BOA 01-05-2004 (, { ~\ BOARD OF ADJUSTMENT MONDAY, JANUARY 5, 2004 MINUTES The Schertz Board of Adjustment convened a public hearing on Monday, January 5, 2004 at 6:30 P,M. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. BOARD OF ADJUSTMENT Earl Hartzog, Chairman Ted Duigon, Vice Chairman Norman Slocum Kathy Hill MEMBERS ABSENT James C. Harden Joe Potempa William Sommers CITY STAFF Leonard Truitt - Building Official Debbie Perrone, Recording Secretary OTHERS PRESENT Robert Brockman Mr. James Russell 1. Call to Order/Roll Call Chairman Hartzog called the meeting to order at 6:50 P.M. 2. Approval of the Minutes: Consider and take action on approval of the December 8, 2003 minutes from the Board of Adjustment meeting. Following review, Ms. Hill moved to approve the Minutes of the December 8, 2003 Board of Adjustment meeting. Mr. Slocum seconds the motion. Motion carried. Vote unanimous. 3. Public Hearing Comments from Citizens There were no comments from citizens. 4. Discuss and Take Appropriate Action: Mr. James D, Russell is requesting a variance to the rear yard setback Block: 12, Lot: 13 of Carolina Crossing # 6, (3612 Augusta Glade). The request is to encroach 5 Yo-feet into the rear yard setback to allow for a 14' x 27' deck (BOA 199-03). Mr. Duigon made a motion to approve Mr. James D. Russell to encroach 5 Yo-feet into the rear yard setback to allow for a 14' x 27' deck (BOA 199-03). Ms. Hill second the motion. A vote was called. All were in favor. The motion carried, Joe Potempa had driven by the property listed above and reported back that he saw no problem with the project. There is no drainage problem with the deck being built. j. (, (' " 5, Update the Board on Planning and Zoning Activity Mr. Truitt updated the Board on the up coming Super Wal-Mart to be located on the property adjacent to Wendy's on FM 3009. There would be access to Wal- Mart from both FM 3009 and IH 35. Re-zoning of 192.48 acres for a subdivision along Ware Seguin Road. Re-zoning of property adjacent to Norma Paschal Elem. School. Annexation of 655 acres up the other side of Northcliffe. Discussion only. No action taken, Mr. Duigon made a public comment that the letter that is sent out to the neighboring property owners should be updated. This is under revision by the staff. BOA board made a suggestion that staff come up with three alternative procedures for a more timely process for a variance request. Staff recommended that this request be placed on the next BOA agenda. 6.
