REGULAR MEETING OF THE CITY COUNCIL
APRIL 16, 1985
The Schertz City Council convened in Regular Session, Tuesday,
April 16, 1985, at 7:00 P.M. in the Council Chambers, 1400 Live
Oak Road. The following members were present: Mayor Earl W.
Sawyer, presiding; Charles B. Sharpe; Ray Stanhope and Ken Green-
wald. Absent were Councilmen Adolph Aguilar and Hal Baldwin.
Staff present were City Manager Jimmy G. Gilmore and City Secre-
tary June G. Krause.
Prior to startng the regular meeting, Mayor Sawyer swore into
office newly elected Councilman Raymond Stanhope and re-elected
Councilman Ken Greenwald.
Mayor Sawyer presented a proclamation to Librarian Gail Douglas
and Library Board Member Margarite Riley, proclaiming the week of
April 14th through 20th as "Schertz Library Week".
PUBLIC HEARING: Mayor Sawyer said the purpose of this Public
Hear ing, held jointly with the Planning and Zoning Commission
members, was to receive input from the public on a proposal to
establish a Special Overlay District along Jack Hays Boulevard
(FM 3009). He then turned the hearing over to P&Z Chairman John
Linebarger.
r- Mr. Linebarger mentioned that a week ago there was a Community
meeting held on this same subject where many of the questions
were answered. Tonight will be the last time comments from the
public will be heard. After the hearing, the Planning and Zoning
Commission has ten days in which.tomake their recommendation to
the City Council, who will take action at their next regular
meeting.
Mr. Gilmore then gave a slide presentation showing some positive
and negative ways the overlay can work_. He. emphasized that the
purpose of this overlay district is not to change the zoning but
to add additional protection for development along Jack Hays
Boulevard. This boulevard will be changed into a five-lane road.
The overlay district will address things such as underground
utilities, low profile signing, drainage and buffers between
traffic and residential areas. This overlay district will pro-
vide added means to insure that we have a good environment that
is pleasing to the eye and still allow for planned growth.

1. Rob SuIt - who pays for putting utilities underground.
2. EricCrugnale - felt the road should be updated first
and then go for overlay and development.
3. Harvey Land, 1213 Fawn Drive - drainage concern
4. Edward Squires, 804 Robert Derrick - concerning
variances.
5. Bob Zunker, 1212 Antler - concerning a permit he is
seeking for a metal building on his property.
6. David Johnson of Johnson and Johnson, San Antonio -
said he had to commend the City Council and Planning & Zoning for
the thought behind this project. It can benefit everyone con-
cerned. He recommended hiring an architect.
7. Jerry Torgeson, Penta Developers - asked questions about
the fire lanes to be sure that they would not create traffic
problems. He also addressed signage.
There being no further comments from the public, Mr. Linebarger
again explained the procedures to be followed. He said this
could be only the first of several overlay districts. As the
City developes, there will be others, such as the extention of
Li ve Oak Road.

Mayor Sawyer explained the city will be working with the State on
the widening of Jack Hays Boulevard, that we will work with the
utility companies for improved lighting of a supior quality. We
will adopt policies for better traffic flow and will work with rl
the local news media to attract new businesess to the area. The Ul
widening of this road will not take place immediately, it will
take up to five years. He asked the public to write to their
representatives to solicit help in this respect.
There being no further comments, Mayor Sawyer declared the public
hearing closed at 8:00 P.M.; and called for a short recess.
The Regular Meeting reconvened at 8:10 p.m.

.2 APPROVAL OF MINUTES: Mr. Sharpe moved to approve the
minutes of the Workshop meetings of March 27, 1985 and April 10,
1985 and the Regular Meeting of Apr il 2, 1985. Mr. Greenwald
seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Stanhope and Greenwald

.3 CONTRACT: Mayor Sawyer said this was to consider a
contract with Guadalupe County on vehicle registration.
Mr. Gilmore said the contract that was presented by Guadalupe
County is a little odd. Be had Attorney Harris look at it and he II
says, although it is worded strangely, the only thing really U
wrong is that it should have something in the contract stating
they will pass the 50 cent fee back to the City.

Council had several questions about the contract. Mr. Sharpe
moved to table this item and discuss at the next workshop and if
want.to, vote on it at the workshop. Mr. Stanhope seconded the
motion, which carried with the following vote:
AYES: Councilmen Sharpe, Stanhope and Greenwald
NAYS: None
14 BID AWARD: Mr. Sharpe moved to accept the bid from
Bluebonnet Motor Company for a 1985 4-door sedan, in the amount
of $9,647.72, saying he realizes this is about $12 more than the
bid from San Antonio but feels the distance will offset that
difference in a short time. Mr. Greenwald seconded the motion.
Mr. Sharpe again said tha'the feels the difference in distance
between New Braunfels and San Antonio will make a big difference
in maintenance- much more than the $12 difference in original bid
price.
Mr. Stanhope asked if we could get a faster delivery date. Mayor
Sawyer then called for a vote on the motion, which carried with
the following vote:

