SPECIAL MEETING OF THE CITY COUNCIL
APRIL 10, 1985
The Schertz City Council convened in Special Workshop Session,
Wednesday, April 10, 1985, at 7:00 p.m. in the Conference Room of
the Municipal Complex, 1400 Live Oak Road. The following members
were present: Mayor Earl W. Sawyer, presiding; Charles B.
Sharpe; Hal Baldwin, Adolph Aguilar and Ken Greenwald. Absent:
Ross Hoover. Staff were City Manager Jimmy G. Gilmore and City
Secretary June G. Krause.
il HEARING OF RESIDENTS: Mr. Bindseil asked about the
drainage being planned for East Live Oak Road. He said it did
not seem to him that the pipes they have put along the road will
,be big enough to handle the rains. Mr. Gilmore said that the
Highway Department did the engineering and it is their project.
They did talk with our engineer.
Mr. Brisgill of Woodland Oaks Subdivision asked what procedures
he should go through in order to get more street light in his
subdivision. He said there have been some prowlers out there and
more lights would help. Mr. Gilmore said he would have our
inspector check on this. If what is there meets our subdivision
ordinance, all we can do is ask but if the lights do not meet
ordinance, then we can demand more lights.

i2 BALLOT COUNT: Mayor Sawyer presented the City
Secretary's count of ballots used at Absentee voting, as well as
at the polls as follows: Ballots 1 through 29 were used for
Absentee voting; ballots 30 through 1500 were used at the polling
place on election day.
Mr. Sharpe moved to approve the ballot count as submitted by the
City Secretary. Mr. Greenwald seconded the motion, which carried
with the following vote:
AYES: Councilmen Sharpe, Baldwin, Aguilar and Greenwald
NAYS: None
i3 ORDINANCE: Mayor Sawyer introduced an ordinance
canvassing the returns and declaring the results of the City
Officer Election and read the captiori as follows:

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, CANVASSING THE RETURNS AND
DECLARING THE RESULTS OF THE C.ITY OFFICER
ELECTION HELD IN SAID CITY ON THE 6TH DAY OF
APRIL 1985, AND DECLARING AN EMERGENCY.
r Council then proceeded to canvass the returns, finding that in
Place 3 Mr. Raymond Stanhope received the plurality of votes
cast; and in Pl ace 4 Mr. Aguilar received the plurality of

votes cast and in Place 5, Mr. Ken Greenwald received a plurality
of votes cast.
Mr. Baldwin moved to accept the returns as presented and approve
passage of the ordinance. Mr. Sharpe seconded the motion, which
carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Aguilar and Greenwald
NAYS: None
.4 SWEARING IN CEREMONIES: Mayor Sawyer then swore into
office Mr. Stanhope, Place 3 ; Mr. Aguilar, Place 4; and Mr.
Greenwald, Place 5.
Mr. Stanhope then took his seat on the City Council of Schertz.
.5 Discussion of Mayor Pro Tem: Mayor Sawyer reminded
Council that according to our Charter, the Mayor Pro Tem has to
change every year. Also that the person named will have to
attend daytime events in his place, as it is not always possible
for him to take off work during the day time. Council
tentatively agreed that Mr. Baldwin would be their choice for the
new Mayor Pro Tem.
.6 RESOLUTION: Mayor Sawyer introduced a resolution for
discussion that would support additional low-rent elderly housing
in the Randolph Region.
Mr. Gilmore said the Housing Authority staff approached him
saying there is a possibility of money coming available for
additional housing for the elderly. They would like for Council
to go along with their application for this money.
Mr. Aguilar asked if they are going to ask for
cities since this is for the Randolph Region.

looking at the Beck property next to them. They are one of the
few Housing Authorities in the United States that operate in the
black, which is unusual for a Housing Authority.
.7 Discussion of an ordinance amending Chapter 7 of the
Code of Ordinances providing for the office of fire chief and
fire marshal and their duties.
Mr. Gilmore said we have had problems in the past when the fire
marshal would go off on his own regardless of the needs of the
fire chief. This created morale problems as well as work
problems. Normally the fire marshal does fit in under the fire
chief. With Mr. Rusch retiring as fire marshal, we have the
oportunity now to make this change without causing problems
within the fire department. .

