SPECIAL MEETING OF THE CITY COUNCIL
AUGUST 28, 2985
The Schertz City Council convened in Special Workshop Session,
Wednesday, August 28, 1985, at 7:00 p.m. in the Conference Room
of the Municipal Complex, 1400 Live Oak Road, Schertz, Texas.
The following members were present: Mayor Earl W. Sawyer,
presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph
Aguilar and Ken Greenwald. Staff present were City Manager Jimmy
G. Gilmore and City Secretary June G. Krause.
#1 HEARING OF RESIDENTS: Mr. Willman brought up the
possibility of a bond issue, discussed about one year ago, to
seal coat and repair streets. He asked if Council was still
going to go out for bonds. Council discussed the high costs
quoted when this was last brought up. It was suggested that
perhaps Mr. Gilmore could get information on purchasing our own
seal coating equipment and doing the work ourselves.
#2 Discussion of annexations and rezoning of same.

Mr. Sharpe questioned if the metes and bounds in the proposed
annexation of the area on south FM 1518 included any portion of
Randolph Air Force Base; and if so, is it legal for the City to
annex government property. Mr. Gilmore was to check with the
attorney.
#3 EXECUTIVE SESSION: None needed.

#4 CITY MANAGER'S REPORT: A. The John Baines Development,
the area near Forbes on 135, people have been in to discuss
development with Mr. Gilmore. They seem ready to get started.
Mayor Sawyer reported on a meeting with Northcliffe regarding
sewer plant or permits in that area. The State recommends
Schertz go out for a permit on their own and go into a different
type permit - mixture of industrial and residential. The State
said they would work with Schertz any way they can and that we do
not have to go through GBRA at all.
B. Have received a memo from TML on general revenue sharing,
stating it will end next year. Hopefully something will change
before 1986 when it is suppose to terminate.
C. In Council packets there is a letter from Mayor Jones of
Seguin regarding a TML Regional meeting. Council discussed the
need of sending a letter with copy of the resolution on water to
all cities in the region soliciting their support.
D. Have a request from Planning & zoning recommending
modifications to the traffic ordinance. Council discussed the
vari~us recommendations and decided to have further discussion on
this item before putting it on the regular agenda.

E. Received a letter from the Good Shepherd Catholic Church O'\~
requesting a separate meter for lawn care. What they are asking
is against our ordinance. It has been done in the past and posed
problems. Mr. Gilmore said if Council desired to go with their
request, it would require a variance to the ordinance. He said
if Council does this, it should say in the variance that the
water through this meter could only be used for lawn watering.
Mayor Sawyer called for a concensus of Council, which showed the
Council wished to grant the church a variance.
F. The Chamber of Commerce has notified the various cities of
the time and date (7:00 p.m., Thursday, October 10, 1985 at the
Samuel Clemens High School Cafeteria) for the Joint City Councils
Meeting. In the letter they are asking the City to appoint a
coordinator. Mayor Sawyer volunteered for this appointment.
G. The Church World Service has donated $1,142.89 to the
Randolph Area Christian Assistance program. These funds
represent the local allocation requested by the organizers of the
Randolph Area CROP Hunger Walk.
H. Have received a letter from Henry Gutierrez. He is
requesting his permit for temporary building to be extended and
give him the requirements to bring the building in line with the
ordinance. This temporary building is in our overlay district.
After discussion, it was agreed to send him a letter saying we 0
will extend the temporary permit until December 31, 1985 and
there will be absolutely no further extensions given.
is ITEMS BY COUNCIL: Mr. Greenwald handed out copies of
the BVYA report on their recent tournaments. He noted that the
fence was well worth the cost of installation. He related that
BVYA had expressed thanks to the city for help with both
tournaments. They wanted to know if they owed the city any money
for police protection.
Mr. Greenwald said that Planning and Zoning had finished a new
sign ordinance. Hopefully Council will be getting it for review
at the next workshop.
The City had obtained some planning booklets for P&Z that have
very good material in them and Mr. Greenwald asked if we could
get copies for the other Councilmembers.
Mr. Greenwald said that the Schertz-Cibolo Joint Coordinating
Committee have a list of common streets. They now need both
cities to furnish metes and bounds before they can go any
further.
Mr. Greenwald reported that Mr. Allen had agreed to replace Mr.
Peek on this Schertz-Cibolo Joint Committee and that James Harden Dr
was recommended for the secretary of the P&Z. I

