07-22-2008 MINUTES REGULAR MEETING July 22, 2008 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on July 22, at 6:30 p.m., in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present, to-wit: Mayor Hal Baldwin Council Member Jim Fowler Council Member John Trayhan Mayor Pro-Tern Tony Wilenchik Council Member David Scagliola Council Member Michael Carpenter Staff Present: City Manager Don Taylor City Secretary Brenda Dennis Assistant City Manager John Bierschwale CALL TO ORDER REGULAR MEETING Mayor Baldwin called the meeting to order at 6:30 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Council Member Carpenter gave the Invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. . HEARING OF RESIDENTS Mayor Baldwin recognized the following: . Rosemary Grayson, 5213 Cabana Drive spoke on changes to the Comprehensive Land Plan. . Allen Richmond, 5701 Crooked Stick spoke on Northcliffe Golf Course zoning. . Elaine Carr, 5202 Cabana Drive spoke on concerns to Mobile Villa Estates. . Steve White, EDC Chairman spoke on the Sweetheart Program. Council General Announcements: Mayor Pro-Tem Wilenchik . None Council Member Carpenter . None City Council Regular Meeting July 22, 2008 219 Council Member Fowler . Mentioned he attended the CPS Energy Strategic Planning meeting Thursday, July 17, 2008 and also attended the AACOG workshop for planning commissioners, elected officials in San Antonio on Friday, July 18,2008. Council Member Scagliola . Mentioned he received several calls and emails regarding the "For Sale" sign at Northcliffe Golf Course and stated he brought it to the attention of the City Manager, who is working on possible options on this issue. Council Member Trayhan . None Items by Mayor . Announced that last Thursday, the Historical Preservation Commission gave a presentation on the arrival of the German Immigrants to South Texas and that it was a very interesting piece of information. PRESENTATION . Presentation on a City of Schertz Float (S. White) Mayor Baldwin recognized Economic Development Chair Steve White who introduced this item answering questions from Council. Mr. White indicated that at the next meeting he would be bringing an action item regarding purchasing a City of Schertz float. REGULAR AGENDA 1. Minutes - Consideration and/or action regarding the approval of the minutes of the Regular Meeting of July 15,2008. Mayor Baldwin recognized Council Member Trayhan who moved, seconded by Council Member Scagliola to approve the minutes of July 15, 2008. Vote was unanimous. Motion Carried 2. Bid A ward- Consideration and/or action awarding a bid to Centuries Industries for a Showmaster 3000 Series portable stage. (G. Logan/S. White) Mayor Baldwin recognized Economic Development Chairman Steve White who introduced this item answering questions from Council. Mayor Baldwin recognized Economic Development Specialist Erin Matlock who also came forward answering questions from Council. City Council Regular Meeting July 22, 2008 220 Mayor Baldwin recognized Mayor Pro-Tern Wilenchik who moved, seconded by Council Member Fowler to award a bid to Centuries Industries for a Showmaster 3000 Series Portable stage. Vote was unanimous. Motion Carried. 3. Ordinance No. 08-E-34 - Discussion and consideration and/or action approving Ordinance No. 08-E-34 calling a Home Rule Charter Amendment Election to be held in the City of Schertz, Texas on November 4, 2008, making provision for the conduct of the election; and resolving other matters incident and related to such election. (Council) Final Reading As there were no changes since first reading, Mayor Baldwin recognized Council Member Carpenter who moved, seconded by Council Member Trayhan to approve Ordinance No. 08-E-34 final reading. Vote was unanimous. Motion Carried. 