SPECIAL MEETING OF THE CITY COUNCIL
FEBRUARY 13, 1985
The Schertz City Council convened in Special workshop Session,
Wednesday, February 13, 1985, at 7:00 p.m. in the Conference Room
of the Municipal Complex, 1400 Live Oak Road. The following
members were present: Mayor Earl W. Sawyer, presiding; Charles
B. Sharpe; Hal Baldwin; Ross Hoover; Adolph Aguilar and Ken
Greenwald. Staff present were City Manager Jimmy G. Gilmore and
City Secretary June G. Krause.
#1 HEARING OF RESIDENTS: None
#2 Developers to meet with Council to discuss possible
annexation, zoning and waste water facilities on proposed
development on IH 35 and Schwab Road.
Mr. Gilmore introduced Mr. Stan Forbes, and Mr. Paul Brown as
developers who have approached the City with a project they are
planning and would like to discuss it with Council.
Mr. Forbes described he and Mr. Brown as speculators. After they
retired from Ford Motor Company, they got together and started
looking for land to buy and develop. He described some of their
developments in North Richland Hills and Allen, Texas, saying
they have become part of those communities. They became
r- interested in this area because of the National coverage the 135
) Corridor has been generating. They plan to close the deal on the
property at Schwab Road and 135 on Friday and want to develop it
in the best interests of the Cor ridor. Mr. Forbes said they
would 1 ike to be annexed and have the property rezoned to an
industr ial type of class if icat ion to include showroom type of
businesses. Probably the toughest problem would be sewer. That
would be essential to attract the type of clients wanted. It
would be best to install a 24 inch sewer line that could take
care of any future development. Mr. Forbes said they did not
plan to put in the sewer themselves but would pay their share on
a sewer line along the Corridor.
Mr. Gilmore said it was his impression that the area is planned
for this type of zoning. Council agreed that was their intent.
Also it has been Council intent to annex in this area as soon as
feasible.
Mr. Forbes said this property consists of 200 acres but they plan
to acquire additional acreage also. They want to take advantage
of the railroad at the back of the property as well as the 135
frontage, and encourage the rest of the area to be developed in
the same manner - the way to get that is to have sewer available
without MUDs.
:- Mr. Sharpe said Council has to look at the best options to get
sewer and the best time - not piecemeal for one property. He
said Mr. Gilmore has contacted Guadalupe-Blanco River Authority

and would contact Cibilo Creek Municipal Authority. Mr. Gilmore
said that GBRA would release their certification if we need them
to. Also another option would be utilizing the plant of GUADCO
MUD #1. Mr. Gilmore said he felt it a solvable problem but the
time factor is the big issue.

Mr. Forbes complimented Council on their planning for water.
Mayor Sawyer thanked the gentlemen for coming and welcomed them
to our city.
Mayor Sawyer called a short recess at 7:40 p.m.
The Special Meeting was reconvened at 7:53 p.m.
#3 JOINT MEETING WITH CIBOLO CITY COUNCIL: Mayor Sawyer
welcomed the Mayor and Council from Cibolo and said Council would
like to discuss a water amusement park on 135.
Mr. Gilmore said the area in question was on either side of
Wieder stein Road - part in Cibolo's ETJ and part in Schertz. We
don't know exactly what is going in at this time.
Mayor Sawyer said Council thought it would be a good idea to get
together and iron out some of the potential areas of conflict on
water and sewer and other items. We need to come to an agreement

Mayor Little said their city limits is close to the are in
question and they are already talking about annexing this
property. He agreed that the two Councils should talk out the
various problems that could arise. This would be very important
to both cities. Mayor Little said he had discussed with Council
about taking two people from each Council and two from each
Planning and Zoning Commission and see if they could work
together along these lines. He said he had made it clear to a
developer today that the two cities want to work in unity with
each other. Mayor Little said he will sign the water contract
with Schertz Tuesday night.
It was agreed that this group should work on all common areas and
borders.
Mayor Sawyer said we will wait for Cibolo to send the names of
their representatives from Council and Planning and Zoning and he
will appoint four and they can get together with Mr. Gilmore and
organize, name a Chairman, etc..
The Councils then discussed some of the animal problems that had
occurred, with Mayor Little saying they would be signing the D(!
contract immediately upon receipt of another copy - he had
misplaced the first one.

Also discussed were the legislative reports recently received and
how some of them would affect cities; and the necessity of
contacting our representatives about our concerns.
Mayor Sawyer called for a recess at 8:21 p.m.
The Special Meeting was reconvened at 8:40 p.m.
Mayor Sawyer suggested Mr. Greenwald be appointed a member of the
group just discussed with Cibolo, as Mr. Greenwald works very
closely with the Planning and Zoning Commission. Mr. Sharpe also
volunteered to represent Schertz.
#4 Discussion of Health Department/Health Inspector
ordinance.
Council discussed the proposed ordinance and the type of forms to
be used for inspections. The Sanitarian is to furnish a sample
that he feels he can work with and the Council will accept.
Council also discussed license fees and asked this be on the next
workshop for further discussion.

