REGULAR SESSION OF THE CITY COUNCIL
FEBRUARY' 19, 1985

The Schertz City Council convened in Regular Session, Tuesday,
February 19, 1985, at 7:00 p.m. in the Council Chambers, 1400
Live Oak Road with the following members present: Mayor Earl W.
Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Ross Hoover;
Adolph Aguilar and Ken Greenwald. Staff present were City
Manager Jimmy G. Gilmore and City Secretary June G. Krause.
#1 APPROVAL OF MINUTES: Mr. Aguilar asked that a
correction be made to item #7 of the minutes of the regular
meeting of February 5, 1985, the seventh paragraph on page 107,
the second sentence to be corrected to read "Mr. Gilmore said Mr.
Froebese has been contacted to visit the Administrative offices."
Mr. Aguilar moved to accept the minutes of the Regular Meeting of
February 5, 1985 as corrected. Mr. Hoover seconded the motion,
which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#2 HEARING OF RESIDENTS: Mr. Willman pointed out that
there is a sign by the Cibolo Creek at FM 78 saying "fill dirt
wanted" and there is a possibility they would be filling in the

creek and causing flooding. Mayor Sawyer said that although the
area is out of our city limits, it will be checked out.
Mr. Ty Brisgill, a new resident of Woodland Oaks Subdivision,
asked if the city has any control over street lighting. He said
that in some places the street lights are fifty feet apart and
others it is over 200 feet between lights. Mr. Gilmore explained
that when the subdivison plat was submitted, the developers had
indicated street lights in certain locations. However, if Mr.
Brisgill ,feels there are not enough lights, he was asked to
contact Mr. Gilmore and he would go back to the subdivider or go
through our electric cooperative to see what could be done.
#3 BID AWARD: Mayor Sawyer said bids were received from
KCR Equipment Co. -in Boerne - $23,000/with trade; Ewald Ford
Tractor in Seguin - $23, 740/with trade; Kuenstler Machinery in
San Antonio - $23,564/with trade; and another from Kuenstler
Machiners for a different Tractor/Loader/Backhoe in the amount of
$26,406/with trade. Mr. Gilmore said the Department Supervisor
has recommended awarding to the low bidder.
Mr. Sharpe moved to accept the bid of KCR Equipment Company of
Boerne, in the amount of $23,000 for the Tractor/Loader/Backhoe.
Mr. Greenwald seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.

NAYS:

#4 TRANSFER OF APPROPRIATIONS: Mr. Gilmore said there are
s~veral changes, most of them budgetary and submitted his list of
recommended transfers.

After brief discussion, Mr. Greenwald moved to approve the
transfer of appropriations in accordance with Section 7.07(c) of
the City Charter, as submitted by the City Manager. Mr. Sharpe
seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#5 ORDINANCE: The Mayor introduced an ordinance amending
the Zonign Ordinance and read the caption as follows:,
AN 'ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING THE ZONING ORDINANCE NO. 79-
S-15 OF THE CITY OF SCHERTZ, TEXAS, IN
ACCORDANCE WITH ARTICLE XIX, SECTION 2 - 2.1.
OF ORDINANCE 79-S-15, WHICH AUTHORIZES THE
CITY COUNCIL TO, FROM TIME TO TI,ME, AMEND,
SUPPLEMENT, CHANGE, MODIFY OR REPEAL THE
REGULATION STANDARDS AND BOUNDARIES OF THE
CITED ORDIANCE; THE AMENDMENT TO ADD SPECIAL
OVERLAY DISTRICTS.

Mr. Greenwald moved to approve the first reading of an ordinance
amending the zoning ordinance by adding Section 3 to Article
XVI Special Overlay Districts. Mr. Aguilar seconded the
motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#6 EXECUTIVE SESSION: None needed.
#7 CITY MANAGER'S REPORT: A. Buffalo Valley Youth
Association has submitted their annual financial report for 1984.
B. You were furnished copies of the TML Legislative Report in
which they give summaries of legislation pending. We have
discussed some of these that need to be watched. We also need to
contact our legislators to let them know our feelings on these
proposed bills.
C. The trip to Sealy to view the solid waste plant has been D~
canceled until a later date, possibly the latter part of March.

D. As discussed at Workshop, Mr. Gilmore has been in contact
r- with Guadalupe-Blanco River Authority to discuss the possibility
of a sewer plant in the northern part of our city. Also he
talked with Cibolo Creek Municipal Authority and has scheduled a
meeting with GUADCO #1, who has a plant in operation now.

E. There was a meeting today including a group of citizens that
had approached San Antonio for water. San Antonio came to us and
asked if we could furnish water to them. The meeting was to tell
them approximate costs to them. We asked that they have a
spokesperson to represent them rather than working with 20 to 30
people. The citizens of this area would have to pay for this
water system themselves and the system would have to meet City of
San Antonio standards. If San Antonio moves out, the line will
be turned over to them at appropriate costs.
#8 ITEMS BY COUNCIL:
Mr. Sharpe reported on the Corridor Transportation Meeting in
Austin. One of the item discussed was a bill to transfer $30
million a year from the Highway Department to the Department of
Public Safety. This would mean taking it out of road building to
support public safety. There are many roads that need to be
built or rebuilt in the State but you have to have a long lead
time. The purpose of this tax was to rebuild roads in Texas.
Mr. Baldwin asked the status of the renaming of FM 3009. Mr.
Gilmore said he had located the information on Jack Hays and the
Texas Rangers are in favor of using the name. The renaming could
be included in some of the Sesquicentennial ceremonies.
Mr. Hoover thanked Mr. Brisgill for coming to the meeting and
invited him to some of the workshop meetings.
Mr. Aguilar announced a dance and auction Saturday night at the
Community Center sponsored by the Library and Humane Society.
Mr. Kuempel will be one of the auctioneers.
Mr. Greenwald announced that SAFES would be having a raffle
Sunday at the VFW from 3 to 7 p.m. with various Country Western
band s .
#9 ITEMS BY MAYOR: Mayor Sawyer listed some of the pending
legislation that he felt would be most detrimental to cities.
Mr. Sawyer read a letter of Agreement between the cities of
Schertz and Cibolo on Animal Control Facilities. This is the one
Council agreed on and sent to Cibolo to be signed.
Mayor Sawyer announced there would be three local activities
Saturday night, February 23rd: (1) the Blue & Gold banquet for
the Cub Scouts (2) Senior Citizen 10th Anniversary celebration
and (3) the Library/Humane Society dance and auction.

Also the Cibolo Valley Jaycees will be approaching the Council on
a matter very soon.
