SPECIAL MEETING OF THE CITY COUNCIL
JULY 31, 1985
The Schertz City Council convened in Special Workshop Session,
Wednesday, July 31, 1985, at 7:00 p.m. in the Conference Room of
the Municipal Complex, 1400 Live Oak Road. The fOllowing members
were present: Mayor Earl W. Sawyer, presiding; Hal Baldwin; Ray
Stanhope and Ken Greenwald. Absent: Councilmen Charles B.
Sharpe and Adolph Aguilar. Staff were Jimmy G. Gilmore, City
Manager and June G. Krause, City Secretary.
il HEARING OF RESIDENTS: After welcoming everyone to the
meeting, Mayor Sawyer asked Mrs. Stewart, who was spokeswoman for
a large group of citizens, to make her presentation or request.
Mrs. Stewart, who lives in Oak Forest, said her group was very
concerned about the 55 mile per hour speed limit on FM 3009. She
said they noticed that there is a turn lane at Greenfield Village
and also the speed limit in that area is 45 miles per hour, then
it picks up to 55 miles per hour and continues at that limit past
both Deer Haven and Oak Forest subdivisions before it goes back
to 45 just before meeting I35. There has been several accidents
in their area on FM 3009.
Mayor Sawyer said the City has been to the Highway Department
five or six times during the past year to get them to slow
traffic to 35 miles per hour. Council has recently committed
$250,000 to improvements to FM 3009 or Jack Hays Boulevard for
widening and turn lanes in the center. This should take place
within five years. We are trying to get more turn lanes;
however, we did not initiate the ones at Greenfield village.
Several citizens wrote to Congressman Kuempel and within two
weeks the Highway Department was down surveying. We have
initiated more patrols on Jack Hays and will wr iteCAletter to
Highway Department; but the main thing is for each citizen to
write to Mr. Kuempel.
Mr. Stanhope mentioned that the group is also recommending no
passing on Jack Hays.
Mr. Sawyer said there should be a traffic light at Elbel Road and
Jack Hays Boulevard by the end of summer.
MR. SHARPE ARRIVED AT 7:10 p.m.
Mr. Gilmore said that within the next few months there should be
some work done on Crest Oak. We are working with a developer on
that.
Mayor Sawyer introduced Bexar County Commissioner Bob Lee and Mr.
Morgan Damarigny, who represents Representative MacSweeney.
The Mayor called a short recess at 7:15 p.m.

The Workshop Session was reconvened at 7:19 p.m.
Mrs. Rugh spoke to Council regarding the organization of a Moose
Lodge in Schertz. The Moose have a childrens home and an old
folks home, are very active in Muscular Dystrophy and like to
become very involved in their community. She said they have 90
days in which to get chartered and have to have 100 members to be
chartered. Their immediate need is for a place to meet during
the next 90 days. Mrs. Rugh asked for the use of the Community
Center for the next 90 days free of charge. After that, if they
have not found another place to meet, they would be able to pay
rent as other organizations do.
Mayor convansassed the Councilmembers, who agreed to let Mrs.
Rugh and her group use the Community Center for 90 days rent
free.

