1979R01- STREET ASSESSMENT PROGRAM . . . . . . . RESOLUTION NO. ?9-,K- / A RESOLUTION ESTABLISHING AND OUTLINING A STREET ASSESSMENT PROGRAM. WHEREAS, no policy exists for the improvement of streets in the City of Schertz; and WHEREAS, the Subdivision Ordinance does not speak to the problem of improving streets; and WHEREAS, a policy for street improvement needs to be set forth; and WHEREAS, it is the intent of the City that property owners partici- pate in the improvement of their streets, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, that SECTION 1 Street improvements, except those streets covered by the Subdivision Ordinance, shall be covered by a Street Assessment Program.;' as set forth in Article 1105 b of State Statutes. SECTION 2. A portion of the cost of said improvements shall be paid and defrayed by the City, and a portion of the cost thereof shall be assessed against and paid by the property abutting upon said streets, and shall be paid and defrayed as fo 11 ows : A. The City shall pay all of the cost of drainage installations where ever located, all of the cost of excavation, base prepar- ation and paving within street and alley intersections and not less than twenty percent (20%) of the cost of excavation, base preparation and paving of all other portions of the street involved. B. The remaining cost of all such improvements shall be paid by the property abutting said street units and the owners thereof. C. The City shall pay for its part of work on the various street units on monthly estimates as the work progresses. D. The remainder of the costs of such improvements shall be assessed against respective abutting properties. The amounts of such assessments shall constitute a first and prior lien upon all such properties and a personal liability of the true and real owners thereof. E. When the improvements have been completed and accepted by the City, the amount of the assessment, together with interest shall become payable in eight (8) equal annual installments. SECTION 3.