#5 RESOLUTION: Mayor Sawyer introduced a resolution sup-
porting additional elderly housing in the Randolph Area and read
the caption as follows:
RESOLUTION NO. 85-R-4
A RESOLUTION SUPPORTING ADDITIONAL LOW-RENT
ELDERLY HOUSING IN THE SCHERTZ-RANDOLPH AREA.
Mr. Greenwald moved to approve.the resolution supporting elderly
housing in the Randolph area. Mr. Stanhope seconded the motion;
which carried with the followin vote:

NAYS: None
i6 ORDINANCE: Mayor Sawyer introduced an ordinance revis-
ing Chapter70f the Code of Ordinances'providing for Fire Chief
and Fire Marshal; and read the caption as follows:

PROVIDING THAT THE CODE OF ORDINANCES, CITY OF
SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER
7 OF SAID CODE, PROVIDING FOR THE OFFICE OF
FIRE CHIEF AND FIRE MARSHAL AND THEIR DUTIES;
REPEALING ALL ORDINANCES IN CONFLICT.

Mr. Sharpe moved to approve the first reading of a ordinance
amending Chapter 7 of .the Code on Fir-e Chi~f, Fire Marshal and
their duties. Mr. Greenwald seconded the motion, which carried
with the fOllowing vote:

17 ORDINANCE: The Mayor introduced an ordinance amending
the Southern Standard Building Code by eliminating wood shingles
and read the caption as fOllows;
AN ORDINANCE
AJlENDING THE SOUTHERN STANDARD BUILDING CODE,
1982 EDITION, AS AMENDED, 'BY ELIMINATING WOOD
AND SHAKE' SHINGLES;. REVl:SI.NG SECTION
1104.5 (b); AND REPEALING ALL ORDINANCES IN
CONFLICT.
Mr. Greenwald moved to apQlDve the first reading of an ordinance
amending the Souther Staridard Building Code by eliminating wood
shingles and revising Section 1104.5(b). Mr. Sharpe seconded the
motion, which carried as follows:

.9 CITY MANAGER'S REPORT: a. we have received a very nice
letter from Mr. Albert Gabrysh praising SAFES personnel on their
response time and life saving that they performed during an
emergency in Universal City.

d. You have copies of letter from Guadalupe valley Electric
Cooperative in answer to our letter regarding the cut.ting of
trees in the easement behind Robert Stevens. Mr. Hines also
wrote to the two gentlemen who had wr itten directly to them.
This is not the answer we would like but at least they did
answer.
e. Jerry Lovelady has requested to open a concession at the
swimming pool to replace the vending machines we now have. He
has talked to the Park Supervisor. He would like to put in a
building and sell drinks, candy, hot dogs, etc. in the same area
where the vending machines are in order to use the utilities that
are in place. The first two years he would give the City 10% of
the sales and after that, 15%. After talking with Park people,
Mr. Gilmore said he felt it would be a good thing and less head-
aches for the City.
Council concensus did not see anything wrong with this as long as
we got a contract drawn up and the concession did not inter fer
with the Fire Department Supper, July Jubilee or BVYA tourna-
ments.
f. Mr. Gilmore said that all next week he will be unavailable.
On Sunday the San Antonio Light is having an article on Jack Hays
Boulevard that might be interesting.
#10 ITEMS BY COUNCIL: Mayor Sawyer said that normally at
this meeting Council nominates a Mayor Pro Tem.
Mr. Sharpe nominated Mr. Hal Baldwin as the new Mayor Pro Tem
with Mr. Greenwald and Mr. Stanhope agreeing.
Mr. Sharpe: a. He was approached by one of the members of the
Austin-San Antonio Corridor Committee who said they are trying to
delete the $130,000 from the South West Texas University budget.
Mr. Sharpe said he wrote them and included newspaper articles
about the corridor from surrounding cities. Basically asking
Rep. Jones, who is the one heading it up to keep this funding in
the budget, to do everything in his power to keep this $130,000
in the budget.
b. Had a meeting Monday night of the Schertz-Cibolo Coordinating
Committee. This was the most productive meeting so far. Had
David Dennis from CCMA who made a presentation on the history of
CCMA, sewer lines and how to get the area extended. Also asked
him about drainage - asked if CCMA could come up with a drainage
study and funding. He said the Corps of Engineers have some
information on file that he can use. The only thing it would
cost Schertz and Cibolo is perhaps $200-$2000 if more study needs
to be 'done. Perhaps the Mayor could write requesting this.
Mr. Greenwald said he had talked to Mr. Weaver and he is going to
send letter to each city requesting that CCMA be allowed to go
ahead with this plan. It will give us water flow figures.

c~ HasanYQne heard from Texas Waste_Management as to why they
are running so late in picking up garbage. Mr. Gilmore said. the
only answer he gets is that people are putting out more trash
this time of year.
