SPECIAL MEETING OF THE CITY COUNCIL
SEPTEMBER 25, 1985
The Schertz City Council convened in Special Workshop Session,
Wednesday, September 25, 1985, at 7:00 p.m. in the Conference
Room of the Municipal Complex, 1400 Live Oak Road, Schertz,
Texas. The following members were present: Mayor Ear 1 W.
Sawyer, presiding; Charles B. Sharpe; Ray Stanhope; Adolph
Aguilar; and Ken Greenwald. Absent: Councilman Hal Baldwin.
Staff present were Jimmy G. Gilmore, City Manager and June G.
Krause, City Secretary.
#1 HEARING OF RESIDENTS: There were no residents wishing
to be heard.
#2 Discussion of propsed rate change by Waste Management.
Mayor Sawyer asked to delay this item until Mr. Gutierrez,
Manager of Waste Management arrived.
#3 Discussion of variance as requested by Good Sheperd
Church.
Mr. Gilmore said this request has been withdrawn as staff was
able to work out the problem with the church.
#4 Discussion of variance as requested by San Antonio Shoe
Company.
Mayor Sawyer explained that San Antonio Shoe Company is
requesting a variance in order to use cedar shakes on the roof of
their new building going up on I 35.
Mr. Gilmore said they are going into the retail sales and the
shakes would help to make the building authenic looking as far as
the log cabin concept goes. We do have an ordinance prohibiting
the use of cedar shakes, and have asked the Fire Chief to give
his comments on this request.
Chief Melton said the main reason for prohibiting cedar shakes in
the ordinance was because of residences and apartments. Where
this building is located, we should not have too much trouble.
However, if the var iance is granted, we will be having others
come in for a var iance. Both Dallas and Houston have outlawed
these shakes. Mr. Melton said he understands that a company on I
35 can make any type shingle to look like the authentic shakes
requested. The cedar shakes would have to be treated every so
often to stay effective to be fire retardent.
After discussion by Council, Mayor Sawyer said he was getting a
concensus that Council did not want to grant the variance. He
suggested wr iting San Antonio Shoe Company telling them that
Council is concerned about the fire hazard and ask them to
investigate other types of shingles.

#5 Discussion of proposed annexation of 88.9 acres out of
Comal County.
Mr. Gilmore said this is the area requested for annexation by
Forbes and will be on the next agenda for final reading of the
ordinance for annexation.
#6 Discussion of proposed annexation of 83.22 acres out of
Bexar County.
This is the area along FM 1518 going toward Shermerville. The
second public hearing on this proposed annexation will be held at
the next regular meeting.

Mr. Gilmore said he has had people ask why we are not annexing
them also. He said perhaps the Council would do some more
annexing in this area at a later date.
Mayor Sawyer said of course the reason for this annexation is to
be contiguous to the Shermervi1le area in order to annex if San
Antonio disannex the area. The residents will get more
advantages than water from the annexation as the City will have
more control as to what goes in along FM 1518.
Mr. Sharpe asked if the city limits line goes through a house,
then that house does not have to pay taxes. Mr. Gilmore said
that is what he has been told. Mr. Sharpe said then they should
not get city water rates.
Mayor Sawyer asked to return to item #2 as Mr. Henry
Gutierrez had arrived for discussion.
#2 Discussion of proposed rate change by Waste Management
of San Antonio.

Mr. Gilmore said that Mr. Gutierrez sent a letter outlining
several items to be incorporated into the contract: (a) the
city to have'access to the Gutierrez landfill at no cost (b) at
the time of closure of the present landfill site, another site
will be available to the city (c) contractor will provide small
refuse containers for the city at no cost (d) the contractor will
provide refuse containers to special events of city at no cost
and (e) a temporary open-top container accessible to residents of
city will be provided for the annual Spring Cleanup at no cost.
Mr. Gutierrez went into more detail on the above listed items.
He said they are asking for a 6% increase for residential rates
and 10% increase for commercial rates. Also with the addition of
a truck to his fleet, service has improved considerably. Mr.
Gutierrez said Cibolo's rates are $5.25, Universal City's are
$5.36 and Live Oak pays Garbage Gobbler $5.34 per month.

Mr. Gilmore reminded Council that other cities do not have the
additional benefits outlined in Mr. Gutierrez I s letter. Mr.
Gilmore asked if Council had any stipulations on a five-year
extension, with no rate increases for twelve months. Rate
increases after that would have to be renegotiated with Council.
Council agreed.

Mayor Sawyer asked for this to be on the next agenda.
Sawyer then called for a recess at 7:22 p.m.

The Special Meeting was reconvened at 7:31 p.m.
#7 Discussion of amendments to the traffic control
ordinance.
Council had no changes or further discussion since the first
reading of the ordinance.
i8 Discussion of proposed animal control ordinance.
Mr. Krause explained that for easier administration of the
ordinance, the fees were removed from the body of .the ordinance
and placed as exhibits.
Mr. Stanhope asked about Section VI Redemption. Mr. Gilmore said
that was state law.
Mayor Sawyer said he had heard two complaints. First - the fees D
are too high and second - the shelter people say they have been
told not to attend the Humane Society meetings. Mr. Sawyer said
that we must tell our Animal shelter people that they are
enforcers and must enforce this ordinance whether they like it or
not.
Mr. Gilmore said our people met with the Judge and discussed how
to write tickets, how to present cases, etc.
Mr. Gilmore said we have received a letter from the state saying
that Betty-Ann Kent has been scheduled to teach some classes. We
are sending her to another school and if she passes, she will be
the only one in the San Antonio area with this certificate.
19 Discussion of proposed renaming of E. Live Oak Road.
Mayor Sawyer mentioned that this road has just been paved and and
is really nice but it is really easy to speed.
Council discussed several different ways East Live Oak Road could
be named using existing streets. The final concensus of the
Council was to leave the name East Live Oak Road inside our city
limits. Also to name the road from FM 3009 to Dobie School
"Elbel Road" and the old Borgfeld Road should be called "Dietz D
Road" . Mayor Sawyer suggested taking these suggestions back to
the Schertz-Cibolo Joint Coordinating Committee for comments.

