REGULAR MEETING OF THE CITY COUNCIL
JULY 2, 1985
The Schertz City Council convened in Regular Sess ion, Tuesday,
July 2, 1985, at 7:00 P.M. in the Council Chambers, 1400 Live Oak
Road. The following members were present: Mayor Earl W. Sawyer,
presiding; Hal Baldwin; Raymond Stanhope; Adolph Aguilar and Ken
Greenwald. Absent: Councilman Charles B. Sharpe. Staff present
were City Manager Jimmy G. Gilmore and City Secretary June G.
Krause.
PUBLIC HEARING: After welcoming everyone to the meeting, Mayor
Sawyer opened the public zoning hear ing held jointly with the
Planning and Zoning Commission. He said the purpose of the
hearing was to receive input from the public on a rezoning
request by Joseph Ruscin for an 11 acre tract from Multi-family
Dwelling District (R-4) to Neighborhood Service (NS). Said land
is located on the South side of Elbel Road between the School
District Administration Building and the Sycamore Creek
Apartments. At this time, he turned the hearing over to Mr. Tom
Yarling, Chairman of the Planning and zoning Commission.

Mr. Yarling called on staffmember Earl Hartzog to give a little
background on this request. Mr. Hartzog again gave the location
of the 11 acres and said that 37 property owners were notified of
the hearing, based on the current tax roll. Two letters were
returned by the post office. The City has adequate utilities to
serve this proposal. One item of concern was the additional
traffic created. The present zoning is for apartments and staff
and P&Z felt this NS zoning would be better as far as traffic is
concerned.
Mr. Joe Ruscin, an attorney representing the owner of the
property, gave some background information on their request for
rezoning of this property. He said that in deciding the most
feasible use for the land, they checked the abundance of
apartments in the area and decided to ask for Neighborhood
Services. They realize that because of the proximity of the
school they cannot have any type business connected with
alcoholic beverages but said they really did not want that type
business. The envision a retail str ip center with some type
off ice spaces. He said they are also aware of the drainage
problems.
When Mr. Yarling opened the hearing to citizens, Mr. Bill Hooper
of 1061 Valley Forge, asked if this property would be built up
like the apartments next to it was, creating drainage problems
for his area. Mr. Yarling explained that the question before
this hearing was for zoning only but that the developers would
have to comply with all ordinances. Mr. Hooper said that when
they built the apartments, they dug out the drainage ditch to
-- build up the land for the apartments and created drainage
problems. Councilman Baldwin asked if it was going to be
necessary to bring these buildings up to the first floor level of
the apartments.

Mr. Gilmore said the drainage ditch should have been put in when
Village 1 and 2 were developed but was not. When the apartments
were built, they not only had to build drainage for them but also
had to pull drainage off Village 1 and 2. The owner of the land
and owner of the dirt decided to keep the dirt and now we have a
slight hill.

Mr. Aguilar asked if the drainage ditch was dug out to raise the
property for the apartments. Mr. Gilmore said no, it was not.
There were no further citizens wishing to speak for or against
this request.
Planning & Zoning members and Council then discussed the type of
businesses planned for this property. Mr. Ruscin said he did not
think the owner had done any type of research nor made any
attempt to lease as yet. When asked by Council if they planned
to have roads behind the businesses, Mr. Ruscin said they always
try to have access in the rear of the building.
Mr. Yarling then reminded everyone this is the last time the
public will be allowed to comment on this request. The P&Z will
take all comments into consideration when they meet to make their
recommendation to the Council.
Mayor Sawyer declared the hearing closed at 7:27 p.m.

#1 APPROVAL OF MINUTES: Mr. Stanhope moved to accept the
minutes of the Regular Meeting of June 18, and Special Meeting of
June 26, 1985. Mr. Baldwin seconded the motion, which carr ied.
with the following vote:
AYES: Councilmen Baldwin, Stanhope, Aguilar and Greenwald.
NAYS: None
#2 HEARING OF RESIDENTS: Mr. Gilmore said to answer some
of Mr. Bill Hooper's questions he would like to comment on the
drainage ditch. There will be no further dirt taken out. The
ditch was built to take care of the drainage. The engineer said
it should have been built when the Village was built. We are
working with the developer of the apartments at this time. There
is work that needs to be done to bring the engineering up to City
standards. And there should be some additional planting of
vegetation on the sides of the ditch. There should be no more
dirt removed - that was not the reason for building it to start
with. We do realize there are problems and they are being
addressed.
i3 EXECUTIVE SESSION: None needed.
#4 CITY MANAGER'S REPORT: A. BVYA has asked for police D
for this weekend tournament. To provide four-hour increments
will cost approximately $240 and it would have to be our off-duty

