SPECIAL SESSION OF THE CITY COUNCIL
SEPTEMBER 11, 1985
The Schertz City Council convened in Special Workshop Session
Wednesday, September 11, 1985 at 7:00 P.M. in the Conference Room
of the Municipal Complex with the following members present:
Mayor Earl W. Sawyer, presiding; Hal Baldwin; Adolph Aguilar and
Ken Greenwald. Absent were: Charles B. Sharpe and Raymond
Stanhope. Staff were City Manager Jimmy G. Gilmore and Deputy
City Secretary Sylvia C. Taylor.
#1 HEARING OF RESIDENTS
Mr. Bierschwale briefed the Council on the best and proper way to
install the water sprinkler system in accordance to our Ordinance
and providing the best results for both the City and the Good
Sheperd Catholic Church.
Mrs. Liz Muller stated that some over-grown branches on Randolph
Avenue and Maple were blocking the street signs, as were branches
on Randolph Avenue and Aviation causing children to walk on the
street on their way to school.

Mr. Gilmore informed Mrs. Muller that the situation would be
remedied.
#2 Discussion of Transfer 'of Appropriations
Mr. Gilmore stated that the transfer of appropriation was needed
due to growth and due to overtime approved by the Council for the
Police Department, as well as Streets and Parks.
Mr. Aguilar inquired as to what items when under Miscellaneous
Incomes.
Mr. Gilmore stated that rental of City machinery and charges for
Ordinances when into Miscellaneous Incomes.
Mr. Aguilar asked why the swimming pool revenue was so low. Mr.
Gilmore stated that the season passes did not do to well this
year.
Mr. Baldwin asked if any long distance service was being used by
the City; Mr. Baldwin suggested LDS due to their low rates. Mr.
Gilmore stated that two systems were being considered since the
present system needed to be upgraded.
Mr. Sharpe arrived at 7:50 P.M.

#3 Discussion of animal control ordinance

After deliberation the Council agreed to make the following
changes to the proposed ordinance:
Article I: Public Nuisance to read as follows:

Article III: Section II
paragraph 2 to read as follows:
Dogs and cats must wear identification tags or collars at
all times when off the premises of the owners. It shall be the
duty of the owner of any animal to procure a duplicate tag from
the animal control officer in the event that the original tag is
lost or destroyed. There will be a fee of 50% of fee charged in
article XI for each replacement tag.
License acceptance and use
Article IV:
Section II Care to read as follows:
5. Only a licensed veterinarian shall crop a dog's ears.
6. Only a licensed veterinarian shall dock, clip, or cut
a dog's tail.
7 & 8 delete
12. The owner of every animal shall be responsible for
the removal of any excretion deposited by his n
anima1(s). Failure to do so, shall be a violation of U
this ordinance.

5. The owner of an animal that is quarantined under this
ordinance shall pay the City of Schertz the cost of
the quarantine and disposition of the animal. The
Animal Control Facility may sell and retain the
proceeds, keep ,grant, or euthanize an animal that
the owner or custodian does not take posession of on
or before the seventh (7th) working day following the
end of the quarantine period.

A license shall be issued after payment of the Standard fee of
$7.00.

#4 Discussion of Zoning Change #72
Mr. Aguilar suggested the change be reworded to say at least an
equal size.
Council suggested that P&z agreeldisagree to a change without
provisions.
Mr. Sharpe stated that too many small size lots were being
allowed and there should be more of a mixture as stated on PUD.
Mr. Gilmore informed Council that a study done on sale of land
revealed that people in our area cannot afford large lots. Mr.
Greenwald added that a survey done by P&Z revealed there were
still about 100 R-1 lot available within the City.
Council requested review of PUD be scheduled for next special
session.

#5 Discussion of appointment to Planning & Zoning Commission
NONE needed.
#6 Discussion of amendments to the traffic control ordinance
Council suggested a list be made containing street improvements
that are being made and anyone (police officers, street
personnel) noticing improvements that need correcting report them
to the proper department immediately.
Council requested more information on the traffic control
ordinance change dated August 16, 1985 (Stop vs Yield, 4-Way
Stop, Mandatory Left Turn, and No Parking) before deciding on
this portion of the change request.
#7 Executive Session NONE needed.

#8 City Manager's Report
Mr. Gilmore asked Council if city should go out for bids for a
new garbage collector or if the city should continue to use Waste
Management; the cities contract with Gutierrez expires at the
end of this month. Gutierrez plans to increase the rates.
Council suggested an extention to Gutierrez's contract until
proposed increase is reviewed. Mr. Gilmore stated that he is to
meet with Mr. Gutie~rez Tuesday to dlscuss the proposed increase.
Mr. Gilmore will report findings to Council Tuesday at the
Council meeting.

Mr. Gilmore asked those planning to attend the TML Regiona.L
Meeting is Seguin on September 27. 1985 please notify us as soon
as possible. Council suggested department heads also attend this
meeting.

Mr. Gilmore asked if a proclamation could be present to the SAFES
EMS in recognition of "Medical Service Week" which is September
29 - October 5. Council agreed unanimously.
Several members of P&Z have volunteered to enforce the Sign
Ordinance by confiscating signs that have not be approved by the
City. Gilmore will check into the legality of this project before
signs are confiscated.
San Antonio Jaycees awarded Russell Bundy and James Keith plaques
for Outstanding Municipal Policemen.
Developer looking at property in front of Northcliff, inside of
Northcliff entrance, asking if area is going to be zoned
Commercial since area surrounding them is zoned Commercial, he
cannot ask for rezoning because he does not own the property.
Council agreed to rezone area. Necessary steps for rezoning will
be taken.
Developer, in the same area, wants Council to rezone property.
The front part and portion of the back of his property is in the rill
City and is zoned commercial. Developer was told to come in and LJ
petition the Council to annex the center portion, then Council
would consider zoning.
Incident involving Officer MacSorley could have been worse but
due to the professionalism of both the Universal City and
Schertz Police Officers the incident was minimized. A letter has
been mailed to Mayor Barnard commending the professionalism of
his officers. Officer MacSorley is doing fine he will be kept
overnight for observation. There was one complaint by Mary
Delafuente because her child was not notified about the incident
and was not allowed in the area to return home from school.
#9 Items by Council
Mr. Aguilar requested information on the cost of a bronze plaque
for the library, as well as name of retailers.
Mr. Baldwin stated the San Antonio Light had an article on the
level of the Aquifer. Mr. Baldwin suggested the need to make
arrangements for surface water since the Aquifer is being drained
of its supply. Mayor Sawyer commented that the only surface
water available was Lake Dunlap. Mr. Gilmore stated that another
alternative was sewer water.

Mr. Baldwln remarked on an incident in Randolph where SAFES EMS
would not go on base to pick-up a patient. Mayor Sawyer
explained that Randolph would not pay the per capita charge for
the SAFES EMS service therefore they were not entitled to it.
Mr. Baldwin suggested the public be notified that they cannot
have SAFES EMS pick them up on Randolph. Mr. Sharpe suggested
another meeting with the Base Commander to try and resolve this
situation.
Mr. Baldwin announced that school enrollment was up.
Mr. Sharpe suggested a resolut ion be wr itten in support of the
Texas Water Bill.
Mr. Greenwald suggested a plaque be presented to Dawin Peek for
his service to the P&Z.

Sawyer adjourned the meeting at 11:30 p.m.
