04-13-2004 PLANNING AND ZONING MINUTES APRIL 13, 2004 .The Schertz Planning and Zoning Commission convened on April 13, 2004 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Chairman Richmond called the meeting to order at 6:31 p.m. Call to Order/Roll Call 2. Citizen Input other than Agenda Items Ms. Van Diest and Ms. Stark made a presentation to the Commission on a proposed development at FM 1518 and Lower Seguin Road. The 25-r. acre tract is partially in the City of Schertz along the frontage. Their plan calls for approximately 26 four-p1ex units. Mr. Richmond thanked the ladies for their presentation and asked them to get with staff to go through the correct process. 3. Board of Adjustment Actions: The Board of Adjustment met on April 5, 2004 and approved the request from Richard Wiseman, 2449 Woodbridge Way to encroach 5-feet into the lO-foot minimum separation requirement between the main building and an in-ground pool. 4. Code Enforcement Issues Ms. Madison reviewed the Code Enforcement Report for March 2004. She also mentioned that the church sign has been removed on Schertz Parkway and that she has notified Mr. Sch1ather regarding the container signs on IH 35. Discuss and take appropriate action to remove this item from the table and withdraw the request to rezone 41.418-r. acres of land out of the Genobra Malpaz Survey No. 67, Abstract No. 221, in the City of Schertz, Guadalupe County, Texas from Neighborhood Services (NS) and Apartment/Multi-Family Dwelling District-4 (R-4) to Residential-2 District (R-2) Applicant: City of Schertz Ms. Madison reviewed staff comments stating that a public hearing was conducted and action was tabled at the February 10, 2004 Planning and Zoning meeting. Due to a pending contract on the property, the Commission needs to withdraw this item from consideration. Ms. Briscoe inquired about when the contract for the property expires, and Ms. Madison replied in December of 2004. It was agreed that this item would be brought forward at that time for review and consideration. Following discussion, Mr. Haddock moved to remove this item from the table and to accept the applicant's withdrawal request. Mr. Wallace seconded the motion. Motion carried. Vote unanimous. 6. PC2004-0001 Discuss and take appropriate action on a replat of Northcliffe Community, Section One, Block 8, Lot 8 and Block 10, Lot 12 establishing Northcliffe Village Subdivision. The 5.9:1:: acre tract shows 21 single family lots zoned Residential-6 (R-6). Applicant: 1103 Land Development, LTD . Ms. Madison reviewed staff comments stating that the zoning on this property was approved by City Council at their April 6 meeting. The rep1at shows 21 sing1e- family lots and is consistent with surrounding development. Mr. Haddock inquired if the house on Lot 9, Block 2 would be fronting Portage Lane. Mr. Steve Hanan was present and stated that it would. Following review and discussion, Mr. Wallace moved to approve the request. Mr. Haddock seconded the motion. Voting Aye: Mr. Richmond, Mr. Haddock, Mr. Van Dine, Ms. Briscoe and Mr. Wallace. Mr. Sommers abstained from the vote due to not being present during the discussion. Motion carried. 7. PC2004-012 Discuss and take appropriate action on a site plan located in the Schertz Industrial Park Subdivision, Block 2, Lot 2. The 1.30:1:: acre tract shows a proposed 20,000 square foot office/storage warehouse. Applicant: J.M. Properties Ms. Madison reviewed staff comments and stated the 20,000 square foot facility IS proposed for office/warehouse use and that the building signage will be installed after occupancy. Mr. Richmond asked about the placement of the four trees and Ms. Madison stated that they are not placed in the right-of-way. . Following review and discussion, Mr. Haddock moved to approve the request. Mr. Wallace seconded the motion. Motion carried. Vote unanimous. SUP2004-001 Discuss and take appropriate action to call a Public Hearing for a specific use permit for Block 1, Lot 14, in the Schertz Business Park to allow for an office/warehouse facility for a construction company to be located in the Air Installation Compatible Use Zone (AICUZ). The property is located at 132 Commercial Place. Applicant: Forum Construction Company, Inc. . Ms. Madison reviewed staff comments and stated that the Planning and Zoning Commission approved the site plan at their November 25, 2003 meeting. The site is located in the AICUZ and requires a specific use permit. Staff recommends the Commission call a public hearing to be conducted on May 11, 2004. Following review and discussion, Mr. Haddock moved to call for a public hearing on May 11,2004. Ms. Briscoe seconded the motion. Motion carried. Vote unanimous. 