REGULAR MEETING OF THE CITY COUNCIL
FEBRUARY 5, 1985
The Schertz City Council convened in Regular Session, Tuesday,
February 5, 1985, at 7:00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Live Oak Road with the following members
present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal
Baldwin; Ross Hoover, Adolph Aguilar and Ken Greenwald. Staff
present were City Manager Jimmy G. Gilmore and City Secretary
June G. Krause.
#1 APPROVAL OF MINUTES: Mr. Sharpe asked for an addition
to the minutes of January 22, Item #7, the third paragraph,
second sentence should read: "Mr. Tom Vandewalle is president,
with Mr. Shapre as Vice-President of the organizational
committee." There were also two typographical errors recorded.
Mr. Sharpe moved the minutes of the Special Meeting of January
16, 1985 and the Regular Meeting of January 22, 1985 be approved
as amended. Mr. Hoover seconded the motion, which carried with
the following vote:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None

#2 HEARING OF RESIDENTS: Mr. Merwin Willman said there is
a sign at the corner of Oak and Main Streets that needs to be
painted or removed.
#3 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, CALLING AN ELECTION TO BE HELD ON
APRIL 6, 1985, FOR THE PURPOSE OF ELECTING
THREE (3) COUNCILMEMBERS FOR SAID CITY.
Mr. Hoover moved to approve the first reading of an ordinance
calling an election on April 6, 1985, to elect Councilmembers for
Places 3, 4, and 5. Mr. Baldwin seconded the motion, which
carried as follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None

#4 ORDINANCE: Mayor Sawyer introduced an ordinance
creating a Health Department and defining the powers and duties
of a Health Inspector. Mr. Gilmore explained that the ordinance
was only a draft form and was given Council tonight in order for
them to study and discuss at the next workshop.
Mr. Greenwald moved to table discussion on an ordinance creating
a Health Department until it could be further studied. Mr.
Sharpe seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: NONE
#5 EXECUTIVE SESSION: None needed.
#6 CITY MANAGER'S REPORT: A. Mr. Gutierrez has submitted
a request to change the collection dates for Greenfield/Woodland
Oaks from Monday/Thursday to Tuesday/Friday. This will allow him
to better serve these customers. He would like this change to
take effect on the 14th of February; but Mr. Gilmore recommended
waiting until March.
Council discussed this request and decided it would require at
least a two weeks delay in order to properly notify the customers
involved. They recommended commencing the change on February
26th.
B. Mr. Gilmore gave Council an update on the vehicle sticker
identifications, outlining the different areas and colors to be
used for each area. He said we will need to get information in
papers and other ways to inform the public of the availability of
the stickers, the purpose for them and the placement on vehicles.
C. Mr. Gilmore will be talking with San Antonio Water Board
people this week to discuss water service south of our city - the
area as discussed on television the last few days. The residents
of the area have approached us to obtain water and were told that
they would have to get a release from San Antonio before we could
talk to them since they are not in our PUC certified area. Mr.
Gilmore said after he talked with the San Antonio Water Board
people he would discuss it with our attorney for clearance.
#7 ITEMS BY COUNCIL: Mr. Aguilar reported the Library
Board met and are getting ready for their annual dance and
auction, which will be held on February 23rd. Mr. Gilmore said
we have some abandoned bicycles that can be passed on to the
Library for auction if they are agreeable.
Mr. Hoover asked how it would affect our budget if we lost our
Revenue Sharing funds. Mr. Gilmore said it would decrease the
budget by about $48,000; but since he has been here, we have not
used this money for operational budget items - only capital
equipment. We have never put it in the operational items.

Mr. Baldwin said a resident of Beck Street asked if a 'Dead End'
sign could be put at the entrance of Beck Street. There is a lot
of turn-around traffic on that street.
Mr. Aguilar also mentioned if it would be possible to put a 'No
Parking' sign at the entrance to Greenfield. Mr. Gilmore said
this is a little different as the truck mentioned was parked on
pr i vate property. True, the owner was contacted and does not
want parking there, but can the City enforce no parking on
private property. Mr. Harris said that might be a Justice of the
Peace matter.
Mayor Sawyer asked that street sign changes be discussed at the
next workshop.
Mr. Baldwin asked if the City had received any information on the
renaming of FM 3009. Mr. Gilmore said he has asked the librarian
to gather the information for him.
Mr. Sharpe said he attended a meeting of the Edwards Water
District and they approved a request from Green Valley Water
Supply Co. to pump an additional 1,232 acre-feet of water each
year. Mr. Sharpe said he asked them to defer a decision but they
did approve the request.

Mr. Sharpe annoucned meetings as follows: organizational meeting
of the Economic Development committee for 7:30 p.m. at the
Republic Bank in Universal City Thursday; Friday at 10:00 a.m.
at the Officer Club the Austin-San Antonio Corridor Council will
meet.
Mr. Sharpe said he noticed some lights on in the old house on
FM3009 - the Froebese property. Mr. Gilmore said Mr. Froebese
has been contacted to come in.
Mr. Gilmore said regarding the old house on Main Street, we
should hear something in about a week and that he will check with
Mr. Harris about condemnation or using police powers to remove as
a nuisance.
The work shack is still on the property at the entrance of
Woodland Oaks, and Mr. Sharpe understood it was to be removed in
December. Mr. Gilmore said the owner has been contacted.
Mr. Sharpe asked that the item of mail delivery service on 135 be
added to the Bell Ringer list. We need to follow up on this now
by sending a letter to the San Antonio Post Office so that when
they are changing routes due to expansion, this can be included.
r Mr. Sharpe shared an article from the San Antonio newspapers
1 about Sea World, in which a Florida County Commissioners
! expressed some concerns they wished they had addressed in the

beginning. This called attention to the need to proceed with all
speed on the overlay district the City is working on at present.
Mr. Baldwin asked the City Secretary to make reservations for him
and Mr. Sharpe for the TML Legislative Seminar in Austin on
February 11th.
#8 ITEMS BY MAYOR: Mr. Sawyer had received a letter
praising the police chief and officers for the solving a burglary
at the Kvapil residence.
Mr. Harris asked Council to monitor the TML legislative reports.
There is some bill going to be introduced affecting the Open
Meetings Law, making it more stringent. They want to do away
with the part allowing for emergency items to be placed on an
agenda with 2 hours notice.
#9 ADJOURNMENT: On a motion by Mr. Sharpe, seconded by Mr.
Baldwin, and unanimously carried, the meeting was declared
adjourned at 7:40 p.m..