4. Ordinance No. 08-M-35 - Consideration and/or action approving an Ordinance prohibiting drilling and mining for nonrenewable resources or the reopening of any abandoned well or mine with the exception of water wells in any public park located within the City limits of Schertz, Texas. Final Reading (G. Logan) Mayor Baldwin recognized Parks and Recreation Director George Logan who introduced this item stating that no changes had been made since the first reading. Mayor Baldwin recognized Council Member Carpenter who moved, seconded by Council Member Trayhan to approve Ordinance No. 08-M-35 final reading. Vote was unanimous. Motion Carried. 5. Ordinance No. 08-M-38 - Consideration and/or action approving an ordinance imposing a 120-day moratorium on the issuance of permits for building and installing certain telecommunication antennas and towers for entities other than the City. First and Final Reading (T. Rhodes) Mayor Baldwin recognized Planning Manager Thomas Rhodes who introduced this item answering questions from Council. Mayor Baldwin recognized Council Member Trayhan who moved, seconded by Council Member Carpenter to approve Ordinance No. 08-M-38 and declaring an emergency. Vote was unanimous. Motion Carried. PUBLIC HEARINGS AND ORDINANCE APPROVAL 6. Ordinance No. 08-S-36 - ZC 2008-007 John Paul II Catholic High School - Conduct a public hearing and consideration and/or action upon a request to rezone 52.391 +/- acres ofland out of the F. Rodriguez Survey No. 99, Abstract No. 484, City of Schertz, Comal County, Texas from Manufacture District - Light (Ml) to Public Use District (PUB) located at the southeast intersection of FM-482 and Friesenhahn Lane. First Reading (T. Rhodes/M. Nichols) City Council Regular Meeting July 22, 2008 221 Mayor Baldwin recognized Planning Manager Thomas Rhodes who introduced this item answering questions from Council. Mayor Baldwin opened the public hearing and recognized the following who spoke in favor of this item: . Sister Carla Marie Lusch, Superintendant of the Archdiocese; Mr. Alex Arriaga, School Council; Mr. George Antuna, Economic Development Director; Robert Brockman, 1000 Elbel Road. Mayor Baldwin recognized Ms. Joan Blanchard who spoke on traffic problems and opposition to having the high school in this area. Mayor Baldwin also recognized Mr. David Richmond, Planning and Zoning Chairman, who spoke against the high school location and suggested they find a different location. Council Members expressed their concerns and view on this issue and it was the consensus of the Council that this is a great opportunity for the City of Schertz. Mayor Baldwin recognized Council Member Trayhan who moved, seconded by Council Member Carpenter to approve Ordinance No. 08-S-36 first reading. Vote was unanimous. Motion Carried. 7. Ordinance No. 08-S-37 - SUP2009-003 Windy Meadows Subdivision - Conduct a public hearing and consideration and/or action upon a request for a Specific Use Permit (SUP) for 1.0 +/- acres of land out of the Toribio Herrera Survey, Abstract No. 153, Guadalupe County, and Schertz, Texas being Lot 25, Block 2 of the Windy Meadows Subdivision to allow indoor boarding kennels in the Air Installation Compatible Use Zone (AICUZ) Accident Potential Zone - 1 (APZ-l) located approximately 370 +/- feet east of the intersection of FM-1518 and Windy Meadows Drive. First Reading (T. RhodeslM. Nichols) Mayor Baldwin recognized Planning Manager Thomas Rhodes who introduced this item answering questions from Council. Mayor Baldwin opened the public hearing and recognized Mr. Dale Elam the applicant who addressed the Council. As no one else spoke, Mayor Baldwin closed the public hearing. Mayor Baldwin recognized Council Member Trayhan who moved, seconded by Council Member Carpenter to approve Ordinance No. 08-S-37 first reading. Vote was unanimous. Motion Carried. ANNOUNCEMENTS - CITY MANAGER AND STAFF . General Announcements on meetings/events attended and upcoming events City Council Regular Meeting July 22, 2008 222 Mayor Baldwin recognized City Manager Don Taylor who reminded the Council of the second annual elected official's reception tomorrow evening at Olympia Hills Conference Center, 6:00 p.m. Mr. Taylor also announced that he has made a change and placed Animal Control under the "direction of George Logan.