#5 Discussion of changes to Traffic Code ordinance.
The two streets mentioned that need "Dead End" signs are Beck
Street and Zuehl Road. Mr. Aguilar - asked about putt ing "No
Parking" signs on entrances to developments. Mr. Gilmore was to
check this for legality.
Mr. Greenwald said that some months back Planning and zoning had
suggestions, including (1) no u-turn on Main Street (2) no u-turn
at the island by the post office and (3) no parking on one side
of Colony.
Mayor Sawyer asked Mr. Greenwald to bring this up at P&Z and see
if they have any additional items for this ordinance. This will
be discussed again at the next workshop meeting. Council to be
furnished with a copy of the ordinance with all amendments.
#6 EXECUTIVE SESSION: Mayor Sawyer called an executive
session under Article 6252-17, V.T.C.S., Section 2(g) Personnel
at 9:31 p.m.
The Special Meeting was reconvened at 9:53 p.m.
#7 CITY MANAGER'S REPORT: (1) Bids were opened today for
a Backhoe/tractor/loader. Bids were received from KCR - Boerne,
in the amount of $23,000; Ewald Ford Tractor-Seguin, in the
amount of $23,740; Kuenstler Machinery-San Antonio, in the amount
of $23,564. Kuenstler also submitted an alternate bid for
r- $26,406. This is a budgeted item and we are recommending
accepting the low bid from KCR.

(2) We have an emergency situation with a sewer line on Oak
Street near the park. The sewer is backing up in the manhole and
could possibly back up in homes in the area. We have tried
everything to correct it but now have to have someone come in and
fix it. We have gone out for bids and it will cost about $6200.
Council concensus was that the City Manager be authorized to
expend money for this sewer line.

(3) Received a copy of Cibolo's notice that they are going to be
fighting Green Valley.
#8 ITEMS BY COUNCIL: Mr. Greenwald asked if the City got a
copy of BVYA' s financial report. Mr. Gilmore said we did and
copies would be made for Council.
Mr. Greenwald advised that something needs to be done quickly
about the lighting at the A-3 ballfield. We are no longer able
to obtain bulbs for the system in use now and wires are all above
ground and in bad shape. We almost had a bad accident with this
wiring two years ago. We got some bids and one is for $5700 - it
will use the existing poles, put wiring underground and use the
same voltage that will make it compatible with the other fields.
We can get bulbs anywhere for this field then. One company gave
a proposal of $12,000. Council discussed spending this money now
and then in a year or two turning the field and spending more
money on it.

Mr. Baldwin reported on a TML Legislative meeting h,e and Mr.
Sharpe attended, saying it was an excellent meeting. He
mentioned several proposed bills that he considered bad
legislation.
Mr. Baldwin advised that a gentleman said at the last GUADCO
meeting, they discussed a water rate increase that they have to
pass on to their customers. Is there a rate change in the new
contract with Cibolo? Mr. Greenwald said apparently they are
talking about the rate change several months ago. The contract
says they will pay the prevailing rate.
Mr. Hoover said the reason he did not want to go with the
contract with Cibolo on Animal Control was because he wanted to
be sure that we have our feet on the ground first and he is not
sure we do at this time.
Mr. Baldwin expressed his opinion that our shelter is not large
enough for our own town and we should wait until it can be 0
enlarged before extending a contract to Cibolo. \

Mr. Sharpe had several items for discussion: (1) the San
Antonio-Austin Corridor is sending out notices of contributions
r- and he believes it will be $750 for this year. Council agreed we
should continue to support this and money is in the budget.

(2)there will be a Transportation Task Force meeting this coming
Friday at 8:30 a.m. at the Capitol Area Council of Governments.
(3) did the City get a completion date on the East Live Oak Road
contract. Mr. Gilmore said bids have been let, fences have been
moved, etc. but we have not seen the contract.
(4) we need to get a copy of the January 8th and February 5th
Edwards Acquifer meetings for our files.
Mr. Aguilar - (1) the 23rd of February is the date for the
Library/Humane Society dance and auction.
(2) he said it bothers him that there is nothing the City can do
about the trailers in front of Maverick Trucking.
Mr. Sharpe said Mr. Kuempel would like to meet with our Council.
He suggested inviting him down. Mayor Sawyer said he would
invite him to any of our meetings.
#9 ITEMS BY MAYOR: Mr. Sawyer said we are continuing to
lose good police officers. Mr. Cervantes left to go to Universal
City - he was one of the best officers we have had. The other
was Jim Wells. Both were extremely good officers. He said he
sure hates to see good men leave the city for money.
Mayor Sawyer said he has been invited to make a speach at
Southwest Texas State University in San Marcos. The subject is
'Problems in small cities on the Corridor'. He said he will
discuss problems with FM 78, water, postal department, the
problem of cities adjacent to one another in cooperation. He
asked if Council had any further input for him. Mr. Sawyer said
they have invited 11 or 12 Mayors from the Corridor to give short
speaches on March 5th.
Mrs. Hoover has invited the Mayor and City Council to a Cub Scout
Blue and Gold Banquet on February 23rd at the Elementary School
Cafeteria.
#10 ADJOURNMENT: There being no further business to come
before Council the meeting was declared adjourned at 11:00 p.m.
