10-25-2005 PLANNING AND ZONING MINUTES October 25, 2005 The Schertz Planning and Zoning Commission convened on October 25, 2005 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Call to Order/Roll Call Mr. Richmond called the meeting to order at 6:30 P.M. 2. Citizen Comments Mr. Freeman stated that he is interested in building a Transmission Shop on Main Street. He asked if the Planning and Zoning Commission would consider such a development in the General Business Zoning District. Mr. Richmond suggested Mr. Freeman contact the Planning Department for further assistance and processes for development. 3. Consent Agenda A. Consider and act upon approval of the September 13, 2005 Planning and Zoning Commission meeting minutes. There were no items pulled for discussion. Mr. Wallace moved to approve the item on the consent agenda. Mr. Van Dine seconded the motion. Vote unanimous. Motion carried. 4. Public Hearing Minutes Planning and Zoning Commission October 25, 2005 Page 1 of 4 A. SUP2005-001 Hold a public hearing and consider and act upon a request to grant a Specific Use Permit to allow for an office/warehouse facility to be located in the Air Installation Compatible Use Zone (AICUZ) on Lot 29, Block 1 of Schertz Business Park. The property is zoned General Business (GB). Applicant: Michael F. and Jennifer S. Biry Ms. Ellis reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. There were four letters mailed, one was returned in favor. The City Council will hold a public hearing on November 15, 2005. Public Hearing Closed at 6:44 p.m. Mr. Sommers asked if the property owner realizes that the Specific Use Permit (SUP) is for the present owner only. If the property should be sold the new owner will be required to apply for a Specific Use Permit. Ms. Ellis stated they are aware this (SUP) is intended for the current property owner only. With no further discussion, Mr. Wallace moved to recommend approval to the City Council. Mr. Van Dine seconded the motion. Vote unanimous. Motion carried. B. SUP2005-002 -CANCELLED Hold a public hearing and consider and act upon a request to grant a specific use permit at Lot 5 of Block 6, Greenfield Village, Unit 2 (116 Will Rogers Drive) to allow for the operation of a business in a Residential-1 District (R-1). Applicant: Robert and Mary Fikes No discussion or action was taken on this item. C. ZC2005-024 Hold a public hearing and consider and act upon a request to rezone 98.9± acres from ResidentiaUAgricultural District (R-A) to Residential District-7 (R-7). The tract is situated out of the Rafael Garza Survey No. 98, Abstract No. 138 and Abstract No. 1'75 in Guadalupe and Comal Counties, Schertz, Texas. The property is generally located between IH 35 and Old Wiederstein Road, approximately 550-feet west of FM 1103. Applicant: Intermandeco, Ltd. Ms. Ellis reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. There were 141etters of notice mailed, two letters returned in favor. ZC2005-030 Hold a public hearing and consider and act upon an amendment to the Unified Development Code (Ordinance 96-5-28), Article VII (Special Uses) Section 7, (Planned Unit Development - Ordinance 05-5-40). Applicant: City of Schertz Ms McBeth reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Public Hearing Closed at 6:56 p.m. Mr. Richmond thanked staff for their hard work and stated that he is happy with the document. With no further discussion, Mr. Van Dine moved to recommend approval to the City Council. Mr. Sommers seconded the motion. Vote unanimous. Motion carried. 5. Items for Individual Consideration: A. ZC2005-025 Consider and act upon a request to rezone 853.68± acres from ResidentiaUAgriculture District (R-A) and General Business (GB) to Planned Unit Development (PUD). The subject property is situated in the Julian Diaz Survey No. 66, Abstract No. 187, the E.R. Evans Survey No. 80, Abstract No. 216, and the Geronimo Leal Survey No. 79, Abstract No. 424, Bexar County, Schertz, Texas. The property is generally located on the west side of FM 1518 between Lower Seguin Road and Ware Seguin Road. Applicant: Schertz 1518, Ltd. Ms Ellis reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Mr. Hawkins stated it is important that a school site is located in this area. Mr. Richmond asked if the proposed site is intended for fifth and sixth grades as well. Mr. Hawkins stated that there is no definite answer for the question. The school is planned for Kindergarten through fourth grades, but things could change. Mr. Richmond voiced concerns about the commercial pod being so close to a potential school. Staff explained that TABC rules do not allow the sale of alcohol within 1,000 feet of a school. Staff ensured that the city would enforce this rule as well. Mr. Richmond called for a short break at 7:10 p.m. The meeting reconvened at 7:21 p.m. The Commissioners indicated concerns with the architectural standards of the Planned Unit Development (PUD), and asked for assurance that there will be some type of guidelines. Mr. Aiken stated that the PUD development has its own restrictions for builder compliance in addition to the Ordinance PUD requirements. With no further discussion, Mr. Haddock moved to recommend approval to the City Council. Mr. Van Dine seconded the motion. Vote unanimous. Motion carried. 6. Items for Discussion Minutes Planning and Zoning Commission October 25, 2005 Page 3 of 4 A. City Council Mr. Wilenchik: The Moratorium on Live Oak Hills has expired. The Chamber of Commerce will be leasing the Community Center Conference Room. The City Council has turned over the traffic issue concerning Legacy Oaks Road and Schertz Parkway to the Transportation and Safety Advisory Commission (TSAC) for review and recommendation. The City Council acted on the reappointment of Mr. Richmond and Mr. Wallace, and newly appointed Mr. Kevin Grant. B. Director's Report Ms. McBeth: Provided the Commissioners with a copy of Mr. Grant's Volunteer application. Mr. Haddock will be honored at the City Council meeting on November 15, 2005. Mr. Taylor has appointed Ms. McBeth as the direct liaison to the Planning and Zoning Commission allowing her the authority to sign plats, etc. Ms. Ellis was promoted to Planner 1, October 1, 2005. There are potentially twelve items for the next meeting. C. Planning Commissioner Comments Mr. Richmond: Asked to clarify that "Laura Heights" is the correct name for the development on the next agenda. Mr. Evans: None Mr. Haddock: None Ms. Tutschke: Wanted to verify that the 22 November and 27 December Planning and Zoning meetings are cancelled. Mr. Sommers: Stated that he will be attending a trial on December 5 and will be out for about a week and a half. The Board of Adjustment met October 24, 2005 and approved three variances. 1) A 350 square foot sign addition to the Longshotz Sports Bar, 2) A 10'x16'-square foot shed, 3) A two faced free standing sign for an Orthodontist at the Oaks at Green Valley development. Mr. Van Dine: Asked if the Planning and Zoning Commission will be reviewing the Traffic Impact Analysis, Signs, and the drainage report. Mr. Wallace: None 7.
