1985R17- EXISTING DRAINAGE EASEMENT RESOLUTION NO.~~~J?~~___ A RESOLUTION REQUESTING THE STATE HIGHWAY AND PUBLIC TRANSPORTATION COMMISSION TO DECLARE AN EXISTING DRAINAGE EASEMENT APPURTENANT TO F.M. 3009 IN GUADALUPE COUNTY, TEXAS SURPLUS TO THE NEEDS OF THE STATE. WHEREAS, by Channel Easement dated October 7, 1971 and recorded in Volume 445, page 272-274 the Deed Records of Guadalupe County, Texas, a 0.184 of an acre drainage channel conveyed by Evelyn Dramme Ripps, to the state of Texas, and; WHEREAS, the existing 0.184 acre channel easement as reflected in Field Notes attached and marked Exhibit "A" is misplaced and is no longer needed for drainage purposes or for use by citizens for highway purposes, and; WHEREAS, the State has contacted the property owner and with their approval have agreed upon a new workable location of a proposed channel easement of the same size as is described in the attached Field Notes marked Exhibit "B", and; ,WHEREAS, the old existing channel easement is no longer needed and the new proposed channel easement will better handle the drainage; and WHEREAS, it is original 160 acre tract is or by the citizens for utilized as an exchange drainage channel easement; apparent that 0.184 acre tract of the no longer needed for drainage purposes highway purposes and can be better for said proposed 0.184 of an acre NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT the State Highway and Public Transportation Commission pass an appropriate Minute Order declaring said existing 0.184 of an acre drainage channel easement to be surplus to the needs of the State and that all right, title and interest in and to said easement to be exchanged for the proposed 0.184 of an acre drainage easement.