Mrs. Liz Mueller said the Randolph Area Elks are making a
donation to the Humane Society on August 17th at 11:00 a.m. and
invited Council and guest to attend.
.2 Bexar County Commissioner Bob Lee thanked Council for
the opportunity to come and talk about what the County
Commissioners Court feels is a critical need. As we all know,
the Federal Government is threatening to discontinue Revenue
Sharing Funds' and they are going to have to search for other
sources of funds. If they can qualify as an Urban County, they 0
can obtain two million dollars a year for three years or a total
of six million dollars of CDBG money. In order to obtain the
status of Urban County, they need a population outside of San
Antonio of 200 ,000. The unincorporated area has about 160,000
and they need an additional 40,000 of Urban Municipalities. In
order for Schertz to become a part of this designation, Schertz
would have to enter into an agreement with Bexar County. By
signing the agreement, it will guarantee Schertz that you will
not have to be in fear of receiving any public assistance housing
outside of this plan, for a period of three years. One other
assurance is that if there would be any amendment, each city
would have to sign it. Mr. Lee said he is convinced that this
agreement provides and guarantees that Schertz would have no
public assistance for three years. He said they desperately need
renovation in the Bexar County Courthouse, at a cost of
approximately one and one half million dollars and would like to
earmark another half million for handicapped access. The City of
Schertz wold have to submit to Bexar County a project that 'would
qualify for low income and it would have to be prioritized with
all other city's proj ects. All but about three cities have
agreed to participate or at least have the item on their agendas.
Mr. Sharpe said there is a civic club that wants to participate
in senior citizen housing and asked if this would prevent them 0
from getting a grant. Mr. Lee said no, he didn't believe it
would. Mr. Sharpe also wanted to know if Schertz could present a
project in our ETJ and Mr. Lee said yes.

Mr. Gilmore asked that in the event the city wants to apply for a
grant, could we use the plan in the agreement. Mr. Lee said he
was not a HUD expert but that he would have someone at the next
Council meeting who could answer these questions.
Commissioner Lee said we could only count the two citizen Schertz
has in Bexar County. Mayor Sawyer asked that this be on the next
agenda for consideration.
i3 Mr. Silber to discuss Dietz Creek. Mr. Silber said he
ws aware of problems with drainage of the Dietz Creek. He has
met with Mr. Ed Ford, Mr. Gilmore and the Mayor to establish what
the City requirements are and he could not find a drainage plan
that would work. He said he wanted the City of Schertz to define
what Dietz Creek Drainage is and what the City Council wants to
_ do about it, Perhaps set up a task force to study and come back
with a recommendation.
Mr. Ford said the City has an ordinance that identifies
requirements and all other subdividers have complied.
Mr. Silber said he was aware of the ordinance but it is ambiguous
and they think they could design a plan that would better serve
the City of Schertz and future development. He said there is no
leadership behind the ordinance, the engineer or anything. The
drainage could be done so much better than it is being done if it
had some leadership.
Mr. Ford explained the subdivision ordinance as well as the flood
plain ordinance and said that the only var iable is the channel
itself. .
Mayor Sawyer asked Mr. Silber if he was saying for us not to take
our engineer's advice on projects that are going on in Schertz.
Mr. Silber said that our engineer was/telling it all.

Mr. Sharpe asked if we devise a drainage plan and say this is
what we devise, will you Mr. Silber accept that. Mr. Silber said
he was not going to sign on something that is not competent.
After lengthy discussion, Mr. Ford said if Mr. Silber submits a
plan that has conceptual approval of downstream property owners,
the City would probably approve it. He said he did not see any
prob~ems with a master plan being submitted if all proper owners
are in agreement.
Mayor Sawyer called for a recess at 8:54 p.m.
The Regular meeting was reconvened at 9:00 p.m.
#4 Discussion of request for annexation of 88.9 acres of
land on 135.

Mr. Gilmore explained that we have a letter of request from the
developers to annex the 88.9 acres of land on 13~. This is the
land'Forbes has discussed with Council previously. Mr. Gilmore
said he had talked with Richard Harris and even though this
request is in the area of dispute that is in litigation, go ahead
with the annexation if desired.