9. ZC2004-004 Discuss and take appropriate action to call for a Public Hearing to rezone properties along the IH 10 Corridor from Residential/Agricultural (RA) to General Business (GB) and Manufacturing District-Light (M-l) Applicant: City of Schertz Ms. Madison reviewed staff comments stating the area for the IH 10 Industrial Corridor has been reduced due to the area exceeding 1,000 acres and a multitude of property owners being involved. The new area covers approximately 695 acres with less than 15 property owners. . Mr. Richmond asked staff to calculate the acreage for the existing industrial parks currently located in the City. Mr. Van Dine inquired about the setback distance for the GB zoning along IH 10. Ms. Madison stated it would be 755-feet from the centerline ofIH 10. Following review and discussion, Mr. Haddock moved to call for a public hearing on May 11,2004. Mr. Wallace seconded the motion. Motion carried. Vote unanimous. 10. Close the Regular Session for a Public Hearing at 7:00 p.m. Chairman Richmond closed the Regular Session and opened the meeting for a Public Hearing at 7:05 p.m. 11. PUBLIC HEARING Resolution No. 04-R-02 Public Hearing to receive citizen comments regarding a proposed City of Schertz Resolution imposing a moratorium on property development in the platted residential subdivision identified as the Live Oak Hills Subdivision. Mr. Tim Sheb1e voiced the following concerns for the moratorium: shortage of public facilities, the investment of the original property owners, rumors of condemnation by the City, suggested rep1atting and creating an "owner's association", establish a re-investment zone, and drainage. . Mr. Mike Smith stated he supported a moratorium if the City's objective is outlined. He stated his family has owned the property for 27 years and he believes that changing the homeowner's deeds and restrictions Minutes Planning and Zoning Commission April 13, 2004 Page 3 of4 may be an alternative. . Mr. Robert Brockman announced he was in favor of the resolution to impose a moratorium. There being no one else to speak, Chairman Richmond closed the public hearing. 12. Reconvene into Regular Session of the Planning and Zoning Commission. Chairman Richmond reconvened into Regular Session at 7:39 p.m. 13. Items by Commissioners and City Staff . Update on Comprehensive Land Plan . Southside Tour Ms. Madison: Updated the Commission on the progress of the Comprehensive Land Plan Committee stating that the group had toured the south and north sections of the City and were moving quickly to bring forward a recommendation for the thoroughfare and land use plans. Mr. Wallace: Stated he would not be available for the Apri127, 2004 Planning and Zoning meeting. Mr. Sommers: Asked that staff inform the developer that soil materials placed on the Mesa Oaks property were placed too close to the trees. His concern was that the trees would die. . Councilman Greenwald: Work has started again on the E1be1 Road drainage project. Southwestern Bell had created the problem when utility lines were severed. Construction should be finishing in late July. He also announced that a contract had been signed with Universal City for the sale of water with the SSLGC. He also stated that the City Council is reviewing a possible upcoming bond. Chairman Richmond: Asked staff for an update of the sidewalk issue between Greenshire Drive and Green Valley Road Elementary. Ms. Madison stated that the engineer (Don McCrary) would be submitting the plans to the Public Works Department. Mr. Richmond also asked staff to review the sign at Northcliffe Golf Course. The green neon frame is distracting. 14. Adjournment There being no further business, Mr. Van Dine moved to adjourn the meeting at 7:52 p.m. Mr. Haddock seconded the motion. Motion carried.
