BOA 05-21-2007 DEVELOPMENT SERVICES DEPARTMENT INSPECTION DIVISION 1400 SCHERTZ PARKWAY SCHERTZ, TEXAS 78154-1634 (210) 658-7477, FAX (210) 658-9627 BOARD OF ADJUSTMENT MONDAY, MAY 21, 2007 MINUTES The Schertz Board of Adjustment convened a public hearing on Monday, May 21,2007 at 6:00 p.m. in the Municipal Complex Council Chambers, Building #4, 1400 Schertz Parkway, Schertz, Texas. BOARD OF ADJUSTMENT Earl Hartzog, Chairman Ted Duigon, Vice Chairman Leonard Weinand, Jr. Alternate Donald McQueen, Alternate Davis Richmond - P & Z Commissioner MEMBERS ABSENT Norman Slocum James C Harden Jr. Joe Potempa Wm Sommers, P&Z Commissioner CITY STAFF Leonard Truitt, Director of Development Services Debbie Perrone, Administrative Assistant Yvonne Baker, Inspection Clerk OTHERS PRESENT Tom Chapman, presenting Benchmark Homes 1. CALL TO ORDER: Mr. Hartzo2 called the meeting to order at 6:00 pm. 2. CITIZEN COMMENTS: Citizen comments on items other than those listed on this agenda. None 3. Consider and act upon approval of the minutes for March 26, 2007 Mr. Weinand made a motioned to accept March 26,2007 with those changes made subject to review of the tape of what was actually said. Mr. McOueen seconded the motion. . Vote unanimous, motion carried. 4. PUBLIC HEARING: A B0A2007-016 LOT 26, BLOCK 2 Public Hearing on a request to encroach 2 feet 6 inches into the 25-foot front yard-building setback located on Lot 26, Block 2,3513 Big Horn Trail in Savannah Bluff Subdivision. Applicant: Benchmark Homes. *NOTE: 11 letters were sent out. Mr. Truitt said the house does encroach 2 feet 6inches into the front-yard setback. The house is currently built, but has not bee finalized. It would appear the earlier survey were incorrect. Staffhas reviewed the request and recommends approval. Mr. Sommers said this a classic example of a hardship that was created by someone else; that the homeowner didn't participate in. And as a result the only other thing he could do if the variance is not granted is to order the house be tore down and with that portion of the foundation tlylt is encroaching be removed and which is pretty ridiculous. Planning and Zoning does not have a problem with this variance request. . Mr. Hartzo2 closed the public hearing at 6: 15 pm. Mr. Dui20n made a motion to accept the variance request B0A2007-016 request from Benchmark to encroach 2 feet 6 inches to front yard-building setback. Mr. Weinand seconded the motion. Vote unanimous, motion carried. 5. ITEMS FOR INDIVIDUAL CONSIDERATION: There were no individual items for consideration. . 6. ITEMS FOR DISCUSION by Board of Adjustment - None City Staff - None 7.