Mayor Sawyer said we are giving the fire chief the authority that
he has got to have.
i8 Discussion of an ordinance amending the Building Code by
eliminating the use of wood shingles and shakes.
Council were in agreement with the section prohibiting wood
shingles and shakes; however they asked that the section on the
requirement for smokeproof enclosures for structures of three
stories or higher be revised to read more clearly.

#10 CITY MANAGER'S REPORT: Mr. Gilmore gave
of a legal opinion of our billboard ordinance.

A. Our Deputy City Secretary will be going in the hospital and
will be gone from the office for quite some time. Mr. Gilmore
asked if Council would appoint Sylvia Taylor as temporary Deputy
City Secretary. Mayor Sawyer said only the City Secretary and
City Manager worked for Council and any other was under the City
Manager and he should make that appointment.

r- B. Mr. Place has resigned from the Housing Authority Board so
i they will be coming to the City with recommendations for
replacement.
C. Mr. Gilmore presented a proposed news release for the Spring
Cleanup.
D. Had a note from the Highway Department regarding the naming
of Jack Hays Boulevard. They sent copies of correspondence
referring to signing of Natural Brideg. Caverns Road, including a
Guadalupe -County Commissioner's Court order that F .M. ..3009 be
designated Natural Bridge.CaversRoad.

E. Regarding bonds and what it would cost in increased taxes for
General Obligation bonds, assuming that the assessed value will
increase at the rate of 6% per year and that the percentage of
collected taxes remains at 98%, $1.5 million issue matur ing in
fifteen years would. necessitate an increase of eight cents -the
rate would go to 52 cents, this at ten percent interest. A $1.5
million issue, maturing in twenty years and based on same
assumptions, would require a six cent increase to 50 cents. the
15 year bonds would cost $1,400,000 in interest and the 20 year
bonds would be $2,133,000 in interest.
The Bond money we have on hand is obligated Water and Sewer funds
and .cannot be spent on anything else. We have drainage and
water/Sewer construction funds, that by vote of Council can be
changed; however by having this obligated, it will help on our
rating if we go out for additional bonds.

Mr. Gilmore was requested to bring this up at the next workshop.

F. We have bid tabulation on the vehicle, showing Mission
Chevrolet as the low bidder. We mailed out to 21 dealers and
only received 5 bids. Mr. Gilmore said he had no preference.
G. As a.result of the community meeting Monday night on the Jack
Hays Boulvard overlay, Mr ..' Naylor's l'epresentative was
apprehensive that the City was going to make him change plans of
things that has already been approved. He gave staff a set of
their covenants and they are more strict than our overlay. Mr.
Naylor has asked if the Mayor can sign a letter saying that they
do not have to make the changes.
.11 ITEMS BY COUNCIL~ ,Mr. Stanhope asked if the Mayor
could send a letter to' the Southern Pacif ic Railroad .Company
asking them to paint the bridge over the Cibolo Creek.
Mr. Aguilar asked if staff would also ask the Railroad company
about a sign in their right-of-way on FM 78 between First Street
and the creek on the north side, that obstructs the view of the
bridge when making a turn off FM 78 onto First Street north.
Mayor Sawyer said this could also be brought up at the Traffic
Safety.Council.
Mr. Aguilar said he enjoyed the Monday luncheon for Mr.
Bustamante.

Mr. Sharpe: A. he noticed on the Guadalupe County Commissioners
Court agenda an item about setting up a tax office in Schertz.
Mr. Gilmore said we have had nothing on it as yet.

