06-03-2008MINUTES REGULAR MEETING June 3, 2008 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on June 3, at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present, to -wit: Mayor Hal Baldwin Council Member Jim Fowler Council Member Tony Wilenchik Staff Present: City Manager Don Taylor Assistant City Manager John Bierschwale CALL TO ORDER REGULAR MEETING Mayor Pro -Tem John Trayhan Council Member David Scagliola Council Member Michael Carpenter Assistant City Manager David Harris City Secretary Brenda Dennis Mayor Baldwin called the meeting to order at 6:30 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Council Member Carpenter gave the Invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. HEARING OF RESIDENTS Mayor Baldwin recognized the following: • Mr. Louis Steelman, 272 Crepe Myrtle who spoke on EMS services on Crepe Myrtle. PRESENTATION • Proclamation — City of Schertz Public Library "30th Year Celebration" (Mayor Baldwin) Mayor Baldwin recognized Mrs. Ruth Tenor, Chair of the Library Advisory Board who introduced members and staff present. Mayor Baldwin read and presented a proclamation. ANNOUNCEMENTS Council General Announcements: Mayor Pro -Tem Trayhan • Stated that he attended the two Saturday sponsored events: 2008 Doggie Dash, and the 2008 Grackle Fest. He commended everyone for their efforts and making them a great success. City Council Regular Meeting 186 June 3, 2008 Council Member Fowler • Stated that he attended the two Saturday sponsored events: 2008 Doggie Dash, and the 2008 Grackle Fest. He stated the events were very successful and thanked everyone involved. • Stated that he attended a recent Texas Leadership Institute meeting on "Developing Successful Festivals & Events" which was held on May 29, 2008 in Bastrop, Texas. Council Member Fowler stated that he brought back some very valuable information and would be providing the information to George Antuna with EDC and Sandy Bryant with Community Services, and Frances Rushing with the Chamber. Mayor Baldwin introduced Council Member Scagliola the "Earl of the Grackles" Council Member Scagliola • Stated that he also attended the events held this past Saturday and again congratulated everyone for their hard work in making them a huge success. Council Member Wilenchik • Stated that he attended the 2008 Doggie Dash this weekend and stated that it was a huge success; 442 runners /walkers, that $8,000 was raised for the Schertz Humane Society. Council Member Wilenchik thanked everyone for their participation in making it a huge success. Council Member Carpenter • None. Items by Mayor • Mayor Baldwin ( "Prince of Grackles ") introduced City Manager, Don Taylor the "Duke of Grackles ", and stated that "Grumpy" was crowned "King of Grackles" and Councilmember Scagliola was crowned "Earl of Grackles ". Mayor Baldwin expressed his sincere appreciation to everyone that made the 2008 Grackle Fest and the 2008 Doggie Dash a great success. • Mayor Baldwin stated that on Friday, June 6, 2008 the Austin -San Antonio Intermunicipal Commuter Rail District meeting will be held at 10:00 a.m. at the Activity Center in San Marcos. Mayor Baldwin recognized Commissioner Wolverton who was in the audience this evening. REGULAR AGENDA 1. Minutes - Consideration and /or action regarding the approval of the minutes of the Regular Meeting of May 27, 2008. Mayor Baldwin recognized Mayor Pro -Tem Trayhan who moved, seconded by Council Member Fowler approve the minutes of May 27, 2008 with corrections noted. Vote was unanimous. Motion Carried City Council Regular Meeting 187 June 3, 2008 2. Ordinance No. 08 -D -28 — Consideration and /or action approving an ordinance amending Section 18 -76, Maximum limits on Specifics Streets. (FM 3009) First Reading (F. Salazar with TxDot /J. Bierschwale) Mayor Baldwin recognized City Manager Don Taylor who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Fowler who moved seconded by Mayor Pro- Tern Trayhan to approve Ordinance No. 08 -D -28 first reading. Vote was unanimous. Motion Carried 3. Ordinance No. 08 -M -21 — Consideration and /or action renewing the City of Schertz Curfew Ordinance. Final Reading (S. Pulaski) Mayor Baldwin recognized Warrant Officer Steve Pulaski who introduced this item. Mayor Baldwin recognized Mayor Pro -Tem Trayhan who moved, seconded by Council Member Scagliola to approve the Ordinance No. 08 -M -21 