01-08-1985 e e ~ } PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in a regular session on Tuesday, January 8, 1985 in the Municipal Complex Conference Room, 1400 Live Oak Road. Members present were as follows: PLANNING AND ZONING COMMISSION THOMAS YARLING, VICE-CHAIRMAN DARWIN PEEK, SECRETARY RAYMOND STANHOPE' MERWIN WILLMAN BOB ANDREWS JAMES HARDEN OTHERS PRESENT DON RYCKMAN A. STEELE ALLEN HAMBLEN DON DECKER JOE HOFFMAN LYNN MILLEGAN MEMBERS ABSENT JOHN LINEBARGER, CHAIRMAN CITY STAFF EARL HARTZOG, PLANNING COORDINATOR #1 CALL TO ORDER - . Vice-Chairman Yarling called the meeting to order at 7:00 P.M. #2 APPROVAL OF MINUTES: Regular Session December 11, 1984 It was noted Item #5B was not complete and should be amended as follows: "It was agreed this item should be added to the appropriate section of the Zoning Ordinance when revised, and need not have the public hearing since it was added to the Zoning Ordinance by Ordinance 84-S-17, dated 24 July, 1984". Item #9 - second paragraph, last sentence should read: "The status of each State Highway within the City was briefly discussed". Darwin Peek made a motion to approve the minutes as amended above and Ray Stanhope secended the motion. The vote was unanimous in favor. #3 CONSIDER AND TAKE APPROPRIATE ACTION: Preliminary Plat Light Subdivision Earl Hartzog gave each member of the Commission a copy of the plat and explained the background on this project. He advised the Commission that the engineer asked that preliminary plat approval be deferred on this plat until the next meeting because of some problem with the elevation for the floodplain for Block 1, Lot 1. After a short discussion, Ray Stanhope made a motion to table action on the preliminary plat until the next meeting. Bob Andrews seconded the motion and the e vote was unanimous in favor. e e -, e -.. #4 CONSIDER AND TAKE APPROPRIATE ACTION: Preliminary Plat Schaefer Village Unit II . Lynn Millegan presented the preliminary plat for this project. They planned to consolidate Unit I and II and construct the complete project at one time. The safety lanes within the park will be conc REtE with a three-foot side- walk on each side of the safety lane within the park. Hillbrook would be constructed to City street specifications, and the developer would like to dedicate to the City, provided a ten-foot building setback line could be permitted. It was noted the preliminary plat overlapped Unit I, and the master plan submitted did not show a driveway off of Schaefer Road. Mr. Decker advised tHat the project should be completed within the next six months. It was noted the preliminary plat did have the owner, volume and page identi- fied, no names for the safety lanes, Block and Lot numbers, floodplain state- ment, Commission Court approval, Block and Benchmark for the elevations. There was a lengthy discussion including a committment from the developer to require each Mobile Home to have the gas lines tested before providing gas service. Ray Stanhope made a motion to approve the preliminary plat for Unit II with the following provisions - Hillbrook should be put in according to City specifications and dedicated to the public, eliminate the entrance off of Schaefer Road and the ten-foot building setback off of Hillbrook would be acceptable. Darwin Peek seconded the motion and the vote was unanimous in favor. Mr. Decker was advised the request for overslzlng water and sewer improvements would require Council approval as well as any improvement made under the Utility Extension Policy. The City Staff was to be contacted on this matter. The temporary water line along Hillbrook to service the existing residence would require the approval of the City Water Department. #5 CONSIDER AND MAKE RECOMMENDATION: Zoning Change Ml to MH West side of Doerr Lane Lynn Millegan presented to the Commission a rezoning request for approximately eighty-seven acres of land located between Missouri-Pacific Railroad and Missouri-Kansas-Texas Railroads located west of Doerr Road. The request was to change the zoning from industrial to a Mobile Home District with plans for a Mobile Home Park. After a lengthy discussion about the dangerous situation because of the railroad track and surrounding industrial zoning with the possibility of hazardous mate- rial accident, the proposed use was not acceptable to each member on the Commis- sion. It was also noted that there are a number of Mobile Home Parks already being established in the City, and the Commission needs to control the number. It was noted that none of the four items in Article XIX, paragraph 2.2.2 of Zoning Ordinance 79-S-15 would permit the zoning request. Ray Stanhope made a motion to deny the rezoning request. Darwin Peek seconded the motion and the vote was unanimous in favor. . e Vice-Chairman Yarling advised those present that the applicant has the option to appeal the Planning and Zoning Commission's decision to the City Board of Adjustment. Mr. Decker thanked the Commission for their time and advised they would not appeal the Commission's decision. #6 CONSIDER AND TAKE APPROPRIATE ACTION: Final Plat Kahn Subdivision There was a short discussion about this project and the completion of . construction. Earl Hartzog advised the Commission the final test on the water line had not been completed, and the signing of the plat could be held until the proper documents are received by the Staff. It was agreed each Mobile Home'should have the gas lines tested before providing gas service to each unit. The smallest lot would be 60' by 118' and the water would be obtained from the City of Schertz. Bob Andrews made a motion to approve the final plat. James Harden seconded the motion and the vote was unanimous in favor. #7 CONSIDER AND TAKE APPROPRIATE ACTION: Home Occupation - 500 Aviation Allen Hamblen presented his request for a Home Occupation at his residence to the Planning and Zoning Commission. Each member was given a letter with the concurrence of the surrounding property owners. e - , Vice-Chairman Yarling advised the other members of the requirements in the Ordinance and the Commission authority to approve the request. Darwin Peek made a motion to grant an exception and authorize the Home Occupation. Ray Stanhope seconded the motion and the vote was unanimous in favor. #8 CONSIDER AND MAKE RECOMMENDATION: FM 3009 Special Overlay District The Commission reviewed the proposed change to the Zoning Ordinance and made minor changes to a few items. #9 GENERAL DISCUSSION There was a brief discussion on the number of satellite dishes being placed in the City, and there was concern as to whether or not the public was aware of the requirement to obtain a building permit. There was discussion on the Subdivision Ordinance, Mobile Home Ordinance, Zoning Changes, and the need for the Floodplain Map to be updated with Master Flood Control Plan. There was discussion about various violations of the City Ordinance taking place along FM 78. The Trailer Park looks like a junkyard and different vehicles are parking in the right-of-way of FM 78. Main and FM 78 have signs with flashing lights and portable signs within fifty feet of the right-of-way. e 410 ADJOURNMENT Vice-Chairman Yarling adjourned the meeting at 10:30 P.M.
