REGULAR MEETING OF THE CITY COUNCIL
JULY 16, 1985

The Schertz City Council convened in Regular Session Tuesday,
July 16, 1985, at 8:00 p.m. in the Council Chambers, 1400 Live
Oak Road. The following members were present: Mayor Earl W.
Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Raymond
Stanhope; Adolph Aguilar and Ken Greenwald. Staff present were
City Manager Jimmy G. Gilmore and City Secretary June G. Krause.
Mayor Sawyer welcomed everyone to the meeting, stating that
before starting the regular meeting, the Schertz Volunteer Fire
Department wishes to present some plaques.
Mr. Clifton Crook, president of the Volunteer Fire Department,
said that we now have a new building adjacent to the large
pavilion in the park. This was made possible by the large
donations of some of our local business people and they would
like to present plaques to them as a taken of their appreciation.
First he introduced Randy Amescua, who is a member of the fi~e
department as well as representing Gerard Electric. Randy
conceived the idea of the building, desi9ned it and donated to it
also. The second plaque was presented to Fred Moos, representing
Arnold Moos Plumbing Company. Mr. Wayne Wolters, president of
the Schertz Business Club, accepted the plaque for the Business
Club. Mr. Crook also had plaques for Mr. Eric White, Garden 0
Ridge Pottery, and Naylor Realty, Tri County Business Park, who
were not present.
.1 APPROVAL OF MINUTES: A. Regular Meeting of July 2 and
Special Meeting of July 10th.
Mr. Greenwald moved to approve the minutes of the Regular Meeting
of July 2, 1985 and the Special Meeting of July 10, 1985. Mr.
Stanhope seconded the motion, which carried with the following
vote:
AYES: Councilmen Baldwin, Stanhope, Aguilar and Greenwald
NAYS: None
ABSTAINING: Councilman Sharpe
.2 HEARING OF RESIDENTS: Mr. Jack Crookshanks, owner of
Lee' Jack's Auto Parts, said he was burglarized for the second
time last Saturday night. Until that time, he said, he had not
seen any police on FM 78 for months and then he was stopped last
Saturday night. He asked if he had to hire his own security.
Mr. Gilmore said that last weekend we had five officers in our
unmarked cars and in their civilian clothes. We know there is a
problem and we want to help - we are trying. Some of the
officers are even on their own time, without being paid.

Mr. Crookshanks then asked if has come down to the point that he
is going to have to hire security guards to protect his property.
Mr. Gilmore said he had reports on seven burglaries in the last
three months on FM 78. There is a pattern developing - we don't
have a definite suspect as yet but do have some information.
Mr. Bob Jordon, owner of The Station, also discussed some
problems he has been having. He stated that Saturday night he
had a "wetback" with some stolen property in his hand and the
police came up and called him by name and told him to leave Mr.
Jordan's property. In answer to Mr. Sharpe's question, Mr.
Jordan said he did not file a report of the theft. Also when Mr.
Stanhope asked how Mr. Jordon knew the man was a "wetback" and
Mr. Aguilar asked what is a "wetback" - Mr. Jordon replied a
mexican. He then related some incident about catching some
people with false credit cards and after the people were-jailed,
he felt he should have been given the false credits cards but our
police were holding them for evidence.
Mayor Sawyer said that these gentlemen do have police protection
out that if they wanted to hire someone for security, then do it.
The City has stepped up patrols, are aware of the problem and are
working on it.

Mr. Chris Berg, owner of True Performance, asked if he was
suppose to know the law that they have to come down to the police
department and file charges. He asked if the police should not
have informed them of this.
Mr. Sharpe said that the police should have informed them of that
because someone has to file charges, the police cannot file on
something that they did not see.
i3 BID AWARD: Consideration of awarding bid on a vibrator
roller.
Mr. Gilmore explained that Council had discussed purchase or
lease-purchase - the decision rests with the Council. The cost
is $11,400 over 24 months but if you incorporate the interest
drawn and availability of money, they equalize each other. We
need this piece of equipment in order to maintain the streets.
Mr. Aguilar moved to purchase the equipment on the 24 month
lease-purchase plan. Mr. Sharpe seconded the motion.
Mr. Aguilar said the question had come up at workshop as to
whether or not this equipment would work on hot patch as well as
cold patch. Mr. Gilmore said it would work with both.
Mayor Sawyer called for a vote on the motion before Council and

.4 RESOLUTION: Mayor Sawyer introduced a resolution and
read the caption as follows:

