REGULAR MEETING OF THE CITY COUNCIL
DECEMBER 18, 1984
The Schertz City Council convened in Regular Meeting, Tuesday,
December 18, 1984, at 7:00 p.m. in the Council Chambers, 1400
Live Oak Road, with the following members present: Mayor Earl W.
Sawyer, presiding; Mayor Pro Tern Charles B. Sharpe; Councilmen
Hal Baldwin; Ross Hoover; Adolph Aguilar and Ken Greenwald.
Staff were City Manager Jimmy G. Gilmore and City Secretary June
G. Krause.
#1 APPROVAL OF MINUTES: Mr. Baldwin asked for a correction
to the minutes of December 4, 1984. The first sentence of the
last paragraph on page 81 should correctly read: "Mr. Baldwin
asked if out of all the incidents were any apprehended and had to
be released due to the lack of an ordinance."
Mr. Baldwin also asked that a correction be made in the minutes
of November 28, 1984. Item #6 - the last sentence on page #75
should correctly read "He was also angry because when he worked
at Cibolo, he says one of our officers called him 'Gumby'."
Mr. Aguilar moved to accept as corrected the minutes of the
Special Meeting of November 14, 1984; the regular meeting of
November 20, 1984; the special meeting of November 28, 1984 and
the regular meeting of December 4, 1984. Mr. Baldwin seconded
the motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#2 HEARING OF RESIDENTS: Mr. Robert Arenas of 519 Exchange
Avenue addressed Council concerning a payment for a water bill
for which he was not credited. He claims to have dropped a water
bill stub and $35.50 in cash in the drop box on November 10th. A
Mr. Campos was with him and even suggested it unwise to put cash
in the drop box but Mr. Arenas said he had never had any problems
before so did it anyway.
Mr. Gilmore explained that Mrs. Austin had personnally checked
all bills that came in at that time and could find no stub or any
money. Our registers balanced out for days prior and after the
10th. Mrs. Austin then check again for the entire month of
November checking to be sure that a like amount was not
credited to another account, but to no avail.
Mayor Sawyer and Councilmembers advised that they would never pay
a bill in that manner with cash. Mr. Gilmore said that warnings
about putting cash in the box have been posted.

Mr. Sharpe recommended writing off this amount for Mr. Arenas but
with a warning that he should not put cash in the window box -
only pay with cash in person at the counter, where he could get a

receipted stub. Council concurred with Mr. Sharpe that this
should be written off. Mayor Sawyer warned that this is the
first and last write-off - that there will be no more.

#3 BVYA CONTRACT: Mr. Greenwald moved to recommend
approval of the BVYAcontract for 1985. Mr. Sharpe seconded the
motion, which carried as follows:
AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#4 BID AWARD: Mr. Gilmore said that regarding the bids
for Phase III of the City's computer system, the only bids
received were from Thomas Software Services, Inc. He recommended
for acceptance Bid "B" and that it be under a lease-purchase plan
which would allow the City to be under budget.
Mr. Greenwald moved to go with bid from Thomas Software Services,
Inc. for the "B" bid under lease-purchase for Phase III of our
computer system. Mr. Aguilar seconded the motion.
Mr. Sharpe said that the lease will cost the City about $4,000
more and asked if there is any way we could find the money to pay
it off now; or could this be paid off early without penalty.
Mr. Gilmore said that with Council permission he would work with D
TSSI for earlier payoff.
Mr. Greenwald amended his motion to include allowing the City
Manager to negotiate for early payoff. Mr. Aguilar seconded the
amended motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#5 ORDINANCE: Mayor Sawyer introduced and read the caption
of an ordinance regulating firearms as follows:
AN ORDINANCE
MAKING IT UNLAWFUL FOR ANY PERSON TO FIRE
ANY GUN THAT DISCHARGES A BULLET, PELLET OR
"BB" BY ANY MEANS; TO SELL, GIVE OR PLACE
IN THE POSSESSION OF ANY PERSON UNDER THE
AGE OF SEVENTEEN YEARS, ANY GUN WHICH
DISCHARGS A BULLET, PELLET, OR "BB" BY ANY
MEANS; TO SELL, GIVE OR PLACE IN POSSESSION
OF ANY PERSON UNDER THE AGE OF SEVENTEEN
YEARS A GUN CAPABLE OF DISCHARGING A
MISSILE BY MEANS OF ANY EXPLOSIVE CAP OR
CARTRIDGE OF ANY DESCRIPTION; AND PROVIDING
A PENALTY FOR VIOLATION THEREOF.

