3-19-1985 136 \ REGULAR MEETING OF THE CITY COUNCIL MARCH 19, 1985 The Schertz City Council convened in Regular Session, Tuesday, March 19, 1985, at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Live Oak Road. The following members were present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Ross Hoover; Adolph Aguilar and Ken Greenwald. Staff were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. o #1 APPROVAL OF MINUTES: Mr. Aguilar requested that the fourth paragraph of item #9 of the minutes of March 5, 1985 be corrected to read as follows: "Mr. Aguilar reported on a trip to Austin for a meeting for librarians, who were briefed on legislative activities and procedures. It was a very interesting and educational meeting." Mr. Aguilar moved to approve the minutes of the Special Meeting of February 27, 1985 and the Regular Meeting of March 5, 1985 as corrected. Mr. Baldwin seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None #2 HEARING OF RESIDENTS: Guadalupe County Judge James 0 Sagebiel reported on the Alamo Area Housing Finance Corpor.ation, . saying they have an allocation of $37,690,000. However, if do not have participation of local lending institutions, the allocation is in jeopardy. Judge Sagebiel said they have until April 12 to get sufficient local lenders committed or they would lose the money. NAYS: None #4 ORDINANCE: Mayor Sawyer introduced and read the caption of an ordinance as follows: ORDINANCE NO. 85-H-3 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CREATING THE DEPARTMENT OF HEALTH FOR THE CITY OF SCHERTZ AND DEFINING THE POWERS AND DUTIES THEREOF. Mr. Aguilar moved to approve the final consideration of an ordinance creating a Department of Health. Mr. Baldwin seconded the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None #5 CONTRACT: On the recommendation of the City Manager, Mr. Greenwald moved to table the Sanitarian contract consideration until the next workshop meeting. Mr. Baldwin seconded the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None #6 ORDINANCE: The Mayor introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE (ORDINANCE NO. 79-S-15) OF THE CITY OF SCHERTZ; ESTABLISHING AUTHORIZED ZONING DISTRICTS FOR A 127 ACRE PARCEL OF LAND OUT OF THE MALPAZ SURVEY NO. 67 FROM PD, PRE.... DEVELOPMENT DISTRICT; AND REFLECTING SAID CHANGES ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ ZONING ORDINANCE NO. 79-S- 15. Mr. Baldwin moved to accept the first reading of an ordinance amending the traffic ordinance. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None #8 ORDINANCE: Mayor Sawyer introduced and read the caption on an ordinance as follows: o AN ORDINANCE PROVIDING DEFINITIONS, REQUIRING A PERMIT OF ALARM SYSTEM USERS; PROVIDING SERVICE CHARGES FOR FALSE ALRAMS; PROVIDING FOR PROTECTION OF FINANCIAL INSTITUTIONS; . PROVIDING FOR A PENALTY; PROVIDING FOR A SEVERABILITY CLAUSE. Mr. Greenwald moved to approve the first reading of an ordinance regulating false alarms. Mr. Hoover seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None #9 RESOLUTION: Mayor Sawyer introduced a resolution suspending the proposed rate schedules filed by Entex, Inc. and said that in view of new information he had received he would like for this item to be tabled at this time. NAYS: None #10 RESOLUTION: Mayor Sawyer introduced a resolution and read the caption as follows: RESOLUTION NO. 85-R-2 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, DESIGNATING FM 3009 AS JACK HAYS BOULEVARD. Mr. Sharpe suggested the resolution be expanded to spell out who Jack Hays is and why we are changing the name. He said we also need to include signing on FM 78. Mr. Greenwald moved to approve a resolution designating FM 3009 as Jack Hays Boulevard, as expanded. Mr. Baldwin seconded the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None r- #11 RESOLUTION: The Mayor introduced a resolution and read I I the caption as follows: I RESOLUTION NO. 85-R-3 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, SUPPORTING THE RECOGNITION OF THE TEXAS MUNICIPAL CLERKS CERTIFICATION PROGRAM. Mr. Sharpe moved to approve the resolution in recognition of the Municipal Clerks Certification Program. Mr. Greenwald seconded the motion, which carried with the followng vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None #12 EXECUTIVE SESSION: None needed. #13 CITY MANAGER'S REPORT: A. Planning & Zoning has recommended a Special Overlay District for Jack Hays Boulevard go to public hearing. Mr. Gilmore said he would like to have a public meeting on the 28th to discuss the overlay and then on April 16th hold the public hearing. ~ B. Our auditors will present the audit at the next workshop for L discussion. The City Manager said that because it is audit time ~ 140 he had gone back and pulled out information on some of the good things that has happened in the City. In 1980, we earned $12,512 in interest and in 1984, we earned $186,177. In 1980 the sewer income was 34% of the budget and expense was 39%, while in 1984, the income was 33% with the expense being only 25%. In 1980-81 Ad Valorum taxes supported 43% of the general fund budget and in 1984-85 only 37%. In 1979 we had no Capital Improvement Funds and in 1985 we have $350,000. Since 1979 the City has purchased two new firetrucks costing approximately $210,000 that cost the City only $35,000. We have a new library building and furniture that cost approximately $130,000 but the cost to the City was zero. We have a new animal shelter facility with the cost of land and facilities being only $16,00Q. SAFES is now self- sufficient. We have a new sewer line from Maske Road to North side of I35 which cost $1,000,000 but the cost to the City was $20,000 cash and $18,000 debt write off. We purchased a new water storage site on IH 35 - the land value on some plats is $16-20,000 per acre but we paid $9,000 for one acre. We have incorporated the Schaefer Road Water system into the City system. The reconstruction of East Live Oak Road will cost $165,000 but the cost to the City will be less than $10,000. So you see we are doing good. \ \ o I C. Have a memo from the Inspection Department that they are getting with some contractors for the demolition of the house on Main Street. #14 ITEMS BY COUNCIL: Mr. Sharpe: A. represented the 0 Mayor at a tree planting ceremony this date on Kitty Hawk. It is a very nice development. B. Have had two meetings of the Schertz-Cibolo Planning Committee. Are looking at a master drainage plan within the area. Also have discussed changing of property on ETJ's between the two cities. C. Mr. Sharpe handed out a list of words that the City Manager might consider using in his next annual report. Mr. Baldwin said that Superintendent Steele is very interested in the field trip that was discussed at the last meeting. Mayor Sawyer said it might be well to invite the newspaper reporter to go along on this trip. Mr. Aguilar reminded Council of the Book Sale the Library is sponsoring this coming weekend from Friday through Sunday. Also there will be a meeting of the Corridor Committe Friday from 2:00 p.m. to 5:00 p.m at New Braunfels. Mr. Greenwald: A. Suggest that at the public hearing on the Jack Hays Boulevard overlay, we invite Cibolo City Council and 0 Planning and Zoning Committee and all citizens. :jl/;ilb~~ I ! r ~ 141 B. The next meeting of this Joint Planning committee will be April 15th at 7:00 p.m. at Schertz Municipal Offices.
