11-28-1984 SPECIAL MEETING OF THE CITY COUNCIL NOVEMBER 28 - 1984 The Schertz City Council convened in Special Workshop Session, ;1 Wednesday, November 28, 1984, at 7 00 p.m. in the Conference Room LJ of the Municipal Complex, 1400 Live Oak Road with the following members p_esent: Mayor Earl W. Sawyer, presiding; Charles B Sharpe; Ha~ Baldw~n; Ross Hoove~; Adolph Aguilar and Ken Greenwa~d. Staff present were City Manager Jimmy G. Gilmore and City Sec~etary June G. K~ause 11 HEARING OF RESIDENTS: None i2 D~scussion of an ordinance regulacing firea~ms. Mr G~lmo e exp....ained the need for such an ordinance stacing that .n the last six months there have been 50 to 60 incJ.dents for an approximate cost damage of $16,000 to $18,000 to windshields, windows, street lights, porch li9ht~, etc. Council discussed the proposed o~dinance, which mainly restriccs the buying, selling and possesion of various types of firearms for individuals under the age of 17 unless accompanied by a parent, legal guardian or responsible adult. Council eliminated article II and reworded Article III. The revised ordinance to be on the next agenda for consideration. i3 Discussion of an ordinance regulating excessive false alarms. ~ Council discussed the var ious fees charged by other cities and asked the City Manager to have more information on alarm systems available for the next workshop meeting. i4 EXECUTIVE SESSION. None needed is CITY MANAGER'S REPORT: A. Mr. Gilmore briefed Council on a new law requiring cities to acquire a sales tax number and pay sales tax on impoundment of vehicle charges. At present we charge $5, but the question arises as to whether we collect sufficient funds from this source to offset all the administrative time and costs of filing quarterly reports. Some alternatives are: increase the fee to $10 for each impoundment, hoping the increased revenues would make it worthwhile; or we could drop the impoundment fee (as the city of Live Oak did) and add an administrative fee of $10 to the towing fee charged by the carrier. After discussion, it was Council concensus to drop the impoundment fee and add on the administrative fee. B. A request was presented to Planning and Zoning for a second curb cut at 429 Sha.::on Court. P&Z recommends this request be disapproved because the applicant did not provide sufficient ~1'1' justification; and presently there are no other driveways on this side of Marilyn Drive (where the curb cut would be placed) and it ~ ., "'~i"~-M'~.jt.! ' !1':'~ .! c:,. U appears the roadway is narrower at this location. Placing a driveway at this location could be a traffic hazard since this r area of Mar ilyn is presently being used as a major through I street. This item to be on toe next regular agenda. C. the Northeast YMCA has initiated a Latch Key Service at elementary schools for after school care for young children until their parents get off work. Our school system has accepted this service. Council had no objection. r- D. The City received a thank you from the Community Education Advisory Council on behalf of the School District for the use of the Community Center for their recent garage sale. E. Mr. Gilmore gave out copies of a very good article that appeared in the Austin papers regarding development in our area. F. The Police Department has an applicant for Police Reserve they would like to present for consideration at the next meeting. Richard Wrenn has gone through the training necessary and also is an employee of the Water Department of the City. G. Northcliffe is creating problems again with the Fire Department and SAFES. The put out a newsletter giving emergency phone numbers of New Braunfels for fire and ambulance service. SAFES goes out and there is a New Braunfels ambulance already there. If the transport is to New Braunfels, they take it but if it is for San Antonio, they say SAFES take it. Northcliffe's new young fire chief works for the New Braunfels Fire Department but their Chief and City Manager were unaware of their services being dispatched to Northcliffe. There is a meeting being set up with the New Braunfels City Manager and Fire Chief and our City Manager and Fire Chief to try to work out some of the problems. H. Mr. Gilmore said he will be going to Austin Friday for a pre- hearing conference on Green Valley. r I. The new contractor on the 135 project has the first hole under 135 and