1985R10- COSTRUCT LIVE OAK ROAD " -,. , RESOLUTION NO. ~6 -/<-/0 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, OF INTENT TO CONSTRUCT LIVE OAK ROAD (SCHERTZ PARKWAY) TO IH 35 AND THAT A REALISTIC MEANS OF FUNDING THE PROJECT IS BEING PURSUED TO PROVIDE FOR SUCH CONSTRUCTION COSTS. WHEREAS, the City council of the City of Schertz has determined that there is a need to extend Live Oak Road (Schertz parkway) to IH 35; and WHEREAS, action has been taken to acquire the necessary right-of-way for the project; and WHEREAS, the major landowners have stated that they will issue letters of commitment to dedicate the necessary right- of-way for the road; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT the City Council of the City of Schertz believes that a realistic means of funding the project can be accomplished and is taking appropriate action to finalize these provisions. Drawer I Schertz, Texas 78154 Dear Mr. Gilmore: Several land owners and developers visited me last week in regard to the proposed interchange of IH 35 with the Live Oak Road extension. There seemed to be some confusion as to what the State would need from Schertz as evidence of the City's intent to proceed with the Live Oak Road project. Specifically, they asked if right-of-way for Live Oak Road need be dedicated or deeded to the City immediately, or if a letter of commitment would suffice until such time as the right-of-way would actually be required for construction. For our purposes, a letter of commitment from major landowners indicating their intent to donate will be satisfactory. In addition to the above evidence of right-of-way acquisition, we will need a resolution, or other evidence, from the City of Schertz indicating intent to construct the road and that a realistic means of funding the project is being provided for.