RESOLUTION NO.
A RESOLUTION BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, ADOPTING A REVISED SET OF
PERSONNEL POLICIES IN THE FORM OF A PERSONNEL
MANUAL.
Mr. Stanhope moved to approve the resolution adopting the
revised set of. personnel policies. Mr. Baldwin seconded the
motion.
Mr. Sharpe said he was not prepared to vote on this item at
present. Mayor Sawyer said he felt the rest of the Council was
ready. Mr. Greenwald explained that some of the changes came
from one of the meetings at the last seminar attended by Council.
The Mayor then called for a vote on the resolution. The motion
passed with the following vote:
AYES: Councilmen Baldwin, Stanhope, Aguilar and Greenwald. 0
NAYS: None
ABSTAINING: Councilman Sharpe
.5 ZONING CHANGE '71: Mayor Sawyer said this is a request
by Mr. Ruscin to rezpne an 11 acre tract of land'on Elbel'Road,
between the Administration Building and the apartments, from R-4
to Neighborhood Services.
Mr. Greenwald moved to concur with the Planning & Zoning
recommendation and rezone the 11 acre tract from R-4 to
Neighborhood Services. Mr. Aguilar seconded the motion.
Mr. Baldwin said he feels very strongly about this; that the
City's Master Plan for years has carried the commercial on Live
Oak Road and Jack Hays Boulevard. He said he would like to see
the City stick with that. He went on to say that he had no
qualms bout this type zoning across from the school but he did
feel it would be a little bit more attraction for the kids to
leave schoo.l.
Mayor Sawyer said he had really looked at this zoning and cannot
see any other zoning for this piece of property. He said he felt
the City plan must be flexible. Those businesses near a school
that would be detrimental are barred by law. Mr. Sharpe agreed
with the Mayor and said he did not see anything wrong with the 0
zoning request. Mayor Sawyer then called for a vote and the
motion carried as follows:

i6 EXECUTIVE SESSION: Mayor Sawyer called an executive
session at 8:29 p.m. under Article 6252-17 Vernon's Texas Civil
Statutes, Section 2 <g) on personnel.
MR. BALDWIN HAD TO LEAVE THE MEETING AT 8:45 P.M.
The regular meeting was reconvened at 8:52 p.m. by Mayor Sawyer,
who said the City Manager was given instructions, which he will
carry out. '
#7 CITY MANAGER I S REPORT: We are still behind in grass
cutting. Copies of letters are available of thos~ we have sent
out regarding citizens cutting their property. We have cut the
ball diamonds and they will be cut again pr ior to the next
tournament. We do not feel that we should lend our two mowers.
We feel we should use them ourselves. We do have other mowers
available if the right person asked for them.
#8 ITEMS BY COUNCIL: Mr. Sharpe said he was the one that
asked about sending out letters. There is one piece of property
with weeds so high, they are obstructing traffic. Also there is
a potential safety hazard on M~in Street where the street has
r- been cut for repairs. The barricades are very close to the drop
off.
Mayor Sawyer explained that Mr. Baldwin had an. emergency call
from home.
Mr. Aguilar said that on the monthly reports, the number
impounded sounds excessive. Mr. Gilmore said this is the time of
year when people are moving in and out and drop off animals on
us. Also Cibolo had an excessive number. Mr. Auilar asked what
is meant by "other" on the report. Besides cats and dogs, we
also have rabbits, ducks, etc.
Mr. Aguilar asked if we know what the water level is in the
aquifer. Mr. Gilmore said the last he heard it was 24 feet from
the high record. Springs are flowing that have had no water in
them for years.
Mr. Greenwald said it was questioned at the joint Planning
meeting as to whether or not anything has been come up from CDR
about Elbel Road. Mr. Gilmore said he understood there were
discussions going on but he had not heard anything further. Mr.
Greenwald said maybe we should take the lead and get them
together.

Hopefully next month Dr. Peek will have something on streets
abutting both cities. The concensus is to work out an agreement
on different streets rather than to have one city patrol one side
of the street and the other city patrol the other side.

Mr. Greenwald said he went up to Quick VI to get some air for a
bicycle and had to pay for it. That wasn't any problem but he
also found out that they sell water. Mr. Gilmore said it was not
illegal.
i9 ITEMS BY MAYOR: Mr-; Sawyer said' he had received a
letter from the Chamber of Commerce inviting t~e Council to a
grand council meeting of the area cities to show how well cities
can work together in some instances.
He said he also received an answer to his letter to Doyle H~~es
of GVEC concerning fees but it really doesn't say too much.
Mayor Sawyer reported on the -last. meeting of the Council of
Mayors, which was highlighted by Randolph Air Force Base. He
said they are planning an annual calendar with various functions
listed for each city. This will allow cities to set
unconflicting dates for non-annual events.

Mr. Sawyer said at the last workshop he asked Council to consider
joining Bexar County and counting our citizens in the Urban
County designation. CommIssioner Lee-will be at the workshop on
the 31st to answer any questions.
Mr. Greenwald announced the South Zone Interstate Tournament the
26th, 27th, and 28th of JUly. They have registered about 68 Di
teams.
Mayor Sawyer said this points out the need for Amer ican Guest
Hotel, which is why this meeting was delayed one hour so Council
could go to the opening of their American Guest Hotel on 281.
.10 ADJOURNMENT: 'On a motion by Mr. Aguilar, seconded by
Mr. Greenwald and unanimously carried, the meeting was declared
a'djourned at 9 :52 p.m.. '.
