2007R10-TXDoT FM 3009 RESOLUTION NO. 07-R-IO A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS OPPOSING THE TEXAS DEPARTMENT OF TRANSPORTATION FM 3009 ROAD EXTENSION PROPOSAL WHEREAS, the Texas Department of Transportation ("TxDOT") has proposed a project to extend FM 3009 from FM 78 to 1-10; and WHEREAS, TxDOT has requested that the City of Schertz, Texas (the "City") acquire right-of- way necessary for the FM 3009 extension; and WHEREAS, the City Council ofthe City (the "City Council") believes that such extension ofFM 3009 will cause drainage and flooding problems, will contribute to traffic flow problems within the City, and will create safety hazards to the citizens of the City and its visitors; and WHEREAS, the City Council urges TxDOT to utilize FM 1518 as the primary link within the City between 1-35 and 1-10, instead ofFM 3009. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: SECTION 1. The City Council hereby opposes TxDOT's proposed project to extend FM 3009 from FM-78 to 1-10 and confirms that it has no intention of acquiring right-of-way necessary to complete such extension. SECTION 2. The City Council recommends that TxDOT instead widen and improve FM 1518 as the primary link within the City between 1-35 and 1-10. SECTION 3. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. SECTION 4. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. SECTION 5. This Resolution shall be in force and effect from and after its final passage, and it is so resolved.
