1976R09- TWELVE-INCH WATER MAIN BELOW NACOGODOCHES RD WELL SITE ---._-" '-" 1;6. ~t~1?~ r :# ?~-R-f A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AUTHORIZING THE CITY UTILITY SUPERIN- TENDENT TO PROVIDE A TAP OF THE CITY'S TWELVE- INCH lvATER MAIN BELOW THE NACOGODOCIIES ROAD . WELL SITE AND ADJACENT TO FM 2252 FOR THE PURPOSE OF SUPPLYING POTABLE WATER TO THE PROPRRTY O~VNED BY LADSHAW-MILLER DEVELOPMENT CO. , INC. vJHEREAS, the City is grantee in a warranty deed which stipulates the following: "A condition of this deed is that if the City of Schertz produces water from the property herein con- veyed, the grantors (George M. Heberer, et ux) herein, their successors and assigns, shall have the right to be supplied by the City of Schertz, Texas, with potable water in such quantities as may be necessary to provide an adequate water system"; and WHEREAS, Ladshaw-Miller Development Co., Inc. owns a parcel of property properly conveyed by the EState of George M. Heberer, thereby making them assignees as outlined above; and lVHEREAS, Ladshaw-Miller Development Co., Inc. has agreed to pay the charges to connnect to a 12" City main, which charges consist of the costs of all labor and materials used in connection with the tap into said main, including the cost of placing a meter box, plus ten percent (10%); and WHEREAS, Ladshaw-Miller Development Co., Inc. has agreed to pay all costs incurred in connection with the construction of a water service line from the City's 12" main to the aforesaid land purchased by Ladshaw-Miller Development Co., Inc. from the Estate of George H. Heberer, which service line shall be designed to serve any improvements constructed on said landi and WHEREAS, Ladshaw-Hiller Developmept Co., Inc. has agreed to comply with the provisions of Ordinance #270 (a copy of which ordinance is attached hereto); NOW, T.HEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I That the City Utility Superintendent is hereby autho- rized to make a tap and service line connection to the City's 1211 water main below the Nacogdoches; Road well site and adjacent to FH 2252 for the purpose of supplying potable water to improvements constructed on lands owned by Ladshaw-Miller Development Co., Inc. and purchased from the Estate of George M. Heberer. II That Ladshaw-Miller Development Co., Inc. will pay the City of Schertz, Texas, all actual expenses for main tap, con- nection fee, meter and meter box, plus ten percent (10%) of such costs. III That in the future, each individual water customer or user occupying any new business, whehter commercial or residential, shall be individually metered; and no two or more different busi- nesses or residential units or combination thereof located within the same premises shall be connected to the same meter. . ,.,., ..;;1Ii . .. IV That Ladshaw-Mi11er Development Co., Inc. is not autho- rized any future taps of their service line coming from the City's 12" water main located at FM 2252 without first obtaining 'tvritten permission from the City of Schertz, Texas, and complying with Ordinance #270 ~nd any amendments thereto. V That Ladshaw-Miller Development Co., Inc. agrees to comply with the provisions of Ordinance #270 of the City of Schertz, Texas, which require a monetary deposit for a water meter and a water charge to be asssesed for water service and all other provisions of said Ordinance #270 and any amendments thereto. mo, ADOPTED AND APPROVED this, the /9d; day of J.-e/-u , 1976.