should start today on the second one. If things go like they have been, he should be through by December 15th. We are having to take out the old pipe. J. Mr. Gilmore presented the Council's list of suggested names for Live Oak Road extension and FM 3009 for discussion. After consider ing all names, Council agreed on 'Schertz Parkway' for Live Oak Road but could not come to an agreement on a name for FM 3009. This to be discussed at another workshop meeting. #6 ITEMS BY COUNCIL: Mr. Hoover asked about the article in the newspaper where the ex-Chief of Police in Cibolo says he may sue the City of Schertz. Mr. Gilmore said that when Cibolo hired him, they had a teletype back-ground check run on him, which they have the right to do. He claims we gave the information out. He was also angry because when he worked at Cibolo, he says one of our officers called him "Grumpy". , '~ 76 Mr. Greenwald referred to a TML directive that said cities had to take out of their ordinances the requirement for developers to provide park areas. College Station took it all the way to the Supreme Court and won so maybe we should go back to TML and ask what now. Mr. Gilmore said he would run this through our"" attorney. Some of the developers say they do not mind giving parcels to fire departments, etc. as long as they have advance notice prior to plat finalization. o Mr. Greenwald stated that at the last CVADAC meeting, it was brought up that in the last session of Congress a bill was passed which states that anyone arrested for OWl had to take the Mortimer Filkins test. A member of their organization can give the test. Mr. Gilmore is to check this out. Mr. Greenwald asked staff to check out a big building being put up at the dump site on south FM 1518. Also check on the apparent junk yard being utilized behind True Performance. Mr. Sharpe had several announcements: (1) they finally got started on the United Way Drive and will be meeting to see how it comes out. Two of Schertz major contributors did not participate - the City and School District. (2) Thursday at 8:15 a.m. there wil_ be the Grand Opening of the new Wall-Mart store in Universal City. (3) December 6th is the Annual Christmas Tree Lighting sponsored by the Business Club. (4) 0 December 16th the Greater Randolph Area Chamber of Commerce is ' having their banquet at Woodlake. (5) Need to set the date of the Senior Citizen Day to include in the Texas Highways - the date to be May 11, 1985. Mr. Aguilar announced there will be a Corridor Meeting on December 14. 17 ITEMS BY MAYOR: Mayor Sawyer announced there will be an Open House at his home on December 15th for City Council, employees of Schertz and all volunteers. Mr. Baldwin asked if it would be appropriate to recognize the the Samuel Clemens football team and Coaches at the next meeting to congratulate them in being in the play-offs. Mayor Sawyer said he will be glad to present a proclamation. Mr. Sawyer also reminded everyone of Ray Corbett Day on December 11 at 9:00 a.m. Mayor Sawyer said he had discussed with Mr. Gilmore about getting on with annexation on 135 down, as we are getting surrounded by New Braunfels. Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Ross Hoover; Adolph Aguilar and Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. r- I After welcoming everyone to the meeting, Mayor Sawyer said he had a proclamation to present. He asked Coach Lehnhoff and Assistant Coach Tabola to come forward and read a proclamation which called for all citizens to commend and congratulate the Samuel Clemens High School football team for its outstanding 1984-85 season. The Buffaloes are the Distr ict l4-4A champions. Mr. Baldwin named some of the team's accompl ishments then Coack Lehnhoff presented the members of the team that were present. #1 PUBLIC HEARINGS: Mayor Sawyer turned the publ ic hear ings over to Mr. John Linebarger, Chairman of the Planning and Zoning Commission. Mr. Linebarger enumerated the three Zoning Changes being considered, stating the hearings are to receive comments from the public on each zoning change. After the hearings, the Planning and Zoning Commission has ten days in which to make a recommendation to the City Council for a decision. Mr. Linebarger said when each hearing has been identified, he will ask the citizens who wish to come forward, give their names and addresses and make their comments. ~