B. mentioned the trailer at San Antonio Waste. Staff now has a
letter requesting a varian~e for a doublewide trailer to be used
as an office building. Mr. Gilmore asked how we can turn it
down, especially if he takes the wheels off - it then becomes a
modular building. The only thing is that he has violated the
ordinance by doing it first and then coming in for a permit.
C. Monday at 7:00 p.m the Schertz-CiboloCoordinating Group will
meet and they have asked CCMA to be there to discuss drainage.
Mr. Gilmore discussed some proposed plans for sewage treatment
for the northeast sector.
D. We had talked about a newsletter insert for the weekly paper
but need to get prices to see if it is feasible.
E. Have we found out anything from GVEC about the waiving of the
$500 lot fee to developers. Mr. Gilmore said they do not admit
it but developers say it is true. . Mr. Sharpe suggested inviting 01
Mr. Hines to a May Workshop to discuss underground lines on Jack
Hayes Boulevard and related matters.

F. There was an article in the papers about the City of Selma
looking for water. We should let them know that we have water
and would be interested in talking with them about furnishing to
tnem.
G. There will be a San Antonio-Austin Corridor Meeting in Austin
on Friday, April 12th.
Mr. Baldwin: A. Senior Citizen Day is May 11th, I would like to
have Council donate their months pay toward the purchase of
chicken for this celebration. Also solicited Council's help in
rounding up contributions of money or groceries for bingo and
domino prizes.
B. Said he drove behind a UPS truck on Elbel road and it was
going 39 mph. Mr. Gilmore said we have called their supervisor.
C. Do we normally do anything for a Council person who has left
the Council. Mayor Sawyer said we normally give them plaques.
We also need to get one for Mr. Linebarger who has resigned as
Chairman of the Planning and Zoning.
Mr. Greenwald: A. BVYA Opening Day Ceremonies will be 20th of
April at 10:00 a.m. - invitations will be forthcoming.
B. Mr. Peek has agreed to replace Mr. Stanhope on the Schertz-
Cibolo Coordinating Committee.
C. We need for the Mayor to send letters reappointing Ex Officio
members to the various organizations. Mr. Aguilar - Library, Mr.
Greenwald BVYA and P&Z, Mr. Stanhope - Humane Society. Mr.
Sharpe suggested sending letter of congratulations to the new
president of the Cibolo Valley Jaycees and to the Kiwanis Club
for painting park buildings.
Mr. Greenwald said that BVYA has signed contract with South Zone
for the tournament and they are looking at 60 teams at present.
Also there is a major corporation that may sponsor the
tournament; part of the contract is that the City sign the
contract.
Mr. Greenwald advised that Randolph AFB is redoing their fencing
and Mr. Stanhope has been in contact to see if BVYA can get some
of the old fence for around the ballfield area.
i12 ITEMS BY MAYOR: There will be a Community Council
meeting Thursday night at theTaj Mahal if anybody has anything
they would like to have brought up, let the Mayor know.
Mayor Sawyer said the Police have caught the tire-slashers in
Greenfield 14 and 15 year old kids that live in the
neighborhood.

Mr. Sharpe advised that he read where Windcrest received a
$22.,000 grant for Crime prev~ntion programs. Could we alsoapp-ly
for one of these grants.

Mr. Sharpe also said the Chamber of Commerce had a circus in Live
Oak last weekend and made about $2,000 profit. They are trying
to get the circus back next April and have in Selma and have
three day festival type thing. Maybe make it an annual
celebration.

Mr. Aguilar asked how the .people that pay their . water bills by
mail or drop box receive their bumper stickers. Mr. Gilmore said
they can come in and sign up and. receive two.free.and buy as many
as they need for twenty-five cents each. Weare st.il.l
advertising this.
Mr. Aguilar announced that the 19th of April is the TML Region..?
meeting in Eagle Pass and asked if Mr. Stanhope would like to go.
