BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:

THE STATE OF TEXAS,
WHEREAS, the City Council of the City of Schertz, Texas has
heretofore determined the advisability and necessity of providing
fire engines, fire hose, an engine house and other apparatus for
the extinquishment of fires.
WHEREAS, the City Council of the City of Scher..., Texas, has
heretofore determined the advisability and necessity of issuing
interest bearing time warrants against the General Fund of said City
of Schertz, Texas, to evidence a part of the indebtedness to be in-
curred in the acquisition of the above named items; and
WHEREAS, pursuant to the proYisions of Chapter 163, Acts of
the Regular Session of the Forty-second Texas Legislature, the
Mayor has caused notice to bidders for the acquisition of such items,
and notice of ontention of the City Council to pass an order on this
the ~th day of May, 1959, authorizing the issuance of City of
Schertz, Warrants for the purpose hereinabove mentioned, to be pub-
lished for the time and in the manner required by law; and
WHEREAS, this Council affirmatively finds that said notice to
bidders and notice of intention to pass the order authorizing the
issuance of such warrants was duly given by posting, in the manner
and for the time provided by law there being no newspaper published
in the City of Schertz, Texas;
WHEREAS, no petition has been filed by ten (10%) per cent of
the qualified property taxpaying voters of the City praying this

council to order an election for the purpose of submitting the pro-
position to issue bonds for said purpose to a vote of the qualified
property taxpaying voters of this City, and this council further
fi~ds that no petition of any kind or character in respect to the
issuance of the proposed warrants has been filed with the City
Secretary or any member of this Council, or any other official
thereof; and
WHEREAS, this Council hereby affirmatively finds and adjudges
that the financial condition of said City is such that it will per-
mit the payment of said warrants in the installments or maturit~es
as hereinafter set out without making any unjust burden of taxa-
tion tQSupport the same; and
WHEREAS, it is by this Council considered and determined to be
to the best interest and advantage oYsaid City of Schertz, to author-
ize the issuance of said Warrants, and it is now the desire of the
Council to authorize the issuance of such warrants in accordance
with the Constitution and Laws of the State of Texas;
NOW, THEREFORE, BE IT ORDAINED, ADJUDGED AND DECREED BY THE
CITY COUNCIL OF SCHERTZ, TEXAS:
I.
That there shall be issued under and by virtue of the Consti-
tution and laws of the State of Texas, and more particularly Chap-
ter 163, Acts of the Forty-second Texas Legislature, Regular Session,
1931, interest bearing time warrants of said City of Schertz, to be
known as City of Schertz Warrants, Series of 1959, against the
General Funds of said City, for the purpose of evidencing a part
of the indebtedness to be incurred acquiring the items of property
above listed.
II.
That said warrants shall be made payable to bearer and shall
be numbered from 1 to ~~ ' inclusive, shall be in the denomination

XI.
It is further ordered that in the event it mall not be necess-
ary to issue the full amount ofwarrants herein contemplated, then,
in such event, such amount of City of Schertz, Warrants, Series of
1959, as shall not be supported and based upon claims duly approved
by the Mayor and duly audited and allowed by the City Council of said
City, shall be cancelled and destroyed, the numbers and amounts of

upon the Minutes of the City Council.
XII.
That a special fund, to be designated "City of Schertz Warrants,
Series 1959, Fund", shall be, and the same is hereby created and set
aside out of the General Fund of Schertz, Texas, flhf which fund, when
collected, shall be used to pay the interest on said warrants and
the principal thereof at maturity, and for no other purposes;
That to create said fund tp pay the interest on said warrants,
and to provide a sin~ing fund to pay the principal thereof at matur-
ity, there shall be, and there is hereby levied for the year 1959
a tax of and at the rate of il''t'*"tE' 10\ ( /Je.) cents on each $100.00 val-
uable of taxable property in Schertz, Texas, out of the Ad Valorem
and property taxes levied by said City; and said tax of and at the

if any, as shall be necessary, is hereby levied out of the Ad Va1-
orem andproperty taxes levied by said City for each succeding year
thereafter while said warrants or any of them are outstanding, on

Texas, and said tax shall be assessed and collected for each of said
years, and applied to the purposes named, and to no other.
