed without a decellane or right turn lane to get these people offFM78. Traffic only is paying attention to the red or green light, and without a decal lane, there will be a lot of rear-enders. So again my thought is city staff or the City Engineer should take another look at that due to safety at the busy intersection. Mr. Wallace asked if the stoplight is state owned. Mr. Rhodes answered yes. Mr. Wallace asked if the access point could be right across from FM3009 so the stoplight could be made into a four way stop instead of a three way? Mr. Rhodes stated that the plat states the access point will be directly across from FM3009. Mr. Evans stated that if it changes to a four way light it would save somebody. After discussion, Mr. Haddock moved to approve the item. Mr. Wallace seconded the motion. Voting Aye: Ms. Tutschke, Mr. Wallace, Mr. Haddock. Voting Nay: Mr. Sommers, Mr. Greenwald, Mr. Evans. Tie vote. After a brief discussion, it was the unanimous decision of the commission the item be placed at the end of the agenda for August 22,2007. D. PC2007-062 Consider and act upon a request for approval of a site plan for Lot 50, Block 4 Forest Ridge Commercial. This 4.723:f: acre tract is located on the Northwest comer ofFM-3009 and Wiederstein Road. The property is zoned Neighborhood Services District (NS). Ms. Gabbard reviewed staff comments. After a short discussion on lighting, adequate parking and tree mitigation, Mr. Greenwald moved to approve the item. Mr. Wallace seconded the motion. Vote unanimous. Motion carried. E. PC2007-063 Consider and act upon a request for approval of a site plan for Lot 1, Block 1 Hubertus Retail / Walgreens. This 7.847:t acre tract is located on the southwest comer ofIH 35 and FM 1103. The property is zoned General Business District (GB). Ms. Gabbard reviewed staff comments. After a short discussion on lot size and signage, Mr. Sommers moved to approve the item. Mr. Greenwald seconded the motion. Vote unanimous. Motion carried. 6. ITEMS FOR DISCUSSION A. City Council Mr. Carpenter advised the commission of property annexation by the City of Schertz, and he discussed the joint session that took place last week. Director's Report Mr. Rhodes advised the commission that the new proposed zoning map update would be on the agenda August 22, 2007. Zoning notices will be published in the paper and mailed. Maps will be posted at various locations. C. Planning Commissioner Comments Ms. Tutschke: No comments. Mr. Sommers: No comments. Mr. Greenwald: Apologized for missing the last meeting. Mr. Evans: Requested an update on Kramer Farms drainage, and advised the commission and staff that he would be on vacation August 22, 2007, and would not be in attendance at the j oint meeting. Mr. Wallace: No comments. Mr. Haddock: No comments. 7.
