BOA 10-24-2005 If':: ;;> ./ """ BOARD OF ADJUSTMENT MONDAY, October 24,2005 MINUTES The Schertz Board of Adjustment convened a public hearing on Monday, October 24, 2005 at 6:00 P.M. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. BOARD OF ADJUSTMENT Earl Hartzog, Chairman Ted Duigon, Vice Chairman Joe Potempa Kathy Hill Norman Slocum - Alternate William Sommers, P&Z Commissioner CITY STAFF Leonard Truitt, Building Official Debbie Perrone, Inspection Dept. Secretary MEMBERS ABSENT James C. Harden, Jr. OTHERS PRESENT Robert Brockman, 1000 Elbel Chuck Ramsey, Longshotz Mr. & Mrs. Douglas Jennings, 2501 Hourless Oaks Mr. Siwecki, 2505 Hourless Oaks 1. Call to Order . """ Chairman Hartzog called the meeting to order at 6:00 p.m. 2. Citizen Comments: No Comments 3. Consider and act upon approval of the September 26, 2005 Board of Adjustment Minutes. Ms. Hill moved to approve the minutes with the corrections noted. Mr. Duigon seconds the motion. Motion carried. Vote unanimous. 4. Public Hearing Chairman Hartzog opened the public hearing on the requests for variances BOA2005-006, BOA2005- 008, BOA2005-009. The Chairman stated that this public hearing would accept public input on the specified BOA items and that the BOA would consider all citizens comments in rendering its decision. a. BOA2005-006 Hold a public hearing and consider and act upon a request for a sign variance to install an additional 35 square foot illuminated sign "SPORTZ BAR" on the east elevation of the building located at 17327 IH 35 North, Suite #203, Block: 2 Lot: 15, Tri-County Industrial Park Subdivision, Zoning: General Business. Applicant: Chuck Ramsey '-" Mr. Truitt said that staff supported the sign variance request. Board of Adjustment - Minutes October 24, 2005 Page 1 of3 Mr. Duigon recommended that the entire sign be redesigned to include the desired wording within the """ specified 50 square foot. Mr. Ramsey stated that his establishment has been confused as being a gun shop and not a sports bar. Ms. Hill made a motion to approve the sign variance for LONGSHOTZ "Sportz Bar". Mr. Slocum seconds the motion. The vote to approve the sign variance request was 4 in favor. Mr. Duigon voted to disapprove the sign variance request. Public Hearing closed 6:30 p.m. b. BOA2005-008 Hold a public hearing and consider and act upon a request for a variance to install a 10' x 16' shed in the side yard set back at 2501 Hourless Oaks, Block: 21, Lot: 8, Belmont Sub-division, Zoning 5. Applicant: Mr. & Mrs. Douglas H. Jennings, Jr. Mr. Truitt briefed the BOA members that because ofthe "pie shape" yard there is a hardship in placing a shed on the property and staff recommended approval ofthe variance request to place a 10' x 16' shed. Mr. Siwecki, neighbor at 2505 Hourless Oaks had no problem with the construction of the shed. Mr. Duigon made a motion to approve the variance request for a 10' x 16' shed on 2501 Hourless Oaks. Ms. Hill seconds the motion. Motion carried. Vote unanimous. """" Public Hearing closed 6:35 p.m. c. BOA2005-009 Hold a public hearing and consider and act upon a request for a sign variance to install one (1) new double-faced non-illuminated multi-tenant monument sign 8'0" x 8'0" (64 square feet) at entrance off Green Valley Road. Applicant: Larry Godsman. Mr. Truitt advised the BOA members that staff have recommended disapproval ofthe sign variance request. Ms. Hill made a motion to approve the sign variance. Mr. Slocum seconds the motion. Voted to approve the sign variance request was 4 in favor Mr. Hartzog voted to disapprove sign variance request. Public Hearing closed 6:55 p.m. 5. Items by Commissioners and City Staff '--' Mr. Truitt advised the members that there would be a BOA meeting November 28,2005 with one (1) item on the agenda.
