2000R01- NONVIOLENT CIVIL RIGHTS DEMONSTRATIONS I RESOLUTION NO. CJO-J!. - / A RESOLUTION ESTABLISHING POLICIES REGARDING THE USE OF EXCESSIVE FORCE DURING NONVIOLENT CIVIL RIGHTS DEMONSTRATIONS, INCLUDING THE PHYSICAL BARRING OF ENTRANCES OR EXITS OF FACILITIES OR LOCATIONS WHICH ARE THE SUBJECTS OF SUCH DEMONSTRATIONS BE IT RESOLVED by the City Council of the City of Schertz, Texas, as follows: 1. It is hereby established as the policy of the City of Schertz that: (a) no law enforcement officer employed by the City of Schertz shall at any time use more force than is reasonably necessary to effect a lawful arrest, including the lawful arrest of persons engaged in a nonviolent civil rights demonstration within the City of Schertz, Texas; (b) the City of Schertz and its law enforcement personnel shall not unlawfully physically bar any entrance or exit of a facility or location which is the subject of a nonviolent civil rights demonstration; and (c) the law enforcement and other personnel of the City of Schertz who willfully violate any of the above policies shall be subject to disciplinary action, including but not limited to termination, as determined to be appropriate by the Police Chief (as to law enforcement personnel) and the City Manager (as to all other personnel of the City). 2. This Resolution shall take effect immediately. Adopted by the City Council of the City of Schertz on this l%tiday of ~ 2000.
