01-09-2008PLANNING AND ZONING MINUTES January 9, 2008 The Schertz Planning and Zoning Commission convened on January 9, 2008 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. APPOINTMENT OF OFFICERS After reading of the agenda item, Mr. Wallace moved to reappoint Mr. Richmond as Chairman and Mr. Evans as Vice Chairman, Mr. Sommers seconded the motion. Vote unanimous. Motion carried. CITIZEN COMMENTS Mr. Truitt, Director of Development Services, made a short presentation on the approval of the contract with Mitchell Planning Group by the City Council and introduced Thomas Rhodes as Planning Manager. Mr. Brockman, 1000 Elbel, presented the commission with information that he heard at a council meeting on the Crestmark Homes project on FM 1518. CONSENT AGENDA: A. Consider and act upon the Planning and Zoning Commission meeting minutes for December 12, 2007. Minutes Planning and Zoning Commission January 9, 2008 Page 1 of 5 B. PC2007 -114 Schertz Library -Final Plat Consider and act upon a request for approval of the final plat of Lot 1, Block 1 Schertz Public Library Subdivision consisting of 14.749± acres of land located at the northeast corner of Schertz Parkway and Elbel Road. The property is zoned Public Use District (PUB). C. PC2008 -002 Schertz Forest Unit 3- Revised Final Plat Consider and act upon a request for approval of a revised final plat of Schertz Forest Unit 3. The 102.7± acre tract contains 45 single - family residential lots, generally located at the southwest corner of FM -1518 and Ware- Seguin Road. The property is zoned Residential/Agricultural (R -A). Following reading of the agenda items, Mr. Wallace moved to approve Consent Agenda items 4A, 4B, 4C. Ms. Tutschke seconded the motion. Vote was unanimous with Mr. Greenwald abstaining from agenda item 4A. Motion carried. 5. PUBLIC HEARINGS: A. SUP2007 -010 Keystone Concrete - Specific Use Permit Hold a public hearing, consider and act upon a request for a Specific Use Permit (SUP) for Lots 35 and 36, Block 1 of the Nell Deane Subdivision. The proposed commercial lot is within the Air Installation Compatible Use Zone (AICUZ). The 3.0± acre tract is zoned General Business -2 (GB -2). The tract is situated out of the Genobera Malpaz Survey No. 67 Abstract No. 221, Guadalupe County, Schertz, Texas. The property is located approximately 412 feet east of the intersection of FM 1518 on Nell Deane Street. Public hearing opened at 6:43 pm. Ms. Nichols reviewed staff comments and advised the commission that the applicant was present. Mr. Brockman questioned the reason for the SUP. Mr. Evans stated to Mr. Brockman that the SUP was a requirement because the property lies in the AICUZ. Public hearing closed at 6:47 pm. After a short discussion between commissioners and staff on floodplain and lot information, Mr. Wallace moved to approve the item. Mr. Sommers seconded the motion. Vote unanimous. Motion carried. B. SUP2007 -009 Pape Subdivision - Welding Shop - Specific Use Permit Hold a public hearing, consider and act upon a request for a Specific Use Permit (SUP) for Lots 2 and 3, Block 2 of the Windy Meadows Subdivision (proposed Pape Subdivision). The proposed commercial lot is within the Air Installation Compatible Use Zone (AICUZ). The 2.0± acre tract is zoned General Business -2 (GB -2). The tract is situated out of the Genobera Malpaz Survey No. 67 Abstract No. 221, Guadalupe County, Schertz, Texas. The property is located approximately 85 feet east of the intersection of FM 1518 on Windy Meadows Drive. (applicant requested to withdraw this item and reschedule) This item was withdrawn by the applicant and requested to reschedule at a later date. C. PC2007 -112 Pape Subdivision - Replat Hold a public hearing, consider and act upon a request for approval of a replat of Lot 2 and Lot 3, Block 2 of the Windy Meadow Subdivision establishing Lot 40, Block 2, Pape Subdivision consisting of a 2.0± acre tract of land located approximately 85 feet East of the intersection of FM 1518 and Windy Meadows. The property is zoned General Business District 2 (GB -2). Public hearing opened at 7:03 pm. Ms. Gabbard reviewed staff comments and advised the commission that the applicant was not present. Mr. Edwards seconded the motion. Voting Aye: Ms. Tutschke, Mr. Evans, Mr. Wallace, Mr. Edwards, and Mr. Richmond. Voting Nay: Mr. Sommers and Mr. Greenwald. Motion carried. 6. ITEMS FOR INDIVIDUAL CONSIDERATION A. PC2007 -115 Keystone Concrete -Site Plan Consider and act upon a request for site plan approval for Lots 35 and 36, Block 1 of the Nell Deane Subdivision. The proposed commercial lot is within the Air Installation Compatible Use Zone (AICUZ). The 3.0± acre tract is zoned General Business -2 (GB -2). The tract is situated out of the Genobera Malpaz Survey No. 67 Abstract No. 221, Guadalupe County, Schertz, Texas. This property is zoned Manufacturing District - Light (M -1) Ms. Gabbard reviewed staff comments and advised the commission the applicant was present. After a short discussion about plat notes, Mr. Wallace moved to approve the item. Ms. Tutschke seconded the motion. Voting Aye: Ms. Tutschke, Mr. Greenwald, Mr. Wallace, Mr. Edwards and Mr. Richmond. Voting Nay: Mr. Sommers and Mr. Evans. Motion carried. 7. ITEMS FOR DISCUSSION A. ZC2008 -001 Article IX, Sign Standards Discussion regarding revisions to Article IX of the UDC, Sign Standards. (T Rhodes) Mr. Rhodes gave a short presentation highlighting the sections of the UDC Article IX that have changes. B. Electronic Signs Discuss and make recommendation to City Council regarding Electronic Signs. (D. Richmond) After discussion between commissioners, Mr. Richmond moved to recommend to City Council a moratorium on the permitting of electronic signs. (Subject to approval by City Attorney). Mr. Sommers seconded the Minutes Planning and Zoning Commission January 9, 2008 Page 3 of 5 motion. Voting Aye: Ms. Tutschke, Mr. Sommers, Mr. Greenwald, Mr. Evans, Mr. Wallace, and Mr. Richmond. Voting Nay: Mr. Edwards. Motion carried. C. Unified Development Code Discuss and make a recommendation to the City Council to establish a joint meeting to receive a presentation from Mitchell Planning Group regarding the new Unified Development Code. (T. Rhodes) Mr. Rhodes stated that Mitchell Planning Group has completed the UDC document, and it is at the Attorney hired by the city for review. The projected meeting date should be at the beginning of February. 8. ITEMS BY COUNCIL, COMMISSION AND STAFF A. City Council Comments Mr. Carpenter congratulated Mr. Richmond and Mr. Evans on their reappointments. He stated that he likes the contract between the City and Mitchell Planning Group that was presented to Council. He made a few comments on the agenda and the meeting. B. Planning Manager Comments Mr. Rhodes advised the commission that an extra joint session between the City Council and the Planning and Zoning Commission would be required to discuss the UDC after his presentation. C. Planning Commissioner Comments Ms. Tutschke: No comments. Mr. Sommers: Thanked Michael Carpenter for his comments. Mr. Greenwald No comments. Mr. Evans: No comments. Mr. Wallace: Stated he opposed the unwritten rule of requiring applicants to be present for discussion. Mr. Edwards: No comments. Mr. Richmond: Stated that the Commission has an obligation the ask questions and make comments on applications. Applicants should show support for the importance of their requests to Planning and Zoning. 8.
