1975R05- ALAMO AREA COUNCIL RESOLUTION No. 75-R-5 A RESOLUTION ACKNOWLEDGING THE RESPONSIBILITY FOR LAND USE PLANNING; AND RECOGNIZING AND SUPPORTING THE ALAMO AREA COUNCIL OF GOVERNMENTS AND CIBOLO CREEK MUNICIPAL AUTHORITY AS THE RESPONSIBLE AGENCIES FOR THE FEDERAL 208 PLAN- NING PROGRAM ACTIVITIES FOR THE AREA ENCOMPASSING THE CITY LIMITS OF THE CITY OF SCHERTZ. WHEREAS, the City of Schertz is interested in orderly and planned development of its exixting and future jurisdictional boundaries, and WHEREAS, an effective coordination of waste water management through the planning process, would be a valuable tool to alleviate severe water quality problems within Schertz' jurisdictional boundaries, and WHEREAS, the City of Schertz recognizes that Federal 208 Planning Funds have been granted to the Alamo Area Council of Governments for the purpose of regional water quality management; and WHEREAS, Public Law 92-500 requires land use planning and Texas statutes empower the municipalities to be the responsible agents to fulfill this planning obligation within their individual jurisdict- ional boundaries; and WHEREAS, the City of Schertz desires to exercise this planning responsibility through its Planning Commission; and WHEREAS, the City of Schertz, by contractual agreement, recognizes the legislative designation of Cibo1o Creek Municipal Authority as the regional entity for water quality management. NOW, THEREFORE, BE IT RESOLVED that the City of Schertz will, as required by PL92-500, identify, if appropriate, designate and enforce land use requirements, as articulated in Sub-Section 2, Paragraphs F, Hand K of PL 92-500; BE IT FURTHER RESOLVED that the City of Schertz will continue its joint efforts with the Cibo1o Creek Municipal Authority to develop a plan to produce a coordinated water::qua1ity management system for the area and to implement the plan with the Cibo1o Creek Municipal Authority upon adoption of the plan by the City of Schertz; AND BE IT FINALLY RESOLVED that the City of Schertz, through its continued support of and cooperation with the Alamo Area Council of Governments as well as the Cibo1o Creek Municipal Authority as those agencies having planning jurisdiction for the areas encompass- ing the City limits of the City of Schertz, does hereby support these agencies as having the responsibility for planning water quality management under the guidelines of the Federal 208 Planning Funds Program.