on final reading as presented. Vote was unanimous. Motion Carried 4. Ordinance No. 08 -S -26 — SUP 2007 -011 - Consideration and /or action on a request for a Specific Use Permit (SUP) for Lot 21, Block 2 of the Windy Meadows Subdivision consisting of approximately 1.0 acres of land located approximately 815 feet east of the intersection of FM1518 and Windy Meadows Drive. This proposed commercial lot is currently zoned General Business District — 2 (GB -2) and is located within the Air Installation Compatible Use Zone (AICUZ). Final Reading (I'. Rhodes /M. Nichols) Mayor Baldwin recognized Planner II, Misty Nichols who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Scagliola who moved, seconded by Mayor Pro -Tem Trayhan to approve Ordinance No. 08 -S -26 final reading. Vote was unanimous. Motion Carried 5. City of Schertz Visitor Center (Kramer House) - Discussion and consideration and /or action for approval of additional funding for City of Schertz Visitor Center (Kramer House). (G. Logan) Mayor Baldwin recognized Parks Director George Logan who introduced Mr. Jerry Mendenhall with J. Mendenhall Architects who came forward presenting a brief PowerPoint presentation answering questions from Council. Mayor Baldwin recognized Mayor Pro -Tem Trayhan who moved seconded by Council Member Scagliola to approve the additional funding request for $ 315,497 from the Hotel Motel Fund as presented to Council. Vote was unanimous. Motion Carried 6. Ordinance No. 08 -G29 — Consideration and /or action approving Ordinance No. 08 -G -29 repealing Ordinance No. 74 -G -38 setting the City Council compensation at Zero (0). First Reading (Mayor Baldwin) (Item placed back on agenda) City Council Regular Meeting 188 June 3, 2008 Mayor Baldwin introduced this item stating that because Council Member Carpenter was absent last week, he voted to not approve on second reading the previous ordinance setting the Council's compensation to zero (0). Council Members discussed their views on this ordinance in great detail and after much discussion; Mayor Baldwin called for a motion. Mayor Baldwin recognized Council Member Scagliola who moved seconded by Council Member Wilenchik to approve the ordinance on first reading. Vote was 31210 with Council Members Fowler and Carpenter Voting no. Motion Carried DISCUSSION AND UPDATE AND POSSIBLE ACTION 7. Deer Haven Road Improvements - Discussion and consideration and /or action regarding Deer Haven Road Improvements. (J. Bierschwale) Mayor Baldwin recognized Assistant City Manager John Bierschwale who introduced this item stating accessing the subdivision from FM3009 poses hazards due to limited deceleration lanes and narrow entrances. He stated that there was a Public Hearing originally held March 5, 2008 to discuss widening of the streets to 24 ft. and removing 50 trees. After negative input from residents, the City re- designed the plans which will narrow the streets and save as many trees as possible. A second public hearing was held May 21, 2008, to review the new plan, which was to widen the streets to 20 ft. and remove 13 trees. Residents voted for the re- design via ballot on the project scope which included FM3009 Deceleration Lanes, Entrance Widening, and 20 foot road width. Votes were tallied as: FOR: 34, AGAINST: 13 Mayor Baldwin recognized Mayor Pro -Tem Trayhan who moved seconded by Council Member Carpenter to approve the project as recommended by staff. Vote was unanimous. Motion Carried ANNOUNCEMENTS CITY MANAGER AND STAFF • General Announcements on meetings /events attended and upcoming events Mayor Baldwin recognized City Manager Don Taylor who publically thanked all the staff for their efforts on the recent events held in the City. Assistant City Manager John Bierschwale stated that he wanted to especially thank Brad Bailey and his staff as well. EXECUTIVE SESSION Called under Section 551.071 Litigation, pending litigation; Section 551.072 Texas Government Code - Deliberation regarding the purchase, exchange, sale, lease, or value of real property. Mayor Baldwin recessed the regular meeting to executive session at 8:05 p.m. City Council Regular Meeting 189 June 3, 2008 RECONVENE TO REGULAR SESSION Council Member Wilenchik left at 8:35 p.m. Mayor Baldwin reconvened regular meeting at 8:37 p.m. 8. Take any additional action deemed necessary as a result of the Executive Session. No action taken.
