SPECIAL MEETING OF THE CITY COUNCIL
MAY 29, 1985
The Schertz City Council convened in Special Workshop Session,
Wednesday, May 29, 1985, at 7:00 p.m. in the Conference Room of
the Municipal Complex, 1400 Live Oak Road..' The following members
were present: Mayor Earl W. Sawyer, presiding; Charles B.
Sharpe, Hal Balwin; Ray Stanhope; Adolph Aguilar and Ken
Greenwald. Staff present were City Manager Jimmy G. Gilmore and
Deputy City Secretary Sylvia C. Taylor.

12 P & Z VACANCY:
Council was on concensus to approve P&Z'S recommendation to
appoint Mr. David Allen to fill vacant possition on committee;
item to be voted on in next reqular seccion.

.5 REQUEST FOR BOA HEARING:
Mr. Gilmore informed Council of Mr. Zunker's request for a
variance to the Special Overlay Ordinance. Mr. Zunker desires to
construct a tin building to house his automobile.
Mayor Sawyer stated that if a variance was granted at this early
stage of the Ordinance there was would be no purpose for the
Overlay Ordinance.
#6 REQUEST FOR PUBLIC HEARING:

Mr. Gilmore announced Mr. Ruscin' s request was to rezone the 0
11.281 acres of land between Sycamore Creek Apartments and the
school administration offices. Mr. Ruscin wants the area rezoned
to Neighborhood Services from R-4.

Mayor Sawyer asked what could be placed in the area if it is
zoned NS.
Mr. Greenwald responded that alcoholic beverages are not allowed
by law to be sold within 10,000 square feet from a school.
Public Hearing to be scheduled as soon as possible.
#7 DRAINAGE ON FM 3009 WITH BARSHOP: Cancelled
#8 ORDINANCE ESTABLISHING SPEED LIMIT ON FM 78:
Mayor Sawyer stated no discussion was necessary since Highway
Department required this ordinance be passed.
#9 EXECUTIVE SESSION: None needed.
#10 CITY MANAGER'S REPORT:

Mayor Sawyer asked Mr. Gilmore to request annual bills from Mr.

Council gave Mr. Gilmore permission to pay Mr. Richards for the
Capital Improvement fund.
The San Antonio Apartment Association requested permission to
extend the park drinking hours until 11:00 p.m. Council approved
the extention.
Mr. Gilmore informed Council of a reminder from Melick and Thorpe
on the Village Oak Hospital opening, June 2.
Mr. Gilmore requested permission from the Council to give two
Girl Scout Troops from Poteet a discount on swimming passes from
June 1 through June 6.
Mayor Sawyer suggested the Troop be charged for the first day of
swimming and be given free passes compliments of the Mayor and
City Council for the remainder of their stay.
Mr. Gilmore has another meeting with the developers along Live
Oak Road. Developer, Tom Anderson, wants to extend road out to
Look Out Road and is in a hurry to do so. Some landowners are
holding the project up but 60 acres have been donated by other
landowners.

#11 ITEMS BY COUNCIL:
Mr. Baldwin stated he had the first oppurtunity to view the ditch II
behind the school central office and it is starting to collect
trash and debris.
Mr. Stanhope mentioned the "used car lot on Main" next to the
bank.
Mayor Sawyer stated the car might be repossessed, then declared
a recess at 8:25 p.m.
The Workshop Session was reconvened at 8:30 p.m.
Mr. Greenwald addressed a letter from P&Z dealing with F.E.M.A.
on parking in the floodway list suggestions for RV Parks in
floodways. Parks would be required to have system alarms when
the water level reaches certain level the alarm would go off.
Letter should be sent to P&Z and incorporated in Mobile Home
Ordinance, making Park Manager liable if disaster occurs.
Mr. Greenwald mentioned that at theCCMA meeting the resolution
supporting sewer development was discussed and approved.
Mr. Sharpe requested letters be mailed to the Universal City
Council requesting permission to speak at one of their Counc,il
meetings. The letter should mention problems along 1518, noting 0
that they cannot provide proper services to residents or
businesses in that area.
Mr. Sharpe also noted that the minutes from the P&Z do not
contain enough content about the meetings.
Mr. Greenwald stated that Earl Hartzog was trying to be both
staff member and take minutes since the Secretary did not take
minutes.
Mr. Aguilar mentioned all the signs that are up along FM 78, the
Rail Road has given permission for these signs to be put up.
Mayor Sawyer suggested a letter be sent to the Railroad . asking
them not to give permission for more signs to go up along the
tracks.
Mr. Sharpe suggested an amendment to Ordinance 79-S-l5 charging
$200 a day until in compliance.
Mr. Greenwald mentioned that P&Z was reviewing a proposed sign
ordinance that should be ready for the June 19th Workshop.
Mayor Sawyer suggested the Railroad be invited to one of the
workshops to discuss this problem.
Mr. Stanhope noted an old house had been moved to 1518 and Pecan;
asked if the City had any control on what type of houses are
moved i~to the City limits.

Mr. Gilmore stated that if the houses meet all the requirements
of our Ordinance then there was not much that could be done.
Mr. Baldwin stated that the only solution to this problem was a
Housing Code.
Mayor Sawyer asked Mr. Gilmore to request copies of a sample
Housing Code from TML.
Mr. Sharpe announced that he would be in Temple May 30; suggested
June 29 for the offical recognition of Sesquicentennial.
June 15th is date suggest for a Joint Tour with the School
Trustees.
August 22, Thursday, EcoDev Council proposes a Joint City Council
Meeting for all cities in the area, details on where the joint
meeting have not been finalized. Charters have to be check
before setting location of meeting.
Mr. Aguilar addressed the letter for P&Z' s reluctance to make
recommendation on F.E.M.A.
Mr. Greenwald stated the P&Z were concerned that they may have
approved something that could cause the City to be liable. P&Z
r- is not sure they should give final approval.
Mr. Gilmore stated that what was being ask is against the law.
Mr. Aguilar stated the corner of Curtis and Pfeil Duplex had some
cars park on front making it look like a junkyard but has been
cleaned since then.

#12 ITEMS BY MAYOR: Mayor Sawyer introduced a resolution,
and read the caption as follows:
A RESOLUTION
A RESOLUTION BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS IS SUPPORT OF THE CITY OF
CIBOLO'S COMMUNITY DEVELOPMENT BLOCK GRANT
APPLICATION FOR FUNDING TO PROVIDE FOR A
FIRE STATION ON THE NORTH SIDE OF TOWN, AND
SEPARATED FROM THE SOUTH SIDE OF TOWN BY THE
SOUTHERN PACIFIC RAILROAD SYSTEM.
Mayor Sawyer asked Mr. Gilmore what progress was being made on
the water theft case.
Mr. Gilmore responded that some of the cases where being taken to
court.

Mr. Aguilar inquired as to who should be notified of dumping on
1518.
Mr. Gilmore replied that the County should be notified.
Mr. Stanhope asked if it was legal to dump dirt in Cibolo Creek.
Mr. Gilmore replied that is was not legal and the State had been
looking into the problem.
Mr. Stanhope inquired on establishing an Ordinance prohibiting
the parking of cars in front of. yards. '
Mr. Gilmore stated that San Antonio had such an Ordinance but
they could not enforce it.
113 ADJOURMENT: On a motion by Mr. Sharpe, seconded by Mr.
Aguilar and. unanimously carried, the meeting was declared
adjourned at 9:38 p.m.
