08-22-2007 PLANNING AND ZONING MINUTES August 22, 2007 The Schertz Planning and Zoning Commission convened on August 22, 2007 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. CALL TO ORDER/ROLL CALL Mr. Richmond called the meeting to order at 6:32 P.M. 2. CITIZEN COMMENTS Robert Brockman commented on the presentation given by Thomas Rhodes at the joint session and the city's annexation and zoning of new properties. 3. CONSENT AGENDA: A. Consider and act upon the July 11, 2007 minutes for the Planning and Zoning Commission meeting. Following reading of the agenda item, Mr. Wallace moved to approve Consent Agenda item 3A. Mr. Haddock seconded the motion. Vote was unanimous. Motion carried. 5. ITEMS FOR INDIVIDUAL CONSIDERATION A. PC2007-064 Consider and act upon a request for approval of a preliminary plat for Lot 21 and 22, Block 1 of the Presto Nova Schertz Subdivision. This 3.344:1: acre tract is located at the Intersection of FM-78 and FM-3009. The property is zoned General Business District (GB) Mr. Richmond stated this item would be moved forward to consider before the public hearings. Mr. Rhodes reviewed staff comments. With no discussion, Mr. Wallace moved to approve the item. Ms. Tutschke seconded the motion. Vote unanimous. Motion carried. 4. PUBLIC HEARINGS: Minutes Planning and Zoning Commission August 22, 2007 Page 1 of3 A. ZC2007-067 Hold a public hearing and consider making a recommendation to the City Council to establish the initial zoning of Public Use District (PUB) on a 35.874 acre tract of land out of the Mile S. Bennett Survey No. 75, Abstract 61, County Block 5057, Bexar County, Texas generally located at the terminus of Hillbrook Drive, adjacent to FM 1518 approximately 2,200 feet south of the intersection of FM 1518 and Schaefer Road Public hearing opened at 6:41 pm. Ms. Nichols reviewed staff comments. Twenty notices were mailed and one was returned in opposition. Joel Newland, 10427 Hillbrook Rd., expressed concerns with security on and around the school property. Wade Hawkins, SCUCISD, stated that the school would be a replacement school for the Corbett Junior High School and the campus will be fully fenced with a public road leading to the school. Public hearing closed at 6:46 pm. After a short discussion, Mr. Greenwald moved to approve the item. Mr. Haddock seconded the motion. Vote unanimous. Motion carried. B. ZC2007-008 Hold a public hearing and consider making a recommendation to the City Council regarding an update and possible revision of the zoning map for the City of Schertz for all parcels within Guadalupe and Comal Counties. Public hearing opened at 6:50 pm. Mr. Rhodes presented the Proposed Zoning map to the Commission and audience. He explained the changes from the existing map to the proposed map. There were 11,123 notices sent to owners of property in the city. Staff received fifty-eight (58) replies in favor, seventy-eight (78) opposed, eight (8) undecided, and 456 undeliverable. There were several citizens concerned with the rezoning of their property from Agriculture to Manufacturing, and the options that this zoning would leave on the value of their property. Others were concerned with their property being rezoned commercial or Neighborhood services. Some citizens were concerned with the impact rezoning would have on their property, and living next to commercial businesses. After some discussion between citizens, staff, and commissioners, the Public Hearing closed at 7:27 pm. Following review and discussion, Mr. Sommers moved to forward a recommendation of approval to City Council for the proposals exhibited. Recommendation was made to accept staff recommendations on exhibits 1,2,3,6,8,9,10,11,12,13,15,16,18,19,20,21, and the seven lots on Ira Drive, make no changes to the Blanchard property (exhibits 4 and 5) per property owner's request, accept staff revised recommendation on exhibit 7, make no changes to exhibits 14 and 17 per property owner's request. Mr. Greenwald seconded the motion. Vote unanimous. Motion carried. 6. ITEMS FOR DISCUSSION A. City Council Mr. Carpenter stated that there have been some questions on having a council liaison for the Planning and Zoning Commission. The City Manager and City Attorney will be looking into the liaison question with TML. He stated that the City received a letter from the School district about exemption from impact fees. B. Director's Report Mr. Truitt had no comments. Mr. Rhodes stated that a resolution is being worked on to have the ETJ area released from the City of San Antonio. He thanked the Commissioners who came to the UDC diagnostic report review meeting and Minutes Planning and Zoning Commission August 22, 2007 Page 2 of3 welcomed any other recommendations they might have. Mr. Rhodes concluded with advising the commission that the Montelongo property was postponed by request of the applicant at the Council meeting last night and will be back on the agenda August 30, 2007 for discussion and setting a date for the public hearing. C. Planning Commissioner Comments Ms. Tutschke: No comments. Mr. Sommers: Stated that he appreciates the liaison from the council and welcomes any thoughts. Mr. Greenwald: No comments. Mr. Wallace: No comments. Mr. Haddock: No comments. Mr. Richmond: No comments. 7.
