The Schertz Board of Adjustment convened a public hearing on Monday, January 23,2006 at 6:00 p.m. in
the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas.

Chairman Hartzog called the meeting to order at 6:00 p.m.

Consider and act upon approval of the December 5, 2005 Board of Adjustment Minutes.
Minutes of December 5,2005 meeting disapproved.
4. Public Hearing
Chairman Hartzog opened the public hearing on the request for variance B0A2006-001. The
Chairman stated that this public hearing would accept public input on the specified BOA item and that
the BOA would consider all citizens comments in rendering its decision.

Hold Public Hearing and consider and act upon on a request for a sign variance to install two
(2) additional wall signs for Whataburger located at 5570 FM 3009, Block: 1, Lot; 5, Sub-
division: Wal-Mart Super Center.
Mr. Truitt said staff had reviewed the site and does not agree that two (2) additional wall signs (31.33
square feet) are needed to improve visibility for the business.
After a lengthy discussion on the locations of the two (2) wall signs

Mr. Duie:on made a motion to approve the two (2) wall signs subject to modifications ofthe signs.
'- There was no motion of a second to approve the sign request.
Mr. Harden made a motion to deny the sign variance application; he felt that there was no significant
proof of a hardship.
Ms. Hill seconded the motion. Mr. Hartzog and Mr. Duigon voted nay. Sign request was denied.
Mr. Hartzoe: closed the public hearing at 6:45 pm.
5. Items by Board of Adjustment Member and City Staff:
Ms. Hill gave her informal resignation to the Board of Adjustment members and staff. Ms. Hill will
be moving to Cibolo. Staff requested Ms. Hill's resignation in writing. Staffwill work on filling the
vacancy.