The S-C Joint Committee also discussed complaints about Beck
Concrete and the terr ib1e mess their trucks leave on FM 78.
Mayor Sawyer suggested having the police keep a close watch on
that.
Mr. Baldwin asked if copies of the P&Z minutes could be gotten to
the Council sooner.
Mr. Baldwin asked if the Schertz Bank got a permit to do the
parking lot work they are doing, including moving the exit. Mr.
Gilmore said they did.
Mr. Baldwin asked if there was anything new on the traffic light
at Elbel and Jack Hays and the bridge. Mayor Sawyer said we have
been contacting everybody concerned and have been assured that it
would be in by time school starts - if not tell the people to
call the State and CDR.
Mr. Baldwin then discussed some concerns he had about the Schertz
Modular Park. He said insinuations were that construction
started before the plat was approved. Mr. Gilmore said ground
preparation could be started. The water line has to be approved
but does not require a permit. Mr. Baldwin asked about
inspections. Mr. Gilmore said the only thing is that the water
line be sufficient to support fire protection. This is a private
water line in a mobile home park rather than a subdivision. The
r- only thing is that we require a construction plan, adequate fire
lanes and adequate fire protection. Mr. Gilmore said that all we
are involved in is City compliance with ordinances, the rest is a
civil matter between the two parties. As far as Mr. Gilmore can
determine, they have met all requirements of ordinances.
Mayor Sawyer called for a recess at 9:23 p.m.
The Special Meeting was reconvened at 9:30 p.m.
Mr. Sharpe asked if the City has anything in particular they want
to discuss at the Joint City Councils meeting; perhaps discuss
the resolution on the Texas Water bill. Mr. Sharpe proposed that
the City support the Texas Water Bill and have copies of a
resolution available for the other cities to sign at that time.
Mr. Sharpe suggested it is time to again ask the State to reduce
the speed from Live Oak Road to 135 on Jack Hays Boulevard. Mr.
Aguilar agreed and suggested we should include F .M. 78 in our
request. Mayor Sawyer said he had written the letter to Rep.
Kuempel concerning speed on Jack Hays.
Mr. Sharpe said that when last talked about not having sidewalks
at Sabastian Apartments, the developers were given a reprieve for
one year. Mr. Gilmore said he has already talked to them about

Council discussed having the deve'lopers along Jack Hays Boulevard
put money for sidewalks in escrow, and what percentage it should
be. Mr. Gilmore said he would work with Richard Harris on this
problem.
Mr. Sharpe said that City Public Service has said that they will
not furnish service in our city limits unless we use their grid
system for numbering. Mr. Gilmore said he has a meeting set up
with City Public Service representatives next week.
Mr. Sharpe also asked about the new ordinance on excessive false
alarms. Mr. Gilmore said he would have a report for the next
workshop.
Mr. Aguilar discussed some of the department reports - the police
and water particularly. Mr. Aguilar also mentioned about people
stealing water from fire hydrants using pipe wrenches. Mr.
Gilmore said when they can be caught they should be ticketed.

Mr. Aguilar also asked about ticketing in the Animal Control
Department. Mr. Gilmore said we are giving more tickets now
rather than returning animals to owners. Mr. Gilmore said the
new animal control ordinance is almost ready for Council review.
Mr. Aguilar suggested that on the fire department daily report, Of
the Chief use a chart and just check off the different duties as \
completed rather than the long report he is now giving.
Mr. Gilmore reported that Earl Hartzog has' resigned and - that we
are looking for a replacement at present. We have two prospects.
.6 ITEMS BY MAYOR: Mr. Sawyer said that next Friday he is
meeting with Converse to let them know what is going on regarding
the proposed annexation south of Randolph AFB. It seems San
Antonio staff is giving them wrong'information.
Also on Friday he will be meeting with Mr. Wells, who worked with
Marion on their new sewer plant. Will try to get some cost
figures on a plant to give us more ground work for our permit.
Mayor Sawyer said San Antonio has to have a public hear ing in
September on the disannexation and told the people they could
choose the location. They chose our Council Chambers.