Council was presented a schedule of annexation and agreed to go
forward.
.5 Discussion of setting public hearing on Morton-Southwest
rezoning request (ZC '72).
Mr. Gilmore said this request has gone to Planning and Zoning and
they recommend scheduling a public hearing. Council agreed with
the public hearing date presented - September 3, 1985.
i6 Discussion of SAFES write-offs for 2nd quarter of 1984.
Mayor Sawyer said Council has the City Manager's assurance that
the City will continue to pursue collection of these bad debts.
.7 Discussion of vegetation ordinance.
Mr. Gilmore said this ordinance was written and reviewed at the
request of Councilmembers. This is a much clearer ordinance than
the present one and it has been reviewed by our attorney, who 0
finds no fault with it. . .
Mr. Baldwin asked the difference in the old and proposed
ordinance concerning Section IV which states "lot/parcel shall
have their ordinary meaning but shall include, in addition to the
land. within its boundaries, all land adjacent to and extending
beyond the property line to the curb line of adjacent streets"
etc. Mr. Gilmore said the present ordinance just says sidewalk
area, this one clarifies the meaning.
Mr. Sharpe asked if the City could just give a warning ticket for
violations rather than sending a letter. Mr. Gilmore will check
out the law.
MR. GREENWALD BAD TO LEAVE AT 9:24 p.m.
.8 BUDGET WORKSHOP: Mr. Gilmore handed out a letter from
our insuranc'ecarrie'r stating that workmen's compensation was
going to increase probably from 36 to 50% on October 1. This
increase will have to be added to the budget line item. The City
Manager then went over charts showing the estimated revenues.
Using the Appraisal District's estimated values, a 45 cent tax
rate would make it possible for an additional administrative
assistant to be hired. He also went over the estimated
expenditures for General Fund, SAFES and Water and Sewer Funds; rl

administrative assistant. He showed the capitol improvement
items and his proposal for Revenue Sharing Funds.
Mr. Wallenburg and his assistant, Steve, addressed Council
concerning support for R.S.V.P. They introduced Mrs. Sally
Valentine, who is a R.S.V.P. volunteer. They explained that
their organization is a two-fold server: (1) meaningful service
for the community and (2) provides activity for senior citizens.
They asked f~ $500 be included in the budget as Schertz share of
this service to the community.
After Council discussion, Mayor Sawyer said he did not object to
giving to this organization but would not like to see it as a
line item or Council would be besieged with request from other
organizations.
i9 EXECUTIVE SESISON: None needed.
#10 CITY MANAGER'S REPORT: A. Going back to Dietz Creek
and Mr. Silber's discussion, we have had many meetings with these
people and so far, it has cost us $1200.09. We have asked Mr.
Silber to come in with appropriate data - four engineers agree
with Mr. Ford.
B. The New Braunfels Herald reporter interview Mr. Gilmore and
they should have an article in the paper soon.
r- C. We are still working on the Live Oak Road extention. We have
i less than six months to get the information to the Highway
l Department. If they can do the overpass, they will be under way
in less than ten months.
ill ITEMS BY COUNCIL: Mr. Baldwin asked if Barshop has
changed their drainage plan. Mr. Gilmore said that their
retention pond has been shown by several engineers to be the
wrong way to handle drainage. Yes, they have done away with that
theory, the best solution is to go under FM 3009 just above Oak
Forest.

Mr. Stanhope asked how the City's water supply is. Mr. Gilmore
said just great.
Mr. Sharpe said he attended a briefing in San Marcos on a status
report on Edwards and San Antonio water. Somewhere along the
line all municipalities will be asked to support this. The
report should be finished in January of 1986.
Mr. Sharpe said he had talked with Mr. Tschirhardt about the fact
that we are running up a big attorney bill and asked why we don't
take over their whole system. He said he would get back with us
and he never has. Maybe we should get in touch with him in
writing. Mr. Gilmore said Mr. Harris will be bringing David
Jones out to the next Council meeting for a briefing on this.

.12 ITEMS BY MAYOR: On Monday, the 5th, Mr. Thompson has
invited the Mayor to a meeting on the south Randolph annexation.
Mrs. Fenner is ~~ying tbat San Antonio does not protect the RAFB
zone. Mr. Sawyer said that if the City could not get the
frontage on I 10, then we will not annex the area.
Mayor Sawyer asked Mr. Gilmore to start annexation on FM 1518,
500 feet either side but do not include Rittimann addition.
.13 ADJOURNMENT: Mayor Sawyer declared the meeting
adjourned at 11:36 p.m.