Mr. Baldwin moved to adopt this ordinance regulating firearms in
the City of Schertz. Mr. Greenwald seconded the motion which
carried as follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#6 MEETING DATES: Mayor Sawyer said that since the first
regular meeting in January would fall on New Year's day, Council
had discussed in workshop changing the regular meeting dates for
January to the 8th and 22nd.
Mr. Sharpe moved to move the regular meeting dates for the month
of January 1985 to January 8th and 22nd. Mr. Aguilar seconded
the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.

Received a letter from Mr. Notzon from the Alamo Area Council of
Governments confirming a telephone call saying they will support
the City in any manner we desire, regarding the Green Valley
aplication for funding. Mayor Barnard, who is President of the
Executive Committee of AACOG has informed our Mayor that he will
work in support of this matter also. They are sending letters to
funding agencies with recommendation for them to go back to the
committee who reviewed the request and then get back to the
Executive Committee.
The City had a police car damaged the day before. While helping
DPS with a multi-car accident on 135, the vehicle was parked off
the highway with all lights flashing and a car ran into our car.
Their insurance has contacted us and said they will bear the cost
of repairs.
In your packet is a letter from the Chamber of Commerce to Cable
TV people concerning their displeasure about being ignored by
Rogers Cablesystem. This is the same concern our city has and
other cities in the area are having.
Also a letter from TML regarding the Bingo Enabling Act and the
1% sales tax that is to be used for law enforcement. The
executive Director is asking for support to make sure this tax is
not taken away from cities.

As per Council instructions, Mr. Gilmore did contact Professional
Services and also obtained a copy of an agreement Universal City
has with these same people. The gentleman is a Certified
Sanitarian registered with the State of Texas to run sanitary
inspections of establishments. With UC, he inspects
approximately 65 food places for $9 per account or $9 per hour.
He will also do public nuisance, swimming pools, food poisoning,
foster homes, etc. on an on-call basis. The agreement with UC is
a monthly charge of $500 for the regular 65 establishment
inspections. He will close places down if necessary. Mr.
Gilmore said he feels now is the time for Schertz to start this
type of thing rather that wait until such time as we would have
to act hastily. This will require an ordinance or agreement on
our part. The man feels that since he does not live in the city
he can act without prejudice. More information will be available
at the next workshop.
#9 ITEMS BY COUNCIL: Mr. Sharpe asked if anything new is
available on the SAFES/Fire Department matter with Northcliffe.
Mr. Gilmore said a meeting was held with County Judge, Fire
Chief, EMS Director and New Braunfels outlining the problems we
have been having. Our Judge has written a letter with a copy to
us, designating SAFES as primary coverage for Northcliffe. He is
attempting to set up a meeting with citizens of Northcliffe to
try to get this solved.

Mr. Baldwin said he was unable to get the bid pr ice on the
vehicle decals he was waiting for but would get it the next day.

Mr. Baldwin also asked the status of the Cibolo water contract.
Mr. Gilmore said he had talked with Mayor Little and Richard
Harris this date. Richard Harris is sending the new contract to
their attorney and once they had an agreement, it will come back
to us for approval and then to their Council for approval. Also
Cibolo has agreed to go with a 1,000,000 gallon tank rather than
the 500,000 as originally planned.
Mr. Hoover said the animal shelter is looking better every day.
Mr. Gilmore said we hope to have another opening in January. We
. are now operating on emergency 24 hours a day.
Mr. Aguilar said he noticed there is always a truck trailer in
front of the Maverick Truck Lines on FM 78 parked the wrong way
with no reflectors or lights.
Mr. Aguilar also called attention to an article in the latest
Texas Town and Cities regarding Executive Sessions. We should
review this to be sure we are complying.
According to Mr. Aguilar, Mr. Scharpe was recognized at the
Chamber of Commerce Annual dinner for all he has done in the
communities and the Chamber.

Mr. Greenwald said BVYA will not be holding a basketball season
this year. They were unable to get parents or commissioners
interested.
#10 ITEMS BY MAYOR: Mayor Sawyer said in regards to his
remarks about Mr. Arenas getting a wr ite-off, he just does not
want people coming to Council and saying I dropped cash in the
box and expecting a write-off each time.
The Mayor then wished everyone a Merry Christmas and Happy New
Year, saying that all our citizens make this a better place to
live.
#11 ADJOURNMENT: Mr. Baldwin moved the meeting be
adjourned at 8:45 p.m., with the motion being duly seconded and
carried unanimously.
