1986R14- SCHERTZ MODULAR PARK, UNIT 1 CITY OF SCHERTZ RESOLUTION OF NONCOMPLIANCE SCHERTZ MODULAR PARK, UNIT 1 RESOLUTION NO. If" - 1< -ILl WHEREAS, the City Council of Schertz, Texas is the governing body of the City of Schertz, Texas; WHEREAS, the City Council of Schertz, Texas has duly adopted~he Zoning Ordinance (79-S-15), as amended, to insure orderly growth with the City of Schertz, Texas corporate boundaries; WHEREAS,. the City Council of Schertz, Texas has duly adopted the Subdivision Ordinance (80-S-13), as amended, to insure all subdivision of land within the corporate boundaries and extraterritorial jurisdiction will conform to' the rules and regulations set forth in said Ordinances; WHEREAS, the City Council of Schertz, Texas has duly adopted a Mobile Home Ordinance (81-S-2), as amended, to provide standards and insure safety of Mobile Home Parks and Mobile Home Subdivisions; WHEREAS, the City Council of Schertz, Texas has duly adopted a Flood Plain Management Ordinance (77-M-9) making provisions related to development within the City of Schertx, Texas designated flood plains; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: That the Schertz Modular Home Park, Unit 1 is now in noncompliance with the aforementioned ordinances by constructing a new street (safety lane), in- stalling utilities and by making unauthorized changes of land elevations within a designated flood zone, construction of safety lanes within the flood zone of insufficient width including curves less than authorized. Specific areas of noncompliance are: 1. A new safety lane was built without City authorization. It also is in violation of the recorded plat (Vol. 9512, Page 112) and Schertz Subdivision Ordinance (Section 15.4 e., f., g. and Section 16.2. c., d., e., f.). Authorized variance for safety lanes is twenty-eight (28') feet. This new lane was measured in five (5) places, starting approximately 1/10 mile from Nu Pecan Grove Drive it was measured 24 feet width, another measurement approximately 28 feet further west measured 24 feet 4 inches, next further west .was 24 feet followed by 23 feet 9 inches and 24 feet in the curve leading to the intersection of Coconut Palm and Oak Bloom. (Section 28, Subdivision Vrdinance and Section VII. C4a, Mobile Home Ordinance) 2. This entire new road plus installed utilities appears to be. built within the 100 year flood plain with considerable recon- touring of the ground within this area which could affect this property and downstream residents during high water. There is no supporting hydraulic or engineering data to support these changes. (Section 31.3 Subdivision Ordinance, and Section 6:02A, Schertz Flood Plain Management Ordinance 77-M-9) 3. Street lights have not been installed within the platted area of Pecan Grove Modular Home Park although people have already moved in and are living in this area. (Section VII, A.5. Mobile Home Ordinance) 4. Notes on the recorded plat for this Subdivision that have not been complied with are: (a) Note 1. No written "Emergency Flood Evacuation Plan" has been provlded by park management or approved by the City. (b) Note 2. Emergency Flood Warning System has not been installed. (c) Note 3. Signs warning of possible flooding at all entrances within the 100 year flood plain have not been posted. (d) Note 4. Flood Gates to entrance within 100 year flood plain not installed.
