PLANNING AND ZONING MINUTES September 13, 2005 The Schertz Planning and Zoning Commission convened on September 13, 2005 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Call to Order/Roll Call Mr. Richmond called the meeting to order at 6:30 P.M. 2. Citizen Comments There was no one present to speak. 3. Consent Agenda A. PC2005-050 Consider and act upon a request for final plat of the Ridge at Scenic Hill, Unit 2A. The 32.20 ::!:: acre tract is located at the intersection of IH 35 and Country Club Boulevard and contains 108 single-family lots. The property is zoned Pre-Development (PD) Applicant: Pulte Homes of Texas, L.P. B. PC2005-051 Consider and act upon a request for final plat of Associate Drive Extension, Phase 2. The 0.9643::!:: acre tract is located on the northwest corner of Doerr Lane and Associate Drive. Applicant: Carter & Burgess There were no items pulled for discussion. Mr. Sommers moved to approve the items on the consent agenda. Mr. Wallace seconded the motion. V ote unanimous. Motion carried. 4. Public Hearing A. ZC2005-022 Hold a public hearing and consider and act upon a request to rezone from Pre- Development District (PD) to Manufacturing District-Light (M-1) of the Harral Subdivision. The 4.0::!:: acre tract is located on Hubertus Road approximately 355-feet east of Fm 482. (361 Hubertus Rd.) Applicant: Thomas and Sharon Harral Background: The Planning and Zoning Commission approved the preliminary plat on May 10, 2005 and Minutes Planning and Zoning Commission September 13, 2005 Page I on . .. . the final plat was approved on July 12, 2005 without conditions or corrections. Mr. Harral is currently using the property for storage of construction materials and equipment. He understands that when he decides to build on the property a site plan will be required, only the existing condition ofthe property is grandfathered. Analysis & Discussion: The adjacent properties are currently undeveloped. According to the Comprehensive Land Plan, this area is to be designated for Industrial/Warehouse Office type development. Public Hearing Requirements: The public hearing notice was published in the City's official newspaper on September 1, 2005, and notices were mailed to surrounding property owners on August 30, 2005. Seven letters of notification were mailed and staff received no responses at this time. Prior Project Review & Action: Preliminary Plat- May 10, 2005- approved- no conditions Final Plat - July 12, 2005-approved- no conditions Staff Development Review: There is an existing drainage easement located at the rear of the property and it handles the storm water for this site. Legal Issues: The property was annexed on December 29,2004. The property had an existing use when the City annexed the property. Legal Non-Conforming status/use on site, and it is currently zoned Pre-Development (PD). Future Issues: The applicant is aware that any additions or changes to the property will require prior Site Plan approval. Staff Analysis: The current condition of the property: construction trailer on site with various pieces of construction equipment, and a chain link fence for security of the property. Staff Conclusion: Based on the above, staff concludes that the zoning request meets all requirements on the Unified Development Code as well as the Engineer, Public Works, and Planning Department. Staff Recommendation: Options: Approve Staff Recommendation: Staff recommends the Planning and Zoning Commission forward this item to City Council with a recommendation of approval. Mr. Brockman asked if the use of the property was going to change. Mr. Haddock stated the property cannot be changed from its current use nor can any buildings be placed on this site until a site plan is approved. Following review and discussion Mr. Haddock moved to forward this item to City Council with a recommendation of approval. Mr. Wallace seconded the motion. Vote unanimous. Motion carried. 5. Items for Individual Consideration: There were no items to consider. 6. Items for Discussion A Director's Report Ms. McBeth: The Planning Department received 19 applications at last submittal consisting of a lot of plats, site plans, and some zoning changes. B City Council's Report Mr. Wilenchik: Stated that the City Council has held two meetings since the last Plmming and Zoning meeting, and reviewed the actions made by City Council for the past two agendas. C Planning Commissioner Comments Mr. Richmond: Mentioned that we have an overlay for the Air Installation Compatible Use Zone that protects Randolph - this is why the Specific Use Permit and the overlay exist in the Unified Development Code. Mr. Evans: Stated that he met with City Council members who were confused about the Specific Use Permit and the Air Installation Compatible Use Zone when changes are made and being presented to City Council in a different way than was forwarded by the Planning and Zoning Commission. Mr. Haddock: None Ms. Tutschke: Asked about the intersection of Legacy Oaks Drive and Schertz Parkway having traffic turning left and right onto Schertz Parkway. She stated that she mentioned this before and wanted to know if there was an update. Ms. McBeth stated that she would get together with the Public Works Director again for an answer. Mr. Sommers: Stated that he was concerned with the exit ramp for Schertz Parkway off IH 35 southbound. He mentioned that cars are shooting off the highway across the intersection to turn on Tri- County, He stated that he would like to see a bubble mirror at this intersection. Mr. Wallace: None 7.