#10 Discussion of variance as requested by Gencraft Homes.
Mr. Gilmore explained their request for a sign permit to display
10 directional signs. They really do not need a variance because
this is covered by ordinance and they will abide by the
ordinance. Mr. Greenwald said this had gone to Planning and
Zoning and they had no problem with it as it is in the ordinance.
#11 EXECUTIVE SESSION: None needed.
#12 CITY MANAGER'S REPORT: A. Mr. Gilmore said he wanted
to put on the next agenda a resolution abandoning that portion of
Doerr Lane that is no longer there. We need a signed resolution
and a quitclaim deed.
B. The City has received a 'Certificate of Conformance' again
this year on our audit. We should be getting a plaque and
certificate soon. Only three percent of the cities our size in
the United States get these certificates.
C. Have received a letter from the President of the Board of
Trustees of the School District requesting that they be allowed a
no-fee permit for health inspections of the schools. Mr. Aguilar
said he felt they should pay for it, as did Mr. Greenwald and Mr.
Stanhope. Mr. Sharpe suggested checking with Universal City to
see if they charge for Rose Garden School so that we can be
consistant.
D. We have received a petition for annexation of 34.5 acres in
Comal County from Henry Bain Engineers. This is in the area next
to the last request on I 35 we are processing now.
E. Mrs. Krause received a thank you letter from Thomas Darcy
that gives a little history of the City of Schertz.
F. Mr. Gilmore handed out some literature on housing density.
G. As requested by Council have invited all department heads to
attend the regional meeting of TML in Seguin.
H. We have everything off the L9000 computer and now would like
to get it out of the building. No one wants to buy it or even
take it off our hands because of maintenance costs and the
problem of getting parts. Council concensus was to get rid of it
however possible.
I. We are acquiring more drainage ditches than we can take care
of. We will need some equipment in the near future. Just
advance notice of need.
J. The school district is selling some surplus land at FM 1518
and Curtiss, next to Walter Schertz. Beacon deadends right
there. There is a stubout that can never go anywhere. Do you

want to vacate or sell it, it is no use to the city. With
Council permission the City Manager said he would try to sell it.
K. Mr. Gilmore said he forsees some problems for SAFES in the
very near future with the Executive Director. His health is not
the best and he is running day and night. In the event that we
lose his services as an attendent, would like to maintain him as
Executive Director without any ambulance runs. We may have to
pay those people who are on twelve hour nighttime standby. There
are two ways it could be done. Pay a flat rate for standby or
per call. We are working on getting on the Seguin budget now.
Seguin EMS gets $300,000 - city $150,000 and county $150,000. If
we back out of the county, is Seguin going to operate down here?
Right now SAFES is a non-profit organization with cities
participating and I would like to keep it going that way.
Mr. Sharpe asked if staff could get the number of county citizens
we serve and the number Seguin serves in the county. Mr. Sharpe
also discussed the possibility of having an ambulance located in
Universal City as well as Schertz.
Mr. Aguilar asked if the City Manager had heard anything further
from Randolph on ambulance service. Mr. Gilmore said he had not.

Mayor Sawyer said to tell Randolph that we are concerned about
our citizens who visit and work at Randolph. Tell them that we
are not adverse to giving free service if they will back us up U"
when necessary.
#13 ITEMS BY COUNCIL: Mr. Greenwald reported on a meeting
he attended in Seguin on Indigent Health Care and the
responsibilities of counties with public hospitals. He said that
after the meeting he talked with Mr. Ritchie and asked him to
send us copies of their budget and minutes. The better informed
we are and can pass the information on the the citizens, the
better off we are going to be. Mr. Walter Schneider is on the
Board and said he would be glad to brief Council at any time.
Mayor Sawyer suggested that if Council needs a briefing, it would
be better to have Mr. Ritchie come down.
Mr. Greenwald said that the Lone Star Ice House had said that if
they' have to conform to the overlay they could not afford to
build. However Lone Star has now come in with plans that do
comply with the overlay.
Mr. Greenwald had investigated about the New Braunfels Herald and
said the only way our citizens could obtain the paper was through
mail subscriptions.
Mr. Greenwald also suggested sending letters of congratulations
to the new Buffalo Valley Youth Association board members.
Mr. Stanhope asked who is suppose to take care of mowing grass
along FM 78. Mr. Gilmore said the state does that and they are
scheduled to take care of it through Schertz this week.

Mr. Sharpe also reported on the Business Club meeting. They
voted to give $1,000 to the Volunteer Fire Department for the
building at the pavilion; the Christmas tree lighting will be on
December 5th; they discussed improving bathroom facilities in the
park; and need the information on the next Employee of the
Quarter.
#14" ITEMS BY MAYOR: Mayor Sawyer said Mr. Sharpe, through
the Chamber of Commerce, had helped to arrange some Japanese
business men to be in New Braunfels. The Mayor and Mr. Sharpe
will be going to meet with them.
Mr. Sawyer said he had talked with Rep. Kuempel about the traffic
light at Elbel and Jack Hays. Mayor Sawyer said he had noticed
that Randolph is getting a light so he told Mr. Kuempel that the
people on Randolph do not vote in Texas elections. He also told
Mr. Kuempel about the resolution on water and that all citizens
of a municipality should be able to get water from the city in
which they live.
#15 ADJOURNMENT: Mayor Sawyer declared the meeting to be
adjourned at 10:25 p.m..
