RESOLUTION NO. 07 -R-47
RESOLUTION APPOINTING EIGHT MEMBERS TO THE BOARD OF
DIRECTORS OF REINVESTMENT ZONE NUMBER TWO, CITY OF
SCHERTZ, TEXAS
WHEREAS, by Ordinance No. 06-T-61 dated December 19, 2006, pursuant to Chapter
311 of the Texas Tax Code, as amended (the "Act"), the City created Reinvestment Zone
Number Two, City of Schertz, Texas (the "Zone") to promote development in the Zone through
the use of tax increment financing, which development would not otherwise occur solely through
private investment in the reasonably foreseeable future; and
WHEREAS, Section 3 of Ordinance No. 06-T-61 indicated that the Board of Directors
for the Zone (the "Zone Board"), pursuant to Section 31 1.0091 (c) of the Act, would consist of
nine (9) members plus the member of the State Senate and the member of the State House of
Representatives in whose district the Zone is located, for a total of eleven (11) members; and
WHEREAS, Section 311.0091 ( c) of the Act allows for a greater number of members to
be appointed to the Zone Board if the application of Section 31 1. 0091 (c) calculations so require;
and
WHEREAS, by virtue of the anticipated participating tax increment to be deposited in
the fund established for the Zone by the City, Bexar County, and the San Antonio River
Authority, the total number of Zone Board members shall be increased to twelve (12), eight (8)
of whom shall be appointed by the City; and
WHEREAS, to be eligible for appointment by the City to the Zone Board pursuant to
Section 311.oo91(f) of the Act, an individual must be (1) a qualified voter of the City or (2) at
least eighteen years of age and own real property in the Zone or be the employee or agent of the
owner of real property in the Zone;
NOW, mEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF mE
CITY OF SCHERTZ, TEXAS:
SECTION 1. APPOINTMENTS TO THE BOARD OF DIRECTORS OF THE
ZONE. The City Council hereby appoints the persons set forth on Exhibit A to serve as
members of the Zone Board, finding each to be qualified for appointment under the Act. Four
additional persons shall be appointed to serve on the Zone Board, one each to be appointed by
Bexar County, San Antonio River Authority, Senator Judith Zaffirini, and Representative Joe
Farias. All members shall serve for a term set forth in the Act and Bylaws to be adopted by the
Zone Board.
SECTION 2. INCORPORATION OF RECITALS. The City Council hereby finds
that the statements set forth in the recitals of this Resolution are true and correct, and the City
Council hereby incorporates such recitals as a part of this Resolution.

SECTION 3. SEVERABILITY. If any provision of this Resolution or the application
thereof to any circumstance shall be held to be invalid, the remainder of this Resolution and the
application thereof to other circumstances shall nevertheless be valid, as if such invalid provision
had never appeared herein, and the City Council hereby declares that this Resolution would have
been enacted without such invalid provision.
SECTION 4. EFFECTIVE DATE. This Resolution shall take effect on the date of
adoption hereof.
