Board of Adjustment Monday September 23, 2002 The Schertz Board of Adjustment convened in a public hearing , 6:30 p.m. in the Municipal Complex at Council Chambers, 1400 Schertz Parkway, Schertz, Texas. BOARD OF ADJUSTMENT Earl Hartzog, Chairman Ted Duigon William Sommers, Planning Commissioner Peggy Brown James Harden Norman Slocum CITY STAFF Ron Youngblood, City Planner Misty Nichols, Recording Secretary MEMBERS ABSENT Kathy Hill Joe Potempa OTHERS PRESENT Robert Brockman, 4505 Grand Forrest John Fluke 205 Oakside Tracy Young, 1677 Osage Lane Glen Ruhl, 2512 Cove Brook #1 Call to Order: The meeting was called to order at 6:30pm. #2 Approval of Minutes: Minutes were approved for July 22, 2002 and August 26, 2002. Mr. Duigon stated he reviewed both sets of minutes earlier and turned the corrections in to the secretary for revisions. He moved to approve the minutes as amended. Mr. Harden seconded the motion. A vote was taken. The motion was approved unanimously. Mr. Harden asked to receive future Planning and Zoning Agendas in order to look ahead at what items The Board of Adjustment will be considering. #3 Public Hearing: On a request from Mr. John Fluke, Lot 3 Block 1, in the Greenshire Estates Subdivision, to encroach into the side yard setback from 7.5 feet to 5'. 5" feet for construction of his home. (BOA# 185-02) Mr. Youngblood stated that staff has no concerns. The Planning and Zoning Commission has forwarded this request with a recommendation of approval. There were six letters sentand none were opposed. and two were in favor. In addition, Mr. Fluke presented additional letters received during the Planning and Zoning meeting from area neighbors and the HOA president who stated they have no problem with this request. Chairman Hartzog asked if this home is already existing on this lot. Mr. Youngblood stated that no structures are on this lot. 1 .. , #4 Public Hearing: On a request from Mr. Ruhl at 2512 Cove Brook, Block 24, Lot 7 in the Woodland Oaks Subdivision, to encroach into the front yard setback from 25 feet to 21 feet two inches on his already constructed home. (BOA # 184-02) Mr. Youngblood stated there were 17 letters sent. All 17 were in favor of the request. This is a unique. This house is existing, and until Mr. Ruhl proposed to sell his home, he did not know his house was encroaching on a setback. Mr. Ruhl is trying to make this right so any future owners will not run into the same obstacles. Mr. Brockman asked the name of the builder of this home. Chairman Hartzog stated that Pulte is the builder of this home, although this problem seems to be a City Inspector's oversight. #5 Public Hearing: On a request from Mr. & Mrs. Mike Young, 1677 Osage Lane, Greenshire Subdivision, for an exception to the UDC to encroach into the side yard setback from 7 feet six inches to 5 feet, for the construction of an attached garage. (BOA # 183-02) Mr. Youngblood stated that 24 letters were sent: Five were in favor and one opposed. Staff has no issues with this request. The Planning and Zoning Commission forwarded a recommendation for approval. #6 Consider and Take Appropriate Action: On the above request from Mr. Fluke (BOA # 185-02). Chairman Hartzog asked if there were any comments or questions. Mr. Duigon stated that the letter in the packet noted that the Planning and Zoning Commission approved the request. He mentioned that the Planning and Zoning Commission should make recommendation to the Board of Adjustment. Mr. Harden moved to approve the request from Mr. Fluke. Mr. Duigon seconded the motion. A vote was taken. The motion carried. #7 Consider and Take Appropriate Action: On the above request from Mr. Ruhl. Mr. Harden moved to approve the request from Mr. Ruhlat 2512 Cove Brook, Block 24, Lot 7 in the Woodland Oaks Subdivision, to encroach into the front yard setback from 25 feet to 21'.2" feet on his already constructed home. (BOA # 184-02) Norman Slocum seconded the motion. A vote was taken. The motion carried. #8 Consider and Take Appropriate Action: On a request from Mr. & Mrs. Mike Young, 1677 Osage Lane, Greenshire Subdivision, for an exception to the UDC to encroach into the side yard setback from 7'. 6" to 5', to build an attached garage. (BOA # 183-02) Mr. Harden stated that he felt the garage would not affect any neighbors since there is a drainage ditch next to the property. Mr. Duigon moved to approve the request from Mr. & Mrs. Young at 1677 Osage Lane. 2 , '.. Mr. Harden seconded the motion. A vote was taken. The motion carried. #9 Items by Board and City Planner: Mr. Youngblood thanked Mr. Duigon for rearranging his schedule to make the meeting. Mr. Duigon mentioned that the letters that are sent to citizens after a Planning and Zoning meeting should state that The Planning and Zoning Commission forwards a recommendation of approval or disapproval to The Board of Adjustment. Mr. Hartzog stated the next meeting is tentatively scheduled for October 28, 2002. #10 Adjournment: The meeting adjourned at 7:00p.m. ATTEST: 3
