BOARD OF ADJUSTMENT MONDAY, MARCH.24,2003 MINUTES The Schertz Board of Adjustment convened a public hearing on Monday, March 24, 2003 at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. BOARD OF ADJUSTMENT Earl Hartzog, Chairman Ted Duigon, Vice Chairman James C. Harden Kathy Hill Joe Potempa William Sommers, Planning and Zoning Commissioner CITY STAFF Leonard Truitt, Building Official Misty Nichols, Recording Secretary MEMBERS ABSENT None OTHERS PRESENT Robert Brockman, 4505 Grand Forrest Dave Martin, Benchmark Homes Deborah Bell, 3325 Sherwin 1. CALL TO ORDER: Chairman Hartzog called the meeting to order at 6:30 p.m. 2. Approval of minutes: No action taken on this item. 3. Public Hearing: On a request from Tom Chapman of Benchmark Homes for a variance at 4300 Golden Oak, in Oak Trails Subdivision for a special exception to the Zoning ordinance requesting to encroach into the front yard setback from 25' to 20'. 3" on a previously constructed house. (BOA #189-03) Mr. Truitt reviewed the request with the Board stating the variance is for a 4.7' encroachment on a front building setback. He stated the home was constructed and the title company found this error upon final survey of the property. Mr. Brockman and Mr. Martin were present to address this issue and answered questions with regards to the driveway. There being no one else to speak on this matter, Chairman Hartzog closed the Public Hearing. 4. Public Hearing: On a request from Deborah Bell, at 3325 Sherwin Dr. in the Northcliffe Subdivision, for a variance to encroach into the side yard setback one foot, eight inches to construct a bay window. (BOA 190-03) Mr. Truitt reviewed the request and stated the applicant is requesting a variance to the side yard setback for the installation of a bay window. There being no one else to speak on this matter, Chairman Hartzog closed the Public Hearing. 5. Consider And Take Appropriate Action: Chapman of Benchmark Homes. On the above request from Tom Following review and discussion from Mr. Duigon regarding the home builder pay attention to detail, Mr. Potempa moved to approve the request for a reduction in the front building setback to 20'-3". Ms. Hill seconded the motion. Motion carried. Vote unanimous. 6. Consider And Take Appropriate Action: Bell at 3325 Sherwin Dr. On the above request from Deborah Following review and discussion, Mr. Potempa moved to approve the request for a reduction in the side yard setback to 4'-4". Mr. Harden seconded the motion. Motion carried. Vote unanimous. 7. ITEMS BY THE BOARD AND CITY PLANNER: No discussion on this item. 8.