policemen. Mayor Sawyer asked for a concensus of Council, who
were all agreeable to the City paying for this but suggested that
BVYA consider this in their next year's budget. Mr. Gilmore said
that all other volunteer organizations pay for this service.
B. As requested by Council, a letter was sent to Cibolo in
regards to dispatch fees, extending the time for the increase to
the next fiscal year. This letter was signed by the Mayor.
C. Have talked with the engineer and he is preparing the metes
and bounds for commencing annexation to the south. Also have
talked with the people in Rittimann Addition and they will get a
petition to request aid from us and the County Judge. Mr.
Gilmore said he would like to pursue grants for their area.
D. Have talked with TML and they will send letter to City in
September requesting those who desire to send in resolutions for
consideration.
E. Mr. Gutierrez has been invited to the next Workshop and he
will be there. We are continuing to send letters in regards to
vegetation.
F. Checked on the liability insurance for Council and it does
cover P&Z and all appointed committees and commissions.
G. Talked with Mr. Harris about GBRA and he saw no problem but
did question what it would accomplish and cautioned about being
very careful so that we did not comprise anything.
H. Have checked our personnel policies and the phrase "For Just
Cause" is not in there. Also talked with the attorney and he has
made some suggestions for changes to comply with the Fair Labor
Standards Act.
I. Two years ago Mr. Gilmore was invited to go to China by the
People to People. He said he has received another invitation for
November.
#5 ITEMS BY COUNCIL: Mr. Baldwin mentioned a Mail-o-gram
received from County Judge Tom Vickers and said this could be the
answer for Rittimann Addition. Mr. Gilmore said that
Commissioner Lee has requested to talk with the Mayor on the lOth
of July and then come to Council on the 16th.
Mr. Aguilar asked about vehicle validation registration. Mr.
Gilmore said that we had started selling them here as of this
week.
Mr. Greenwald asked about one of the Sanitarian inspections and
how long we permit them to operate. Mr. Gilmore said the
Inspector places restrictions on them and will give them time to
bring their establishment in line.

Mr. Stanhope brought up about the Sesquicentennial booth to be
set up for the Jubilee on the 4th. Mayor Sawyer said we will be
kicking off the Sesquicentennial officially at noon. The VFW
will be doing the flag raising and Rep. Kuempel will be present.
Mrs. Jeanine Hicks from the Sesquicentennial State Commission
would be present to present the official flag. The parade would
commence at 10:00 a.m.

16 ITEMS BY MAYOR: Mayor Sawyer said we are very proud of
our City Manager, who has received many honors.
Thursday, July 11th is the Council of Mayors meeting if anyone
has an item to be discussed.
The annexation the City Manager is talking about is the one
southeast of Randolph.
17 ADJOURNMENT: On a motion by Mr. Aguilar, seconded by
Mr. Baldwin and unanimously carried, the meeting was declared
adjourned at 8:15 p.m..

The Schertz City Council convened in Special Workshop Session
Wednesday, July 10, 1985, at 7:00 p.m. in the Conference Room of
the Municipal Complex, 1400 Live Oak Road. The following members
were present: Mayor Earl W. Sawyer, presiding; Hal Baldwin;
Raymond Stanhope; Adolph Aguilar and Ken Greenwald. Absent: Mr.
CharlesB. Sharpe. Staff present were City Manager Jimmy G.
Gilmore and City Secretary June G. Krause.
#1 HEARING OF RESIDENTS: A. Mr. Tom Harm, president of
Buffalo Valley Youth Association and their Board members were
present and wished to discuss their organization with Council.
Mr. Harm introduced the Boardmembers and said thay had come to D
try to get back in line on communications. He said that the City
could not provide the service that BVYA provides. What set them
