A RESOLUTION
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, EXPRESSING THE INTENT OF THE CITY TO
TERMINATE THE PARTICIPATION BY THE CITY OF
SCHERTZ IN THE FEDERAL SOCIAL SECURITY SYSTEM.
WHEREAS, the City of Schertz, has participated for more than
five (5) years prior to the adoption of this resolution, in the Social
Security System established by Title II of the Federal Social Security
Act; and
WHEREAS, the City of Schertz entered into an agreement with
the Texas Department of Public Welfare for the purpose of extending
the benefits of the Social Security System to employees of the City
as authorized by Article 695g, Vernon's Texas Civil Statutes; and
WHEREAS, the City of Schertz has now determined that it is
in the best interest of the City and it's employees to withdraw from
the Social Security Program; and
WHEREAS, the City of Schertz now wishes to give notice to the
Texas State Department of Public Welfare of the intent of the City to
terminate the existing agreement of the City to participate in the
Federal Social Security Program; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:

That the City of Schertz, acting by and through its duly
elected City Council, has elected to terminate the participation of the
City in the Federal Social Security System and notice of such termination
is hereby given as required by the Federal Social Security Act and by
Article 695g, Vernon's Texas Civil Statutes, as amended and in accordance
with rules adopted by the Texas Department of Public Welfare pursuant
thereto.

The City Manager of the City of Schertz is hereby authorized
and directed to execute any and all forms, notices, disclaimers, and
other documents as may be necessary and required by the Federal Social
Security Act and by other applicable Federal and State legislation and
rules and regulations adopted pursuant thereto in order to effect the
termination of participation by the City in the Federal Social Security
System.
