12-16-2002 , of ~ ; BOARD OF ADJUSTMENT MONDAY, DECEMBER 16,2002 MINUTES The Schertz Board of Adjustment convened a public hearing on at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Texas. BOARD OF ADJUSTMENT Earl Hartzog, Chairman Ted Duigon, Vice Chairman James C. Harden Joe Potempa William Sommers, Planning and Zoning Commissioner CITY STAFF Ron Youngblood, City Planner Misty Nichols, Recording Secretary MEMBERS ABSENT Kathy Hill OTHERS PRESENT 1. CALL TO ORDER: Chairman Hartzog called the meeting to order at 6:30 p.m. 2. APPROVAL OF MINUTES: Following review, Mr. Duigon moved to approve the Minutes of the September 23, 2002 and the November 25, 2002 meetings. Mr. Harden seconded the motion. Motion carried. Vote unanimous. 3. PUBLIC HEARING:On a request from Mr. & Mrs. Flores at 709 Mitchell Avenue for a special exception to the Zoning Ordinance to encroach into the side yard setback from 5 feet to 0 feet to construct a carport cover. (BOA # 187-02) Mr. Youngblood reviewed the request with the Board and stated that 33 letters had been sent to surrounding property owners. The City had received ten letters in favor and one letter in opposition of the request. Mr. Youngblood stated the Planning and Zoning Commission and City Staff recommend approval of the request to reduce the side yard set back to 0'. There being no one else to speak on this matter, Chairman Hartzog closed the Public Hearing. 4. CONSIDER AND TAKE APPROPRIATE ACTION: On the above request from Mr. & Mrs. Flores at 709 Mitchell. (BOA # 187-02) Following review and discussion regarding size of the cover (18' by 32'), explanation of the UDC, Mr. Harden moved to approve the request to reduce the side yard setback to 0' to allow for a carport cover. ITEMS BY THE BOARD AND CITY PLANNER: Staff stated that no applications have been submitted and the next earliest meeting could be in February, 2003. Commissioner Sommers suggested workshops with the Planning and Zoning Commission and the Board of Adjustment to update the UDC. Board Members agreed. Board Members wished each other Happy Holidays. 6.
